Wrongful Death

Tulare woman killed in rollover at J Street and Highway 99

A woman killed in a single-car rollover north of Tulare early Sunday morning has been identified as Rosa Estrada, 22, of Tulare, said the Tulare County Sheriff-Coroner’s office.

The California Highway Patrol said Estrada was not wearing a seatbelt and was thrown from the car when it overturned off the J Street onramp onto Highway 99 north of Tulare at 1:20 a.m. Sunday.

The driver, Giovanni Ferreira, 22, of Visalia, was northbound on the J Street onramp when he failed to negotiate a curve and ran off the road, the CHP said. Ferreira’s 2005 Toyota Corolla ran through a metal guard rail and overturned several times. Ferreira was wearing a seatbelt and sustained minor injuries. He was treated at Kaweah Delta Medical Center in Visalia.

Cause of the Tulare Crash

If news accounts  are accurate, the driver Giovanni Ferreira, 22, of Visalia,  is likely  responsible for causing this accident. However, the accident is still under investigation by the California Highway Patrol and an official determination of the cause of the Tulare  County crash has not been made. The CHP did say that alcohol was a contributing factor in the collision.

Alcohol  impaired driving accidents and wrongful death liability

Driving under the impairment of alcohol or drugs is a conscious choice, and drivers who choose to drive under the influence may face both criminal consequences for their actions, and civil liability for wrongful death or personal injury. While this accident remains under investigation, the family members of the  victims may benefit from speaking to an experienced and knowledgeable Tulare County DUI accident victim attorney. A skilled attorney who has represented numerous victims of alcohol related conditions can advise the victims’ families of their legal rights and best course of action to hold the driver accountable to the maximum legal extent.
The laws regarding wrongful death cases are complex and include many facets of the law.  It is vital to surviving family members to seek the advice of an experienced personal injury lawyer such as Gary A Kessler at the Law Offices of Gary A Kessler to protect your rights and those of your loved ones.

One-car fatality linked to intoxication

A one-car accident at the junction of state Route 163 and Interstate 8 left one person dead and two others injured early Sunday. It also closed part of the interchange for about two hours.

At about 3:25 a.m., the driver of a Chevrolet HHR was traveling fast through the transition road from northbound Route 163 to the eastbound interstate, according to the California Highway Patrol.

The vehicle flipped, ejecting two of three passengers. One passenger died, another suffered minor injuries and a third sustained major injuries, according to CHP. It said the driver appeared uninjured but will be charged with felony DUI and manslaughter.

The name of the dead passenger has not been released.

Cause of the San Diego County Crash

As a passenger, the deceased likely could have done nothing to prevent this fatal roll over collision that ultimately took their life. The California Highway Patrol  will surely look at the speed of the vehicle, witness reports, and other factors to determine what occurred and who was responsible. roll over collisions such as this one can have countless causes, including unsafe passing maneuvers, swerving to avoid an object in the road, falling asleep at the wheel, driving under the influence, or driver distraction.

According to the California Highway Patrol the crash was “due to the driver’s state of intoxication, the driver failed to maintain effective control of the vehicle, which ran off the left side of the roadway”.

The Law Offices of Gary A Kessler is a prominent and highly respected law firm in California and the United States.  Gary A Kessler has been serving the people as an experienced wrongful death attorney for over twenty years dedicated and committed to obtaining the best results for his clients in each and every case.  Through experience and education, our firm is able to expertly evaluate complex medical injuries and pursue wrongful death claims.

The Law Offices of Gary A Kessler has a sustaining record of outstanding results for their client’s wrongful death cases throughout California, Nevada, Arizona, Florida, Oregon and Washington.  Our firm specializes in difficult automobile vs. tractor-trailer rig(s), collision cases, uninsured motorists cases, rollover accident cases, bus and train collision litigation, defective product liabilty litigation, boating collision death cases, boating capsizing and drowning cases, backyard pool drownings, jacuzzi spa drownings, association and community pool drownings, accidental shootings, tractor-trailer and commercial vehicle fatality, fuel tank fire cases and wrongful death cases.

