Fatal crash reported on West I-8 at College

SAN DIEGO — One person was killed and two people were injured in a collision on Interstate 8 in the College Area on Monday, the California Highway Patrol reported.
The crash occurred at about 10 a.m. on the westbound side of the freeway near the College Avenue onramp, according to the CHP.
CHP Sgt. Connie Lloyd said the car was traveling about 65 to 70 mph when the driver lost control of the car, which spun out and slammed into a guardrail.
The driver, whose name was not immediately available, died at the scene. Two passengers – a man and a woman – were transported to local hospitals to be treated for their injuries. Their conditions were unknown.
A Sig Alert was issued for the College Avenue onramp to westbound I-8. It was canceled at about 11:45 a.m.
Cause of the San Diego County Crash
As passengers, the deceased likely could have done nothing to prevent this fatal collision that ultimately took their lives. The California Highway Patrol will surely look at the speed of the vehicle, witness reports, and other factors to determine what occurred and who was responsible. Collisions such as this one can have countless causes, including unsafe passing maneuvers, swerving to avoid an object in the road, falling asleep at the wheel, driving under the influence, or driver distraction. CHP officerLloyd said the crash was “100 percent rain-related” and urged drivers to slow down.

Pit Bull Attack Kills San Diego Postal Carrier Diane Jansen
After experiencing three fatal Pit Bull attacks and numerous serious injuries to residents by Pit Bull maulings in 2011, the Southern California coastal area of San Diego has experienced yet another tragedy.
A 59-year-old U.S. Postal Service letter carrier died from a stroke two days after being attacked by a Pit Bull while delivering mail. Diane Jansen had been working the same route for 5-1/2 years in Escondido, a suburb of San Diego, in the north County area, according to San Diego news reports.
The attack occurred at East Washington Avenue and Carlann Lane. KGTV San Diego stated that, according to Police Lieutenant Chris Wynn “The pit bull “just shot out of the partially closed garage door” at the residence of a family with several children and inflicted severe bites to both of Jansen’s legs. No adult was home at the time.
Diane Jansen was immediately taken to Paloma Medical Center, where she was diagnosed with a brain hemorrhage and developed slurred speech and became unresponsive while being examined by medical personnel, according to the Medical Examiner.
Hospital officials removed Jansen from life support Saturday and she died Sunday night, March 4, according to the report. The cause of death is listed as “a stroke due to hypertension and cardiovascular disease”. The dog bites are listed as a contributing condition.
The identity of the dog’s owners was not disclosed because officers with the Escondido Police Department investigated the attack, in addition to the Escondido Humane Society, and neither found evidence that a crime had occurred, according to Police Lt. Chris Wynn. The animal was euthanized with the owners’ consent.
Another Escondido postal worker praised Jansen as “a devoted mail carrier and a happy person who did her job superbly.” He stated that he has been bitten by dogs twice while delivering in North County and said the experience can be ‘terrifying.’ Your heart is in your throat when you get attacked by a dog one day, and the next day you have to go out there and deliver the letter that they are on warning,” he told the North County Times.
Dog Attacks and wrongful death liability
CALIFORNIA DOG BITE STATUTE SECTION 3342
Under California Law, it is no longer necessary for the Plaintiff to prove that the dog was known to be vicious or had a propensity to bite. One bite alone is sufficient for liability. Dog owners do not get a second chance in California. They are liable for any injury their animals cause regardless of whether the animal had bitten anyone previously. Under California Dog Bite Statute Section 3342 the Plaintiff must prove in a dog bite case the following:
- Defendant owned the dog;
- The dog bit the Plaintiff;
- The Plaintiff was lawfully on the premises (express or implied consent to be on the premises) where the bite occured; and
- Plaintiff sustained injuries from the dog bite.
What You Should Do If You Or A Loved One Has Been Bitten By A Dog:
- Take pictures of your injuries immediately;
- Consult law enforcement and request that a police report be made;
- Keep copies of all medical bills and records;
- Continue to take pictures of the bite(s) as the wounds heal;
- Be sure that your doctor is qualified and determine if you are a candidate for plastic surgery to get rid of the scarring;
- If an adult who is employed sustained injuries and lost wages, keep a record of economic loss.
WE WILL FIGHT FOR YOU!
Demand accountability from dog owners. Settling dog bite claims can be difficult and complex. Many times the insurance companies will play “hardball” if you try to settle the case yourself or you have employed a lawyer who does not have the litigation experience to handle such a case. We at the Law Offices of Gary A Kessler have 20 years of litigation experience and we know how to handle the insurance companies. We are prepared to front all of the costs required for the necessary investigations and expert witnesses needed to prepare your case for trial. Are the other law firms you are considering willing to front all costs?
In a dog bite case, we advance all legal costs to prepare and present our client’s claim, and receive a percentage of the settlement or verdict of what we recover for our attorney’s fees on their behalf. Upon settlement our costs shall be reimbursed to us from the gross recovery. If there is no recovery, no attorney’s fees or costs are owed to our firm. Thus, in all personal injury cases, our fees are recovered as a percentage of any settlement or verdict awarded to our clients.

