Pedestrian killed on El Cajon Blvd.
On the early morning of 04/11/2013, a 53-year-old male was a pedestrian apparently attempting to cross the El Cajon Boulevard mid-block when he was struck by a white Nissan sedan traveling eastbound in the number two lane. Witnesses immediately called 9-1-1 and rendered aid to the decedent. When paramedics arrived, advanced cardiac life support was initiated. Despite resuscitative efforts, he could not be revived and his death was pronounced at the scene. Police say alcohol was not a factor in the accident and that charges are unlikely to be filed against the driver of the vehicle.

New Mexico School Bus crash leaves driver dead and 9 injured
A bus driver died and nine students were injured Monday when a school bus went off a road and lodged in an embankment in northern New Mexico, authorities said Monday.
The driver died at the scene of the crash that investigators said might have been caused by a medical event.
Initial reports indicated the bus had rolled over, but authorities later said that was not true.
The bus carrying nine elementary, middle and high school students crashed off State Road 111 near La Madera in Carson National Forest, Rio Arriba County sheriff’s spokesman Jake Arnold said.
The mountainous, isolated area is popular for hunting, hiking and camping.
Two of the students who attend schools in the tiny, rural school district of Mesa Vista had broken bones.
“It is a tragedy and we are very saddened by events today,” district superintendent Tracie Phillips said. “We are providing counseling for all of students, including those involved in the crash.”
It was not clear if the driver, Pat Valdez, 69, might have had had a heart attack and later died from the crash, authorities said.
“We don’t know if the driver died from a medical event, died from the crash or died from a combination of both,” Arnold said.
The Office of the Medical Investigator will determine the cause of death, he said.
Eight students were taken to Espanola Hospital for treatment. Six were treated and released while two others were transported to University of New Mexico Hospital in Albuquerque, Espanola Hospital spokeswoman Niki Allcorn said.
One student was airlifted to UNM hospital from the scene, Allcorn said.
An 8-year-old suffered a broken back and 16-year-old had a broken jaw, authorities said.
School officials say the students were headed to Ojo Caliente Elementary, Mesa Vista Middle and Mesa Vista High schools from Vallecitos in northern Rio Arriba County.
Images from a KOB-TV helicopter showed the bus lodged in an embankment. It appears to have gone off a cliff around 15 miles from the schools in Ojo Caliente, a resort town known for its hot springs. The roads are surrounded by mesas, sagebrush and rocky terrain.
An investigation of the crash was ongoing by the Rio Arriba Sheriff’s Office and New Mexico State Police. Authorities blocked off access to roads leading to the crash site.
The isolated Mesa Vista Consolidated School District is located in El Rito and is around 120 miles north of Albuquerque. It has an enrollment of close to 400 students.