The term “wrongful death” is defined as the death of an individual as a result of the negligence, carelessness, intentional act of another individual, corporation, company or entity.  Filing a proper wrongful death claim is extremely difficult and complex for families because they are not only dealing with their grief over the death of a beloved family member, but also complex issues of compensation as well.  Wrongful death claims are usually sought after by relatives, siblings, or members of the decedent’s estate who have lost a considerable amount of money as well as loss of support and grief due to the wrongful death of the decedent.

In most states, if the death of a relative or spouse was caused by the wrongful act of another, surviving family members can file a wrongful death lawsuit against the negligent party or parties.  In order to file a wrongful death claim, you must be able to prove that you will experience severe future emotional and financial hardship because of the loss of the death of a relative, family member or spouse.

San Jose pedestrian killed Saturday is city’s second traffic fatality in 10 hours

A 77-year-old woman died Saturday morning after being struck by a car as she crossed a San Jose street, police said.
She was the second San Jose pedestrian to die from injuries sustained in a traffic accident within 12 hours.
Officers responded to a 6:47 a.m. call reporting the collision and found the woman at the intersection of Oakland Road and Rock Avenue, Sgt. Jason Dwyer said.
She had been walking northbound on Oakland Road when she was struck by a 1999 Honda Civic, Dwyer said.
The pedestrian, whose name was not released Saturday because her family hadn’t yet been notified, was transported to Regional Medical Center of San Jose, where she was pronounced dead at 8:46 a.m., police said. The driver of the Honda was interviewed by police and released, authorities said.
Police said the driver was not driving under the influence of alcohol or drugs and they still are investigating the pedestrian’s level of sobriety. The incident was San Jose’s fourth traffic-related fatality of 2012.
Another pedestrian was killed shortly after 8:35 p.m. Friday, when a woman was struck by a vehicle while walking on Meridian Avenue near San Carlos Street. She was pronounced dead at the scene about 10 minutes after the accident, authorities said. Her name had not been released as of late Saturday.

Cause of the San Jose Pedestrian Accident

Pedestrian Accident Personal Injury Liability

When you suffer serious/traumatic injuries or a loved one’s death, you are entitled to compensation (medical bills, funeral costs, lost wages, future wages and pain and suffering).  The Law Offices of Gary A Kessler will aggressively represent you and fight for your rights against the insurance companies for the monetary damages you deserve.

Unfortunately, the reality of most pedestrian and bicycle accident victims usually sustain serious/catastrophic injuries which many times results in death.  Over the past twenty years attorney Gary A Kessler has a proven successful track record demanding accountability from the responsible parties and obtaining outstanding results for his clients.

Toddler Killed, Mother Critical in Anaheim Hit-and-Run

ANAHEIM, Calif. (KTLA) — Police are searching for a hit-and-run driver following a horrific accident in Anaheim that killed a toddler and left her mother critically injured.

It happened Wednesday night in the 9500 block of Guinida Street, near Gilbert Street.

A mother pushing her 3-year-old daughter in a stroller was hit in a crosswalk by an out-of-control car.

The child was killed, and the mother remains hospitalized in critical condition.

“We only saw the mother,” witness Gloria Gonzalez told KTLA. “Not realizing, my husband turned around and said, ‘Oh my God, there’s a child!'”

“The child was thrown on the opposite side of the mother,” Gonzalez said.

The impact sent the mother about 40 feet to the middle of the street. The child and pieces of the stroller were sent another 30 feet to the curb.

“The little girl was just face down, and blood started forming by her head,” witness Jesse Gonzalez said.

“I went down… she was still warm… I went to feel for a pulse, and I didn’t feel anything,” Gloria Gonzalez said.

Police say the vehicle involved in the crash, a Nissan Maxima, was stolen from Stanton.

CHP officers found the car about a mile away from where the accident happened, with its windshield shattered and bumper broken.

Residents say the intersection at Guinida and Gilbert has a history of speeding cars, near-misses and unanswered complaints.

“It’s very unsafe to cross here,” one woman told KTLA. “People just keep flying by and nobody stops.”

