Man killed in Fremont crash involving big rig

FREMONT — A man died when a big rig and a cement truck collided Friday morning in the city’s Warm Springs district, police said.

The fatal crash occurred about 8:30 a.m. in the 47100 block of Kato Road, near where West Warren Avenue meets Interstate 880, police said. The cement truck was heading north when it collided with the southbound big rig, which was carrying a boom crane.

The cement truck driver, identified only as a 39-year-old man, was pronounced dead at the scene with major head injuries. The 51-year-old driver of the 18-wheel truck suffered minor injuries and was transported to a hospital, police said.

Drugs and alcohol don’t appear to be factors in the collision, police said.

Authorities closed Kato Road between Benicia and Auburn streets for several hours while they investigated what caused the accident.

Fault and Wrongful Death Liability

Accidents involving big-rigs  have unique and complex legal issues. If it is determined that the driver of the big-rig was  at fault for this collision, the family of the victim would be well-advised to speak to a California truck accident attorney. An experienced and knowledgeable attorney will be able to review the cause of the accident, and if warranted, arrange for an independent investigator to reconstruct the collision to determine exactly what happened and who was responsible. A skilled lawyer can also provide an explanation to the victim’s family on their legal rights in a wrongful death claim against the driver or any other parties at fault. Damages awarded in a wrongful death claim may include funeral and burial expenses, lost earnings, pain and suffering, and other damages.

Council candidate’s father killed in cycling accident

Alfredo Pedroza, the 56-year-old father of Napa City Council candidate Alfredo Pedroza, was killed on Silverado Trail on Thursday evening while riding his bicycle home from a 50-mile workout.

The senior Pedroza was riding southbound on the shoulder of Silverado Trail just south of Pine Ridge Winery at 6:30 p.m. when a Ford hatchback, also heading south, veered off the roadway at 55 mph and struck him, California High Patrol Sgt. Gilberto Jose said.

Pedroza was killed instantly, the CHP said. The vehicle then crashed into an embankment and eventually came to rest against a hill, Jose said.

His son, Alfredo, is a Napa banker who is running for City Council in the November election.

The car was driven by Cammie Mutz, 20, of Calistoga, Jose said. The cause of the crash is still under investigation. Drugs and alcohol are not suspected, Jose said.

Mutz was not injured in the crash, but was taken to Queen of the Valley Medical Center as a precaution, Jose said. Mutz was “very upset” about the accident.

Jose said there were no obvious road hazards at the time, noting traffic was light, it was still daylight and the shoulder in that area is at least three feet wide.

The CHP will investigate whether Mutz fell asleep or was using a cell phone at the time of the crash, the CHP said.

On Friday afternoon, the victim’s son paid tribute to his father, saying he came to the United States as a teenager with no money and no English skills, then “built this family from the ground up.”

“He worked over 30 years in the vineyards,” the son said. “He never missed a day at work. Those are the values I learned from my dad.”

On Thursday, his father had worked a full day as a manager for a vineyard management company, then had gone on a 50-mile bike ride to Calistoga and back, Alfredo Pedroza said. His father was training for a 100-mile race, he said.

The son said his father had married, bought a home and raised two children in Napa. His father never finished school, but aspired that his children succeed in his adopted country, said Pedroza, who was the first in his family to go to college.

“His focus was on making sure my sister and I had the opportunity to accomplish our goals,” he said.

National Safe Boating Week starts Saturday

The 2012 National Safe Boating Week campaign starts Saturday with Coast Guard Auxiliary units promoting recreational boating safety around the country.

The campaign, which runs through May 25, is dedicated to helping boaters understand the need for boating education and vessel safety checks, as well as the importance of wearing life jackets while boating.

“National Safe Boating Week gives us an opportunity to reflect on the safe operation of boats on the water. The incidents we study bring home the need for simple safety precautions while under way,” Coast Guard Auxiliary national commodore Jim Vass said in a statement.

According to a National Association of State Boating Law Administrators report, total boating fatalities in 2010 dropped to 672, the lowest number on record. The study also found that almost 75 percent of all fatal boating accident victims drowned and that, of those, 88 percent were not wearing life jackets.

There were 3,153 injuries and about $35.5 million of property damage in 2010 for recreational boaters. Operator inattention, improper lookout, operator inexperience, excessive speed and alcohol use rank as the top five primary contributing factors in accidents.

“We encourage everyone to wear their life jackets and use a ‘kill switch’ while boating,” Vass said. “Frequently we see young children in life jackets, but their parents are not wearing them. All of us need to wear a life jacket to protect ourselves and set a good example for others.”

Coast Guard Auxiliary flotillas around the country will be hosting special events to reinforce the safe boating message during National Safe Boating Week, including free vessel safety checks at local marinas, boating safety classes and other special events.

RIVERSIDE: Safety of crosswalk where woman struck criticized

A Riverside community leader said he has asked the city for years to improve the markings and signage at a crosswalk where a police patrol car fatally struck a woman Sunday.