Boy, 4, airlifted off Disney cruise after nearly drowning in swimming pool
A four-year-old boy was airlifted to hospital after nearly drowning on a Disney cruise on Saturday.
This is the second drowning incident in a month for the company who do not have permanent lifeguards at their pools. Warnings are posted by the side of the water that lifeguards are not on duty.
The child, whose condition or name have not been released due to privacy reasons, was found unresponsive in a swimming pool on the cruise ship Fantasy at around 3.30 pm.
The ship was briefly docked at Port Canaveral at the time of the near drowning.
After the boy was discovered Disney staff gave him medical attention. The boy was then airlifted to Arnold Palmer Hospital for Children in Orlando.
Disney told Fox Orlando that their ‘thoughts are with the family and they’re working to assist them at this time.’ The ship left port and continued on its Caribbean cruise 45 minutes after the near drowning.
This is the second drowning on Disney property this month. Missouri boy Anthony Johnson, 13, died after he was found at the bottom of a pool at a Disney hotel in Orlando on March 10.
The teen’s father and another guest at the hotel performed CPR after he was pulled out of the water.
Officials said the boy was staying at the Pop Century Resort, near the Epcot theme park, with his family.
Witnesses said the teenager was playing in the water on Sunday evening with family members. A cousin spotted him underwater around 9.10pm and alerted others in the group who pulled him out to the side of the pool.
Orange County Sheriff’s officials said the victim had a pulse and was breathing when he was taken to Celebration Hospital. He was then transferred to Florida Hospital South but later died
CRUISE SHIP ACCIDENTS AND INJURIES
When a passenger on a cruise ship is injured, the law that applies to an injury claim will most likely be the General Maritime Law of the United States. At least if the ship is operated by one of the major cruise lines based in the U.S. such as Princess Cruise Lines, Crystal Cruises, Cunard Line, Royal Caribbean, Carnival Cruise Lines and most all of the others you will be familiar with.
Under U.S. Maritime Law, a cruise line can be held liable for damages if it negligently causes injury to a passenger, no matter where in the world the injury occurs. Negligence can involve something dramatic, such as the listing event on the Crown Princess several years ago when a navigational error nearly caused the ship to capsize, injuring hundreds of passengers. Negligence will certainly be a litigated topic for survivors and family members of passengers aboard the Costa Concordia, the Carnival-owned cruise ship that ran aground off the coast of Italy in January 2012.
But usually the negligence is of a more ordinary sort. For example a deck that becomes unusually slippery when wet or a poorly marked tripping or falling hazard. And unfortunately, this sort of negligence is all to common on Cruise Ships.
U.S. Maritime Law protects you on these ships, no matter where in the world the injury occurs. And foreign passengers enjoy the same rights as a U.S. citizens. But there are important limit on your rights as well that you need to be aware of.
Time Limitation
One of the most important of these limitations is that Cruise Lines are allowed to shorten the time you have to make a claim, and limit the place where you can file suit. Almost all the cruise lines require an injured passenger to give them written notice of the claim within 6 months and to file suit within one year of the date of the injury.
Venue Limitation
The second, the passage ticket will limit the place where you can file suit. Most of the major cruise lines specify either Los Angeles or Miami but some lines specify other cities.
The time and place limits on filing suit must be stated in plain language in your passage ticket so you must check your passage ticket to see what limitations apply to you. If you still have questions, and experienced maritime personal injury attorney will know what limitations apply for any of the major cruise lines.

Fiery Wreck On Interstate 10 kills Two
A hit-and-run driver fleeing from an accident — and traveling the wrong direction on Interstate 10 — slammed head-on into a pickup, causing a fiery wreck that killed him and the motorist he hit, according to California Highway Patrol officials. The crash happened at 1:22 a.m. Sunday, March 31, about a half-mile east of Brookside Avenue in Beaumont, coroner’s investigators said in a written statement. Francisco Hernandez, 23, of Highland, left the scene of a traffic collision in a 2012 Toyota TC, according to CHP and coroner’s officials. Hernandez was driving west in the interstate’s eastbound lanes and crashed into a 2004 GMC Sierra pickup, CHP officers determined. The GMC was driven by a 45-year-old Beaumont man whose name the coroner’s office has not yet released. The collision caused the pickup to catch fire. It was fully ablaze by the time Cal Fire/Riverside County fire crews arrived. The Beaumont man’s body was badly burned, the CHP said. Fire officials said a third person suffered major injuries. It was not clear which vehicle that person was in.

2 dead in fiery I-80 head-on crash involving a big rig
A big-rig driver choking on his lunch on Interstate 80 passed out, veered across the freeway near Davis and slammed head-on into a sedan Thursday, killing the car’s driver and a passenger, authorities said.
Both directions of the freeway were shut down for hours after the crash near Old Davis Road at 10:36 a.m.
The trucker lost consciousness as he choked on his food while driving east on I-80, said Officer Chris Parker, a California Highway Patrol spokesman. His truck swerved to the right, glanced off the guardrail and struck two cars as it veered back to the left, Parker said.
The truck then crashed through the center divide guardrail and struck a westbound BMW head-on, killing the car’s driver and a passenger, Parker said.
The big rig then pushed the car to the westbound shoulder and caught fire.
At some point the trucker’s air passage cleared and he regained consciousness. He escaped with minor to moderate injuries and was being held for questioning by CHP officers.
Investigators have not released his name or the names of the victims in the BMW near the Yolo-Solano County line. The drivers of the other two cars hit by the truck suffered minor injuries.
Fault and Wrongful Death Liability
Accidents involving big-rigs have unique and complex legal issues. An experienced and knowledgeable attorney will be able to review the cause of the accident, and if warranted, arrange for an independent investigator to reconstruct the collision to determine exactly what happened and who was responsible. A skilled lawyer can also provide an explanation to the victim’s family on their legal rights in a wrongful death claim against the driver or any other parties at fault. Damages awarded in a wrongful death claim may include funeral and burial expenses, lost earnings, pain and suffering, and other damages.
