MOJAVE DESERT: Big-rig wreck kills motorist near Baker
A big-rig rear-ended a car yesterday along Interstate 15 deep in the Mojave Desert killing a 59-year-old Las Vegas woman who was driving the 2012 Chevy Impala, according to San Bernardino County coroner’s officials and California Highway Patrol officers.
Juanita Mullin died at the scene of the 10:46 a.m. wreck Monday along the freeway’s northbound lanes about four miles north of Baker.
“For unknown reasons, (Mullin) was either stopped or traveling extremely slow … with the vehicle’s emergency flashers activated,” CHP officers said in a written statement.
A 67-year-old trucker driving a 2008 International momentarily diverted his attention by looking inside his cab and slammed into the car, causing the Impala to overturn and the big-rig to run off the freeway and up an embankment, according to the statement.
Fault and Wrongful Death Liability
Accidents involving big-rigs have unique and complex legal issues. If it is determined that the driver of the big-rig was at fault for this collision, the family of the victim would be well-advised to speak to a California truck accident attorney. An experienced and knowledgeable attorney will be able to review the cause of the accident, and if warranted, arrange for an independent investigator to reconstruct the collision to determine exactly what happened and who was responsible. A skilled lawyer can also provide an explanation to the victim’s family on their legal rights in a wrongful death claim against the driver or any other parties at fault. Damages awarded in a wrongful death claim may include funeral and burial expenses, lost earnings, pain and suffering, and other damages.

Two Dogs Attack Man Walking Dog, Injure Both
A man and the dog he was walking were both injured seriously enough to require medical attention after they were attacked by two dogs on Friday evening near the intersection of Figueroa Drive and Casitas Avenue.
Ken Hayashi, a neighborhood resident, told Patch he was walking an elderly neighbor’s dog that he regularly helps with and never saw the animals coming. He said the dogs that attacked him were two pit bulls that are usually locked behind a gate near his home. Hayashi said he never saw them coming.
“The dogs came from behind and they surprised the heck out of me,” Hayashi said.
Lt. Duane Allen of the Los Angeles County Sheriff’s Department confirmed that deputies were called to the scene and that Hayashi was transported to the hospital following the attack, which took place around 6:30 p.m. on Friday.
Hayashi said he is now feeling OK, but did need stitches in several areas where he was bitten. The dog he was walking, a dachshund mix named Sammi Jo, had serious punctures to her neck which required stitches. A photo of her injuries can be viewed above.
According to Hayashi, the owners of the dogs have given the animals over to the Animal Control Department since the attack. A department spokeswoman was unable to find record of the dogs or the attack when contacted by Patch, but said she would continue to try to find out more about the dogs.
Lois Todd, a neighbor of Hayashi’s who brought the attack to the attention of Altadena Patch, said she has been concerned about aggressive dogs in her neighborhood for a long time.
Todd, a dog owner herself, said she feels like the neighborhood is not a good place for smaller dogs.
“It seems like there is a pit bull at every house,” Todd said.
Todd brought Sammi Jo to a clinic in Eagle Rock following the attack. She said the dog is a rescue and is nervous around people, which made it hard for the vets to take care of her wounds. She said Sammi Jo had two wounds on her upper neck and back that needed to be drained, as well as punctures in the ears.
Todd said she was unhappy with the response of the Sheriff’s Department, and wished someone had taken away the attacking dogs immediately following the incident.
Lt. Allen said department policy with dog attacks is to contact Animal Control and have them handle the dogs. He said the department will intervene if they witness an attack, but if the dogs are secure behind a gate, as the attacking dogs were by the time deputies got to the scene, then they contact Animal Control to follow up.
Sometimes that can take several hours or longer, Allen said.
Hayashi said his understanding is that the pit bull owners contacted Animal Control to have the dogs taken away.
Additionally, Hayashi said he was unhappy with comments that deputies on the scene made to him when they arrived: he said that the first thing the deputy said was to ask him if he spoke English or not. Hayashi, who is Asian-American and was born in California, said he took offense, especially because he was bleeding and clearly needed medical attention.
Hayashi said he has not filed a complaint with the Sheriff’s Department, and Allen said he has no record of anyone in the neighborhood filing a complaint about how the department handled the incident.
Dog Attacks and personal injury liability
CALIFORNIA DOG BITE STATUTE SECTION 3342
Under California Law, it is no longer necessary for the Plaintiff to prove that the dog was known to be vicious or had a propensity to bite. One bite alone is sufficient for liability. Dog owners do not get a second chance in California. They are liable for any injury their animals cause regardless of whether the animal had bitten anyone previously. Under California Dog Bite Statute Section 3342 the Plaintiff must prove in a dog bite case the following:
- Defendant owned the dog;
- The dog bit the Plaintiff;
- The Plaintiff was lawfully on the premises (express or implied consent to be on the premises) where the bite occured; and
- Plaintiff sustained injuries from the dog bite.
What You Should Do If You Or A Loved One Has Been Bitten By A Dog:
- Take pictures of your injuries immediately;
- Consult law enforcement and request that a police report be made;
- Keep copies of all medical bills and records;
- Continue to take pictures of the bite(s) as the wounds heal;
- Be sure that your doctor is qualified and determine if you are a candidate for plastic surgery to get rid of the scarring;
- If an adult who is employed sustained injuries and lost wages, keep a record of economic loss.
WE WILL FIGHT FOR YOU!

