Roadway cleared, fatal crash still under investigation

11:58 a.m.: Emergency crews have cleared the scene of a fatal traffic accident that claimed the life of a 21-year-old Hanford woman early this morning.
The California Highway Patrol said the victim, 21-year-old Ariel Marie Gieseman, was driving east on Flint Avenue around 9:40 a.m. when she collided with the left rear axle of a milk tanker that was turning into the westbound lane.
Witnesses pulled the girl from her wrecked Nissan, but could not find a pulse. She was later pronounced dead at the scene.
The accident blocked traffic through Flint Avenue, about a half mile east of Seventh Avenue, for more than an hour until authorities could clear the scene.
Jerry Pierce, a CHP spokesman, said it is still too early to say who was at fault in the crash. Dense morning fog may have been responsible for at least three crashes reported this morning, all still under investigation by the Highway Patrol.
Cause of the Kings County Crash
Investigators said visibility on Flint Avenue around 9:35 a.m. was down to about 500 feet because of the fog. Gieseman would have had little time to react before the collision. The crash remains under active investigation.

UPS big-rig driver dies in crash near Cajon Pass

A collision between a sports car and a big rig this morning in the Cajon Pass killed the truck’s driver and closed the northbound freeway lanes for about two hours.
The big rig, owned by package shipper UPS, overturned at 6:53 a.m. today just south of Oak Hill Road, crushing the cab and trapping the driver, Alfred Eclipse Jr., of Norwalk, the Highway Patrol said in a news release. Eclipse died at the scene.
Nathan Hebert, 32, of San Bernardino, was at the wheel of a 2005 Nissan 350Z and was reported to be speeding shortly before the car swerved into the center divider, then veered back across traffic lanes and collided with the big rig’s left front wheel, the CHP said in the news release.
“It appears the (truck) driver tried to avoid the collision,” said CHP Officer Hope Maxson by telephone this morning. “But they did collide. And the tractor-trailer went rolling off the right shoulder. It overturned onto its side and down an embankment.”
Hebert suffered minor injuries, the CHP said.
The wreck closed three of the five northbound lanes and triggered a SigAlert.
Cause of the Cajon Pass Crash
Based on news reports Officers said Hebert told them that he was cut off by a silver Toyota Camry, but investigators still haven’t determined what caused the Nissan to lose control and eventually trigger the crash. The accident remains under investigation.
Car Accident Wrongful Death Liability
The term “wrongful death” is defined as the death of an individual as a result of the negligence, carelessness, intentional act of another individual, corporation, company or entity. In most states, if the death of a relative or spouse was caused by the wrongful act of another, surviving family members can file a wrongful death lawsuit against the negligent party or parties. Bull Mastiff Attacks, Tearing Off Ear Of 6-Year-Old Boy In Moreno Valley