A Brentwood man died in an accident on Highway 17 Friday morning and three members of a Scotts Valley family were injured in the four-car collision that closed the highway in both directions for a few hours, according to the California Highway Patrol.
The coroner’s office has not released the name of the 57-year-old Brentwood man who was driving a Nissan Altima southbound on Highway 17 when he lost control and crossed into northbound traffic at Laurel Road at approximately 10:43 a.m.
Upon entering the northbound lane, the Nissan collided with the side of a Chevy Suburban driven by 46-year-old Felton resident Richard Silver, who was not injured. The Nissan then rotated counter-clockwise striking the front of a Toyota 4Runner driven by Scotts Valley resident Matthew Clark, 41. Scotts Valley resident Gretchen Clark, 40, and a child were passengers in the Toyota. All three were taken to Dominican Hospital with unknown injuries.
After being hit by the Nissan, the Toyota collided with an Acura Integra driven by San Jose resident Allan Ramos, 33. Ramos was not injured.
The accident closed Highway 17 for approximately three hours as the scene was cleared and investigated and injured parties were transported to the hospital. The cause of the collision is still under investigation.
According to the CHP, everyone involved was wearing a seatbelt and the child in the Toyota was properly restrained in a child safety seat.
As the rain is expected to continue through Monday, the CHP is reminding everyone to slow down and drive carefully.

Virginia Tech Victims’ Families Win $8M in Wrongful Death Lawsuit

Families of two victims of the 2007 Virginia Tech shootings will receive $8 million in a wrongful-death lawsuit, a jury ruled Wednesday.
The suit, brought by relatives of slain students Erin Peterson and Julia Pryde, alleged Virginia Tech officials were negligent in taking too long to notify the campus that a gunman was on the loose, WTKR-TV reports.
The Virginia Tech massacre began when two students were shot and killed in a dorm on April 16, 2007. School officials did not alert the campus because they believed the shootings were an isolated incident, Virginia Tech’s attorneys said.
Later, student Seung-Hui Cho gunned down 30 more people, including Peterson and Pryde, before turning the gun on himself. It was the deadliest school shooting in U.S. history, according to WTKR.
Virginia Tech’s failure to warn anyone about a gunman on campus led to the killing of Peterson and Pryde, their families’ wrongful-death lawsuit asserted.
But the school’s lawyers argued there was no evidence that a warning would have changed what happened that day. No one could have reasonably foreseen Cho’s massacre, they argued.
In a negligence case, a defendant is generally held liable only for harms that could have been reasonably foreseen by the defendant’s actions, or failure to act. Whether a result was foreseeable is a factor in establishing causation, one of the essential elements of negligence.
Jurors deliberated for more than three hours Wednesday before siding with the victims’ families, MSNBC reports. Each family will receive $4 million from the state of Virginia, because Virginia Tech is a state university.
Attorneys for the state immediately filed a motion to reduce the Virginia Tech lawsuit award, citing a state law that caps jury awards at $100,000, MSNBC reports. Jurors were not instructed about the cap, the attorneys argue.
Big Rig Crash Causes Chain Reaction

Three people were hurt and four vehicles are damaged after a big rig driver lost control of his truck early Wednesday morning and caused a chain reaction on Interstate 5 near Pocket Road, a California Highway Patrol sergeant said.
The big rig driver told officers that he hit a bump in the road and began to spin out of control in the southbound lane of the highway, CHP Sgt. Bill Languemi said.
The wreck, which happened just after 3:20 a.m., was cleared by about 6 a.m.
It was unclear whether the “bump in the road” described by the driver was a patch of water that caused the rig to hydroplane. It wound up sitting across a center divider wall.
It appeared that the rig struck a Honda Accord, which was almost completely flattened. The driver of the Accord was taken to a hospital with critical injuries, Languemi said.
The crash wound up causing two other vehicles — another big rig and another passenger car — to crash, Languemi said. Two other drivers were hurt but suffered only minor injuries, officers said.
Cause of the Sacramento Big -Rig Crash
Based on the limited information provided by news reports it is unclear what caused the collision . Investigators are still trying to piece together how the accident happened. What is clear, is that the accident was the fault of the big-rig driver.

39 students injured in Wash. school bus crash
A school bus overturned Monday morning on a central Washington highway, injuring dozens of children, including three seriously, before coming to rest at the edge of a field, authorities said.
The bus veered off the road, overcorrected and rolled on Highway 281 just south of Quincy, an agricultural region about 120 miles east of Seattle, said Lt. Scott Martin of the Washington State Patrol.
The bus came to rest on its passenger side, and all 39 students on board suffered injuries of some kind, though most were minor scrapes, bruises and bloody noses, Martin said. Three children were in serious condition, but none of the injuries was believed to be life-threatening.
One child was airlifted to the nearby city of Moses Lake, and two were taken to a hospital in Ephrata. The rest of the students went to the local Quincy Valley Medical Center, either for treatment or to be reconnected with their families.
The driver apparently was not injured, and no other vehicle was involved.
The Quincy School District covers about 450 square miles of farmland in central Washington’s Columbia River basin, which is home to thousands of acres of tree fruit, and potato and onion fields. The district serves 2,500 students.
“We are deeply concerned about the students and the driver,” the district’s superintendent, Burton Dickerson, told the Columbia Basin Herald. “The safety of all our students is our top priority. Student safety is the number one job of our bus drivers.”
Cause of the Yakima County Crash
Lt. Scott Martin of the Washington State Patrol stated that the cause of the crash is under investigation. Roads were bare and dry when the bus rolled. No other vehicles were involved in the incident.