An Irish tourist driving on the wrong side of a remote stretch of Highway 1 in San Mateo County caused a head-on collision Saturday night that left five people injured, police said.
The 34-year-old Irish man, who was not named, “was unfamiliar with American roadways” and ended up driving his Toyota north in the south bound lanes near Tunitas Creek Road around 8:05 p.m., according to the California Highway Patrol. He’d pulled back onto the road after stopping to take some pictures when he suddenly spotted a south bound Acura coming right at him.
In an effort to avoid a crash, the Irish man and the Acura’s driver veered to the right side south bound Highway 1 but collided head on, police said. The 43-year-old man behind the wheel of the Acura and a 42-year woman passenger, both of Pescadero, as well as the tourist suffered major injuries in the crash. They were all rushed to Stanford Hospital, police said.

4 people injured after rollover accident on Kearny Villa Rd

SAN DIEGO – Alcohol may be to blame for a rollover car crash in the Miramar area that sent four people to hospitals early Friday, police said.
The crash near Kearny Villa and Miramar roads was reported at 3:45 a.m., according to San Diego police Officer Frank Cali.
The driver of a 2008 Honda headed north on Kearny Villa Road, with three passengers on board, over-corrected on a curve and struck a center divider, Cali said in a statement. The car then overturned several times, he said.
All four occupants were taken to local hospitals, including one male passenger who suffered serious hand and face injuries, according to Cali.
“Think of yourself, think of your family. Look at this wreck here. You know you could walk away or you could die or you could hurt somebody and the rest of your life will be destroyed for a little bit of alcohol or talking on the cell phone is not worth it,” John Hendricks of the San Diego Police Department said.
Police say the driver was not under the influence, but the passengers may have been drunk.

Drowning deaths: Civic body slaps Rs 50,000 fine on contractor
A day after three brothers drowned in a pit dug along the Mithi river in Kalina, the Brihanmumbai Municipal Corporation (BMC) fined the contractor a meagre Rs 50,000. The civic body also sent a showcause notice to Shyam Narayan on Wednesday, asking him to explain the security lapses around the construction site in terms of proper barricading. BMC officials admitted that the security guards employed by the contractor were not present at the site on Tuesday since it was a public holiday.
While the Kurla police station had earlier named MMRDA officials in the FIR on Tuesday, on Wednesday it was made clear by MMRDA that the work was being done by the BMC. “Investigations showed that the BMC contractor is responsible for the negligence that claimed the lives of three children. We have now named the contractor in the probe,” said Deputy Commissioner of Police (Zone V) Dhananjay Kulkarni.
According to senior civic officials, contractors are responsible for maintaining security around construction sites. They are expected to adhere to the tenders conditions, whereby they are expected to adequately barricade the construction site and deploy security guards to monitor the area. Often, however, the tin barricades are stolen by local residents who sell them in the scrap market.
Chief engineer (storm water drains) L S Watkar said, “We have taken the necessary action by penalising the contractor. He has been asked to respond to the security lapses.”
“Anyone can easily trespass to the trench after crossing the premises of Kailas Parbat residential building at Kapadia Nagar. People from our slum have been regularly complaining to all agencies and the police department to put in place security measures since most of the children play here for lack of any other place,” said Azhar Chaudhury, resident of the area and uncle of the three children who drowned on Tuesday.
Eight-year-old twins Abdul Rahim and Abdul Karim and 12-year-old Abdul Aziz were playing in the open area adjacent to the river at Kapadia Nagar on CST Road when the incident took place. The pit was dug as part of the ongoing Mithi river project being undertaken by the BMC, under which retaining walls are being built to train the flow of the river.
