Right of Way

  • Pedestrians always have the right of way. So, no matter where you encounter a pedestrian on the road, they always have the right of way. This includes crosswalks, round-a-bouts, at intersections not marked with signals and at street corners. Crosswalks are sometimes defined by white lines or flashing lights. Crosswalks are outlined in yellow near schools.

California Pedestrian Law

“Under California Vehicle Code Section 21950 (a) The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.

(b) This section does not relieve a pedestrian from the duty of using due care for his or her safety. No pedestrian may suddenly leave a curb or other place of safety and walk or run into the path of a vehicle that is so close as to constitute an immediate hazard. No pedestrian may unnecessarily stop or delay traffic while in a marked or unmarked crosswalk.

(c) The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.

(d) Subdivision (b) does not relieve a driver of a vehicle from the duty of exercising due care for the safety of any pedestrian within any marked crosswalk or within any unmarked crosswalk at an intersection.”

Elderly bicyclist suffers major injuries in collision with school bus

According to the California Highway Patrol, the man was hit at the intersection of Prospect Road and South De Anza Boulevard around 2:10 p.m.

Officer Chris Falkowski said the driver of the bus and students were not injured. He did not know how many students were on the bus — which was a compact shorter model — or what school it was affiliated with.

The man was transported to a hospital, but his condition was not known Friday evening.

What led to the crash is under investigation.

Five women killed in San Mateo Bridge limo fire

A limousine in the San Francisco area caught fire Saturday night while carrying nine women. Four of the passengers and the male driver managed to escape, but five of the women died in the blaze.

The  limousine traveling on a major bridge in the San Francisco Bay area burst into flames, killing five female passengers who were trapped inside and injuring four others who escaped, authorities said Sunday.

The limo was carrying nine female passengers and a male driver when it caught fire late Saturday on the San Mateo bridge, California Highway Patrol officer Art Montiel told The Associated Press.

Five occupants became trapped, while four others suffered injuries but managed to get out after the vehicle came to a stop on the bridge, the patrol said. The driver escaped uninjured.

Montiel said that the victims were all in their 30s. Authorities said the names of the dead would be released once families have been notified.

The blaze occurred around 10 p.m. on westbound lanes of the bridge, which connects San Mateo and Alameda counties, about 20 miles southeast of San Francisco.

The patrol said that smoke started coming out of the rear of the limo, and the driver pulled over as the vehicle quickly became engulfed in flames. Officers were trying to determine the cause of the blaze, which wasn’t the result of an accident.

“We have no idea right now where they were going or where they were coming from,” CHP officer Amelia Jack told KGO-TV.

Two of the women who escaped were taken to Stanford Hospital and the two others were taken to Valley Medical Center in San Jose. All four are being treated for smoke inhalation and burns.

The mother of one of the survivors of a limousine fire that killed five women when it burst into flames as it traveled over a busy San Francisco Bay bridge says the women were heading to a bachelorette party.

Rosita Guardiano tells the San Francisco Chronicle that the bride-to-be was one of the people killed in the Saturday night fire on theSan Mateo-Hayward Bridge. She says the woman was to be married next month.

Guardiano says her daughter — 42-year-old Mary Grace Guardiano of Alameda — is in intensive care, where she’s being treated for smoke inhalation. Three other woman also suffered smoke inhalation and burns.

2 dead after 2 small planes collide in midair near Malibu

WESTLAKE VILLAGE, Calif. — A second body has been found in the wreckage of one of two small planes that collided over the Santa Monica Mountains on Monday.

It was initially reported that only the pilot of one of the planes was killed.

But on Tuesday morning, L.A. County Sheriff’s spokesman Steve Whitmore confirmed that two bodies were found in the wreckage of that plane.

According to Whitmore, the collision sent the plane plummeting directly into the side of the mountain.

The other aircraft, which had three people aboard, made an emergency landing at the Westlake Village Golf Course.

National Transportation Safety Board investigators were at the scene Tuesday trying to piece together what happened.

Both planes were Cessna single-engine aircraft which departed from Santa Monica Airport, according to preliminary information from the FAA.

The body of the pilot of the plane that crashed in the mountains was spotted Monday evening in rugged terrain near Mulholland Highway and Las Virgenes Road, the L.A. County Sheriff’s Department said.

Radar information indicated the two Cessna 172s collided about eight miles east northeast of Ventura about 2 p.m., FAA spokesman Allen Kenitzer said in a statement.

The plane that left Santa Monica Airport was making an engine test flight and heading east when it collided with the other aircraft, according to the FAA.

The crash sparked a fire that was quickly knocked down after burning about an acre of dry brush, officials said.

The other Cessna ended up in the middle of the third fairway at Westlake Village Golf Course.

The hard landing resulted in non-life-threatening injuries to the three people on board, L.A. County sheriff’s officials said.

County fire officials and witnesses said the landing gear was still up when the plane came down.

One of the people aboard complained of back pain and was taken to a hospital, according to authorities.

Golfer Aaron Jesse, 47, said the plane came in silently and hit the ground with a thud.

Jesse said the plane clipped a tree, which spun the aircraft around 180 degrees. Jesse marveled that the pilot seemed to land gently — taking out only four inches of grass and dirt.