MORENO VALLEY — A large bull mastiff has been caught and quarantined after it attacked a woman and her child Tuesday, biting off part of his ear.
The mauling was reported at 11:42 a.m. outside a home on Indian Street, just south of Myers Avenue.
The woman was walking with her son, 6, and pushing a stroller with a younger child at 11:40 a.m. on Indian Avenue when a 120-pound bull mastiff jumped a chain link fence from a nearby yard and begin attacking the boy, according to Riverside County sheriff’s Cpl. Courtney Donowho.
The dog latched onto the boy’s head, partially severing his right ear, Moreno Valley Animal Services Manager Steve Fries said.
Authorities said the mother fought off the dog, which then turned on her, biting her left hip.
The child in the stroller was not injured.
The dog’s owner came out of his home and was able to pull the dog back into the backyard before authorities arrived.
Both the mother and the son were hospitalized for dog bite injuries and are expected to recover.
Moreno Valley animal control officers took the dog to the city shelter, where it will be quarantined for the next 10 days. The homeowner turned over ownership of the dog to animal control officers. The 18-month-old, male animal will probably be euthanized, Fries said.
“We wouldn’t consider this dog a candidate for adoption,” Fries said, noting that it attacked two people unprovoked.
From what the witnesses told me, the dog just hit the fence and bulldozed through,” an animal control officer told reporters.
The dog is big – estimated to weigh 160 pounds. It took four people to subdue the dog and get it into the animal control truck, Mills reports.
A honk from a passing car interrupted the attack, and may have saved the child’s life, Mills reports.
The owners of the dog were cooperative, turned the dog over and were cited. The dog will be quarantined for 10 days and then euthanized.
Dog Attacks and serious injury liability
CALIFORNIA DOG BITE STATUTE SECTION 3342
Under California Law, it is no longer necessary for the Plaintiff to prove that the dog was known to be vicious or had a propensity to bite. One bite alone is sufficient for liability. Dog owners do not get a second chance in California. They are liable for any injury their animals cause regardless of whether the animal had bitten anyone previously. Under California Dog Bite Statute Section 3342 the Plaintiff must prove in a dog bite case the following:
- Defendant owned the dog;
- The dog bit the Plaintiff;
- The Plaintiff was lawfully on the premises (express or implied consent to be on the premises) where the bite occured; and
- Plaintiff sustained injuries from the dog bite.
What You Should Do If You Or A Loved One Has Been Bitten By A Dog:
- Take pictures of your injuries immediately;
- Consult law enforcement and request that a police report be made;
- Keep copies of all medical bills and records;
- Continue to take pictures of the bite(s) as the wounds heal;
- Be sure that your doctor is qualified and determine if you are a candidate for plastic surgery to get rid of the scarring;
- If an adult who is employed sustained injuries and lost wages, keep a record of economic loss.
WE WILL FIGHT FOR YOU!
Demand accountability from dog owners. Settling dog bite claims can be difficult and complex. Many times the insurance companies will play “hardball” if you try to settle the case yourself or you have employed a lawyer who does not have the litigation experience to handle such a case. We at the Law Offices of Gary A Kessler have 20 years of litigation experience and we know how to handle the insurance companies. We are prepared to front all of the costs required for the necessary investigations and expert witnesses needed to prepare your case for trial. Are the other law firms you are considering willing to front all costs?
In a dog bite case, we advance all legal costs to prepare and present our client’s claim, and receive a percentage of the settlement or verdict of what we recover for our attorney’s fees on their behalf. Upon settlement our costs shall be reimbursed to us from the gross recovery. If there is no recovery, no attorney’s fees or costs are owed to our firm. Thus, in all personal injury cases, our fees are recovered as a percentage of any settlement or verdict awarded to our clients.

LANCASTER, Calif. (KTLA) — Sheriff’s detectives investigating the shooting death of a man Saturday by deputies have not found the weapon the deputies thought the man was reaching for when they shot him.
The shooting happened around 10:55 p.m. Saturday near the intersection of 10th Street West and Avenue J-4.
Two deputies approached Christian Cobian, 26, because he did not have a light on his bicycle.
Cobian ignored the deputies’ commands to stop, abandoned his bicycle and began running.
The deputies chased Cobian for a short distance before he allegedly reached for his waistband. That’s when at least one of the deputies opened fire, hitting Cobian.

Sheriff’s officials said Cobian, a gang member in Inglewood, was wanted on a felony narcotics warrant.
He was on probation for receiving stolen property and had three previous felony convictions.

Relatives say they recently moved to Lancaster from Inglewood to get away from crime and gangs.
The shooting remains under investigation. The Los Angeles County District Attorney’s Office will determine if the shooting was justified.

Woman in Wheelchair Killed in San Bernardino Fire

SAN BERNARDINO, Calif. (KTLA) — An arson task force was on the scene of a deadly fire in San Bernardino Monday.

Fires and explosions are sudden and devastating, destroying homes and buildings, and causing physical injuries and death. Burn injuries are painful and disfiguring, and require long recovery periods. Smoke inhalation, and inhalation of toxic fumes and gases from flammable fabrics and furniture stuffed with polyurethane foam, cause added injury and increase the likelihood of death.
The Law Offices of Gary A Kessler regularly represent plaintiffs in cases of catastrophic injury and wrongful death in fires and explosions caused or exacerbated by unsafe premises, unsafe construction sites, and unsafe products.
Faulty electrical wiring and furnaces, gas leaks, malfunctioning or absent smoke detectors, inaccessible or inadequate escape routes, the pressence of flammable fabrics and furniture, and the presence of dried vegetation that can fuel wild and urban interface fires are all examples of sources of liability for property owners or product manufacturers.
Determining the cause of a fire or explosion requires extensive experience and thorough investigation involving engineering, electrical, and gas line experts as well as fire scene experts. The Law Offices of Gary A Kessler has the experience and the resources to effectively prepare and litigate cases on behalf of plaintiffs and family members injured or killed in fires and explosions.
With over 20 years of experience, Gary A Kessler has earned the respect of our colleagues and the courts in California and nationwide for our personal injury work.