Pedestrian Accident Personal Injury Liability

Following a major pedestrian accident, the victim or family members of the victim would be well-advised to contact a skilled wrongful death attorney such as Gary A. Kessler. In the event the driver cannot be located, The Law Offices of Gary A. Kessler can help recover compensation for the victim through his insurance, if he has one. Compensation in a civil claim can include medical care expenses, lost earnings, pain and suffering, or other related damages.

PALM DESERT: I-10 crash kills infant

A nine-month-old Coachella girl was fatally hurt and a 2-year-old boy was critically injured this week during a traffic collision along Interstate 10 near Palm Desert while riding in car seats that weren’t properly secured, California Highway Patrol officers say.

Nevaeh Sessoms died about an hour after the 6:45 p.m. three-vehicle wreck Sunday along the freeway’s westbound lanes near the Monterey Avenue overcrossing, Riverside County coroner’s officials say.

The children were riding in a 1997 Saturn SL4 being driven by 21-year-old Alyissa Gross of Coachella when the car pulled into the traffic lanes from the center median and was rear-ended by a 2005 Ford F-150 pickup truck driven by 45-year-old Milo Santilli of Orange, Officer Joe Zagorski said in a written statement.

The Saturn then hit the center divider guardrail, before spinning back across the westbound lanes and into the path of a 1997 Ford F-150 driven by James Stone Jr. of San Diego, according to the statement.

Everyone in the Saturn – Alyissa Gross, 19-year-old Elizabeth Gross and the two children – were taken to Desert Regional Medical Center.

Cause of the Palm Desert Crash

Cause of the accident wasn’t immediately determined.

“The reasons why the … Saturn was entering traffic lanes from the center median also is not known,”  Officer Zagorski of the California Highway Patrol wrote. The collision remains under investigation.

3 killed, 3 injured in Sacramento Co highway crash

Three Sacramento residents were killed early this morning and two others were hospitalized after their Pontiac SUV was slammed head-on by a Honda CRV driving the wrong way on Highway 50 in Gold River, according to a California Highway Patrol spokesman.

The Honda driver, Christopher Rigsby, 41, of Redwood City was hospitalized and arrested on suspicion of felony driving under the influence, Officer Jim Young said.

“We do believe alcohol was the cause,” the spokesman said.

The force of the crash caused the Pontiac, a 2001 Aztec, to flip on its roof and eject two women in the rear seat, ages 52 and 56, who died at the scene, Young said. A 51-year-old passenger in the front seat died inside the vehicle, Young said.

The identities of the victims, all Sacramento residents, were being withheld until next-of-kin could be notified, the CHP said.

The Aztec driver, Gustavo Sandoval-Gonzalez, 31, of Sacramento, was taken to UC Davis Medical Center with chest pain and hand and knee injuries, Young said. A rear-seat passenger, Pedro Cornejo, 59, of Sacramento, was taken to Mercy San Juan hospital with “major injuries,” Young said.

The crash also left Rigsby trapped inside the 2007 Honda CRV he was driving alone. He was freed by rescue workers and taken to UC Davis Medical Center, Young said.

According to CHP investigators, the Pontiac was driving westbound around 12:45 a.m. on Highway 50 near Folsom Boulevard when it was hit head on by the Honda CRV, which was driving the wrong way. The Pontiac was determined to be driving 62 mph in a 65-mph zone, while the Honda’s speed was unknown, Young said.

Man killed in I-280 crash in Daly City

DALY CITY — A man was killed Saturday morning when he got out of his car after an accident on Interstate 280 and was struck by other vehicles, a California Highway Patrol spokesman said.

David Hanna, 27, apparently was standing or walking when he was struck at around 4:30 a.m. by a vehicle traveling south on I-280 near Eastmoor Avenue in Daly City. He subsequently was hit by at least one other vehicle, and North County Fire Authority personnel who arrived on the scene found the victim pinned under a car blocking two lanes of the freeway. The subsequent investigation closed all but one southbound lane until nearly 8 a.m.

About 4:30 a.m., the man was southbound on the freeway near Eastmoor Avenue when he lost control of his Toyota Camry and struck a cement wall on the right shoulder, Tam said.

He got out of his car but then was struck by several other vehicles on the freeway, authorities said.

One motorist stopped to check on the man, but several others kept driving, Tam said.