Isabel Pablo, 57, was taken off life support 12 hours after the 7:49 a.m. collision that happened when she crossed Madison Street at Emerald Street in the Casa Blanca neighborhood.

The officer was seen afterward shaking, his head in his hands.

Police said Pablo was outside the crosswalk.

“We know this from eyewitnesses’ and officers’ accounts,” Assistant Chief Chris Vicino said Monday by telephone.

The crosswalk is made up of connected flat pieces of rock. There are no stripes on either side. Bright-yellow signs on both sides of Madison featuring the pictogram of a pedestrian, as well as signs with arrows pointing to the crosswalk, warn drivers.

Bob Garcia, a member of the Casa Blanca Community Action Group, said in an interview at the scene Monday morning that the city has told him since the mid-1990s that there was no money for additional markings, flashers imbedded in the pavement or to post a stop sign.

Garcia said the city has told him that a traffic study showed no need for improvements.

The crosswalk is in front of St. Anthony’s Church, which Pablo frequently attended.

Garcia added that the opening of the nearby Casa Blanca Library in 2003 increased foot and vehicle traffic in the area, making the crossing more dangerous.

“It has always been an issue because of speed and traffic,” Garcia said.

Angel Gaytan Jr., who lives on Emerald, said he hears and sees vehicles driving too fast through the intersection on Sundays during family gatherings.

City spokeswoman Cindie Perry said no one from the Public Works Department was available Monday to comment.

In a later interview, Garcia said he had a “great” meeting Monday afternoon with Riverside Police Lt. Dan Hoxmeier, City Councilman Paul Davis, Community Police Review Commission Director Frank Hauptmann and CPRC member Robin Jackson. Garcia said afterward that he appreciated being able to address his group’s concerns.

“We must let the community know what happened and how it happened,” Garcia said.

INVESTIGATION UPDATE

The officer was on routine patrol Sunday when the incident happened, Vicino said.

“We are reviewing in detail everything we can with his vehicle,” Vicino said, noting that the car’s onboard computer records, incoming and outgoing messages, audio and video recorders are all being looked at to determine whether anything might have distracted the officer.

The findings of the Police Department’s Major Accident Investigation Team will not be available for at least several days, he said.

Dog Attacks and personal injury liability

CALIFORNIA DOG BITE STATUTE SECTION 3342

Under California Law, it is no longer necessary for the Plaintiff to prove that the dog was known to be vicious or had a propensity to bite.  One bite alone is sufficient for liability.  Dog owners do not get a second chance in California.  They are liable for any injury their animals cause regardless of whether the animal had bitten anyone previously.  Under California Dog Bite Statute Section 3342 the Plaintiff must prove in a dog bite case the following:

  • Defendant owned the dog;
  • The dog bit the Plaintiff;
  • The Plaintiff was lawfully on the premises (express or implied consent to be on the premises) where the bite occured; and
  • Plaintiff sustained injuries from the dog bite.

What You Should Do If You Or A Loved One Has Been Bitten By A Dog:

  • Take pictures of your injuries immediately;
  • Consult law enforcement and request that a police report be made;
  • Keep copies of all medical bills and records;
  • Continue to take pictures of the bite(s) as the wounds heal;
  • Be sure that your doctor is qualified and determine if you are a candidate for plastic surgery to get rid of the scarring;
  • If an adult who is employed sustained injuries and lost wages, keep a record of economic loss.

WE WILL FIGHT FOR YOU!

Demand accountability from dog owners.  Settling dog bite claims can be difficult and complex.  Many times the insurance companies will play “hardball” if you try to settle the case yourself or you have employed a lawyer who does not have the litigation experience to handle such a case.  We at the Law Offices of Gary A Kessler have 20 years of litigation experience and we know how to handle the insurance companies.  We are prepared to front all of the costs required for the necessary investigations and expert witnesses needed to prepare your case for trial.  Are the other law firms you are considering willing to front all costs?

In a dog bite case, we advance all legal costs to prepare and present our client’s claim, and receive a percentage of the settlement or verdict  of what we recover for our attorney’s fees on their behalf.  Upon settlement our costs shall be reimbursed to us from the gross recovery.  If there is no recovery, no attorney’s fees or costs are owed to our firm.  Thus, in all personal injury cases, our fees are recovered as a percentage of any settlement or verdict awarded to our clients.

Contact the Law Offices of Gary A Kessler today so that we can preserve the evidence and demand compensation and accountability from the responsible parties who caused you or your family member catastrophic injuries!

If you or a family member sustained serious dog bite injuries contact the Law Offices of Gary A Kessler, an experienced law firm, immediately to protect your legal rights and preserve the evidence.

California Dog Bite Injury Liability Under  California Civil Code 3342: “The owner of any dog is liable for the damages suffered by any person who is bitten  by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owners knowledge of such viciousness.”
After a dog attack such as this, the injured party (or his representatives) would be well advised to speak with an experienced California dog bite lawyer about the incident and their legal rights to hold the owner of the dog accountable for all expenses as well as pain and suffering as a result of the dog attack.