One dead, two injured in Highway 152 crash

A Southern California man is dead and two others are in the hospital following a solo-vehicle crash on Highway 152 during commute hours Monday morning.

California Highway Patrol spokesman Matt Pinheiro said Joshua Burke, 21, of Garden Grove was driving a 2004 GMC utility truck westbound in the fast lane west of Box Car Road, about 6 1/2 miles east of Los Banos, at 6:59 a.m. when the truck veered to the right and hit a guard rail. Pinheiro said the truck went into the air and landed on the side of an irrigation canal.

Pinheiro said Burke and his two passengers, Eric Rodriguez, 21, of Long Beach and a 35-year-old man from Murietta, were trapped in the truck, which caught fire in its engine compartment after the crash. The 35-year-old was pronounced dead at the scene. His name was being withheld by law enforcement until his family is notified.

Pinheiro said Burke was airlifted to Memorial Medical Center in Modesto and Rodriguez was taken to Community Regional Medical Center in Fresno. Both men were suffering from major injuries, including burns on various parts of their bodies.

Cause of the Highway 152 Crash

Fatal Traffic Collision in Hesperia

On April 23, 2013 at about 2:50 p.m, Deputies from the Hesperia Station and units from the California Highway Patrol along with rescue personnel from the San Bernardino County Fire Department responded to a report of a two vehicle, head on traffic collision in the area of Hwy 138 and Little Horsethief Ranch Rd. in Hesperia. It was reported that the two vehicles had collided head on and that there were serious injuries to several parties. Rescue personnel arrived on scene and discovered that the male driver of a 1991 Ford Explorer was trapped inside his vehicle and suffered fatal injuries upon impact. The driver was later identified as Robert E. Miller, age 57 of Victorville. A male passenger from that same vehicle was suffering from injuries, not life threatening.

Three occupants from the second vehicle, a 1999 Toyota minivan were also seriously injured, one with life threatening head injuries. Rescue personnel extricated the victims from their vehicles and all were transported to Arrowhead Regional Medical Center by both air and ground transportation.

The Hesperia Station Major Accident Investigation Team (MAIT) responded to conduct the investigation. It was determined that for unknown reasons the driver of the Ford Explorer who was traveling east on Hwy 138 at an undetermined speed, crossed over into the westbound lanes and collided head on into the Toyota minivan as it traveled west on Hwy 138.

Hwy 138 was closed in both directions between Summit Valley Rd. and Hwy 173 until about 1930 hours while investigators processed the scene for evidence. At this time the exact cause of the collision and why the driver of the Ford Explorer crossed into the westbound lane is still under investigation by the Hesperia Station Traffic Division MAIT Investigators.

Bus Crashes near Yosemite: More than a Dozen Injured

As reported in the Los Angeles Times the charter tour bus that crashed Saturday evening outside Yosemite National Park, injuring more than a dozen people, was traveling at an unsafe speed when the driver lost control, according to the California Highway Patrol.

The bus was leaving Yosemite on California 41, or Wawona Road, about 6 p.m., when it veered off the roadway and angled up a dirt embankment, according to a CHP report. As the driver attempted to regain control of the vehicle, the bus crossed both lanes of traffic and struck a tree.

“If the tree wasn’t there to stop the bus, it would have continued down a ravine,” CHP Patrol Sgt. Edward Green told the Fresno Bee. The bus came to a stop with its two rear tires in the air.

Seventeen people were aboard the vehicle; 15 passengers and a tour guide sustained minor to moderate injuries in the crash, authorities said. The driver was uninjured.

The speed limit for the road is 55 mph, but several turns in the roadway require slowing, according to Scott Jobinger, a CHP spokesman. The accident occurred about a mile north of local road 630 and about 40 miles south of the park.

The bus was operated by Seven Happiness Tour and Charter Inc. in Burlingame, Calif., Jobinger said.

Adam Wang, a manager with Seven Happiness, said that the tour began Saturday morning in the Bay Area, and after a tour of the park, the bus was headed to Fresno for the night. It was to return to Burlingame on Sunday. Seven Happiness runs about two charters to Yosemite each week.

Intoxication was not a factor in the crash, the CHP said. A vehicle inspection will be performed on the bus to determine if there were any mechanical issue involved in the accident.

Demand accountability from those responsible for the bus accidents.  A bus driver is a “common carrier” who owes you the “highest duty of care!”  Many times the insurance companies for the bus companies (i.e., many times they are “self insured”) will play “hardball” if you try to settle the case yourself or you have employed a lawyer who does not have the litigation experience to handle such a complex bus case.  We at the Law Offices of Gary A Kessler have over twenty-five years of litigation experience and know how to handle the insurance companies to your advantage.    We are prepared to front all costs required for the necessary investigation and expert witnesses needed to prepare your case for trial as well as file all government claims.  Unfortunately, the reality is that most bus accident victims usually sustain serious/catastrophic injuries which many times results in death.  Over the past twenty years attorney Gary A Kessler has a proven successful track record demanding accountability from the responsible parties and obtaining outstanding results for his clients.