“It’s not unreasonable to hit something in the dark and not know it was a person,” he said. “We’re not sure exactly how many vehicles struck him.”

All but one southbound lane was closed at 4:55 a.m., police said.

Cause of the Los Angeles County Crash

Based on the limited information provided by news sources it is unclear what exactly caused this fatal collision. The California Highway Patrol investigation is ongoing. The California Highway Patrol is searching for a dark blue Prius and its driver following this morning’s incident. The dark blue Prius is a newer model that might have been involved in the incident and may shows sign of traffic-related damage, according to the CHP. Anyone who has information is asked to call (800)-835-5247 or (415) 557-1094.

Concord woman dies from injuries in Monday apartment fire

CONCORD — A woman seriously injured in an apartment fire earlier this week has died, authorities said.

Elise English, 34, of Concord, was taken off life support Wednesday morning after spending the past two days in the hospital, said Contra Costa Fire Marshal Lewis Broschard III.

English was found unconscious and not breathing in her unit at the Clayton Creek Apartments on Clayton Road on Monday after firefighters got a 1:38 p.m. call to an intense two-alarm fire. Firefighters performed CPR and she was taken to the hospital.

Firefighters extinguished the fire, which consumed English’s apartment and the roof, within about half an hour. No one else — including English’s roommate — was injured, and the fire damaged a half-dozen neighboring units.

It was the second fire to occur at the apartment complex that month: On Jan. 6, a one-alarm fire sent a resident to the hospital for smoke inhalation.

Cause of the fatal Concord fire

Based on the limited information provided by news reports it is unclear what started the fire. The cause of the fire remains under investigation.
 Fire & Explosions Premises Liability

Fires and explosions are sudden and devastating, destroying homes and buildings, and causing physical injuries and death.  Burn injuries are painful and disfiguring, and require long recovery periods.  Smoke inhalation, and inhalation of toxic fumes and gases from flammable fabrics and furniture stuffed with polyurethane foam, cause added injury and increase the likelihood of death.

The Law Offices of Gary A Kessler regularly represent plaintiffs in cases of catastrophic injury and wrongful death in fires and explosions caused or exacerbated by unsafe premises, unsafe construction sites, and unsafe products.

Faulty electrical wiring and furnaces, gas leaks, malfunctioning or absent smoke detectors, inaccessible or inadequate escape routes, the pressence of flammable fabrics and furniture, and the presence of dried vegetation that can fuel wild and urban interface fires are all examples of sources of liability for property owners or product manufacturers.

Determining the cause of a fire or explosion requires extensive experience and thorough investigation involving engineering, electrical, and gas line experts as well as fire scene experts.  The Law Offices of Gary A Kessler has the experience and the resources to effectively prepare and litigate cases on behalf of plaintiffs and family members injured or killed in fires and explosions.

With over 20 years of experience, Gary A Kessler has earned the respect of our colleagues and the courts in California and nationwide for our personal injury work.  We have achieved a winning record on behalf of our clients, and we are proud of our successful cases that lead to safety improvements through strengthened laws and product recall.

Traffic Piles Up for Miles After Fatal Crash on 405

LOS ANGELES, Calif. (KTLA) — A three-car wreck Tuesday night on the 405 Freeway left one person dead, California Highway Patrol officials said.

The crash happened about 8:30 p.m. on the southbound 405 just north of the Santa Monica Boulevard off-ramp. Details of the crash have not yet been released, but aerial photography provided by KTLA’s Sky5 suggest the wreck included two sedans and an SUV.

One person has been confirmed dead at the scene, CHP officials said.

Los Angeles city fire officials said no one else was injured in the crash and no one was taken to hospitals for treatment.

CHP officers have closed most of the southbound 405 Freeway, only leaving the southbound carpool lane open to motorists. The lane closures resulted in a traffic nightmare, with cars inching along for miles behind the wreck.

Northbound lanes have not been closed but traffic has also slowed significantly.

CHP officials expect the southbound lanes to remain closed for several hours.

Cause of the Los Angeles County Crash

Based on the limited information provided by news sources it is unclear what exactly caused this fatal collision. The California Highway Patrol investigation is ongoing.
