Dog impounded after biting pregnant woman

SAN DIEGO — A 50-pound pit bull mixed-breed knocked down a pregnant woman and bit her hand at a Serra Mesa apartment complex Wednesday morning, San Diego police said.

The incident occurred at a four-plex apartment building on Glenhaven Street near Sandrock Road about 10:20 a.m.

A 7-year-old boy let the family’s two mixed pit bull dogs out into a fenced common area, unleashed, to go to the bathroom, said Officer Scott Brengi.

At the same time, a 30-year-old woman who is five months pregnant carried some trash out into the yard. One of the 3-year-old dogs ran at her and knocked her flat on her stomach, and bit her right hand, Brengi said.

“She was screaming, her husband came out and got her inside, and the owner got control of the dogs,” Brengi said.

He said the woman’s bite wound was minor, but she was taken to a hospital out of concern for the unborn baby.

The dog owner surrendered the dog to county Animal Services Officer Mitchell Levy. Levy said the dog would be quarantined for 10 days to see if it remains healthy and the extent of the woman’s injury is determined. If the injury should prove serious, Levy said, the dog would likely be euthanized.

Levy said his agency has had no prior complaints about either of the dogs

Dog Attacks and personal injury liability

CALIFORNIA DOG BITE STATUTE SECTION 3342

Under California Law, it is no longer necessary for the Plaintiff to prove that the dog was known to be vicious or had a propensity to bite.  One bite alone is sufficient for liability.  Dog owners do not get a second chance in California.  They are liable for any injury their animals cause regardless of whether the animal had bitten anyone previously.  Under California Dog Bite Statute Section 3342 the Plaintiff must prove in a dog bite case the following:

  • Defendant owned the dog;
  • The dog bit the Plaintiff;
  • The Plaintiff was lawfully on the premises (express or implied consent to be on the premises) where the bite occured; and
  • Plaintiff sustained injuries from the dog bite.

What You Should Do If You Or A Loved One Has Been Bitten By A Dog:

  • Take pictures of your injuries immediately;
  • Consult law enforcement and request that a police report be made;
  • Keep copies of all medical bills and records;
  • Continue to take pictures of the bite(s) as the wounds heal;
  • Be sure that your doctor is qualified and determine if you are a candidate for plastic surgery to get rid of the scarring;
  • If an adult who is employed sustained injuries and lost wages, keep a record of economic loss.

WE WILL FIGHT FOR YOU!

Demand accountability from dog owners.  Settling dog bite claims can be difficult and complex.  Many times the insurance companies will play “hardball” if you try to settle the case yourself or you have employed a lawyer who does not have the litigation experience to handle such a case.  We at the Law Offices of Gary A Kessler have 20 years of litigation experience and we know how to handle the insurance companies.  We are prepared to front all of the costs required for the necessary investigations and expert witnesses needed to prepare your case for trial.  Are the other law firms you are considering willing to front all costs?

In a dog bite case, we advance all legal costs to prepare and present our client’s claim, and receive a percentage of the settlement or verdict  of what we recover for our attorney’s fees on their behalf.  Upon settlement our costs shall be reimbursed to us from the gross recovery.  If there is no recovery, no attorney’s fees or costs are owed to our firm.  Thus, in all personal injury cases, our fees are recovered as a percentage of any settlement or verdict awarded to our clients.

Contact the Law Offices of Gary A Kessler today so that we can preserve the evidence and demand compensation and accountability from the responsible parties who caused you or your family member catastrophic injuries!

If you or a family member sustained serious dog bite injuries contact the Law Offices of Gary A Kessler, an experienced law firm, immediately to protect your legal rights and preserve the evidence.

California Dog Bite Injury Liability Under  California Civil Code 3342: “The owner of any dog is liable for the damages suffered by any person who is bitten  by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owners knowledge of such viciousness.”
After a dog attack such as this, the injured party (or his representatives) would be well advised to speak with an experienced California dog bite lawyer about the incident and their legal rights to hold the owner of the dog accountable for all expenses as well as pain and suffering as a result of the dog attack.

Two San Gabriel residents killed in DUI crash

ALHAMBRA – Two San Gabriel residents were killed and two others injured after the car they were in fell at least 60 feet off a freeway overpass and landed on the transition road between the westbound I-10 and the southbound 710 Freeway.

Manolo Magat, 23, and Joseph Almario, 21, both of San Gabriel were pronounced dead at the scene. The driver, Christine Meng, 22, and passenger Jason Lieu, 22, also of San Gabriel, sustained injuries and were transported to Los Angeles USC Medical Center.

Meng was speeding and driving under the influence of alcohol, CHP officials said, which caused her to lose control of the RAV4 on a curve and crash through the guard wall of the bus way/HOV lane at 1:05 a.m.

She has been charged with felony DUI, California Highway Patrol spokeswoman Doris Peniche said.

Peniche said the CHP is still investigating the incident and could also charge Meng with manslaughter or murder.

The westbound I-10 to the southbound 710 transition road as well as the bus way/HOV lane from Alameda Street to the eastbound I-10 was closed for approximately three hours after the crash.

Cause of the Alhambra Crash

One person was killed Monday morning in a head-on crash south of Lamont.

A California Highway Patrol officer on scene said a Lexus car was heading north on Highway 184 around 5 a.m. when the driver, later identified as 21-year-old Jovanna Salgado, of Arvin, said she fell asleep and drifted into the southbound lane. The Lexus crashed into an oncoming minivan.

The driver of the van died. His name was withheld.

Salgado sustained a major injury to her leg, the CHP said.

Four van passengers received varying degrees of injuries. They were identified as Saul Gomez, Antonio Solares, Johnathan Alonso and Modesto Dominguez, all of Bakersfield. One van passenger, 19-year-old Alfredo Dominguez, was not injured.

7 dead in head-on collision on I-10 near Phoenix

PHOENIX (AP) — Seven people have died in a crash on Interstate 10 near Phoenix after a semitrailer truck crossed the highway’s median and struck a van head on.

Carrick Cook, a spokesman for the Arizona Department of Public Safety, says the victims were all inside the van when the crash happened Sunday about 60 miles west of Phoenix.

The driver of the tractor-trailer and his wife escaped Sunday after the vehicles collided near the Burnt Well Rest Area near here. The tractor-trailer and van plunged down a 6-foot embankment and burst into flames, said Carrick Cook, a spokesman for the state public safety department.

Charges will probably not be filed because investigators believe the driver has a medical condition, Cook said.

The 11 a.m. crash near mile marker 87.1, about 50 miles west of Phoenix, was one of six fatal accidents that killed 12 people over the weekend, Cook said. That marked the second weekend in a row of a high number of traffic-accident fatalities.

“It’s unusual,” Cook said.

The semi truck driver and his wife were hospitalized with injuries. Autopsies are scheduled for Wednesday for the seven victims, believed to be family members.

The youngest were probably teenagers, Cook said.

Identifying the victims is complicated by the violent nature of their deaths, Cook said.

Eastbound I-10, the route between Phoenix and Los Angeles, was closed for most of the day Sunday.

Cause of the Phoenix Crash

If news accounts of this incident are accurate, the Semi driver  is likely responsible for the incident. Fault and Wrongful Death Liability

Accidents involving big-rigs  have unique and complex legal issues. If it is determined that the driver of the big-rig was  at fault for this collision, the family of the victim would be well-advised to speak to a  truck accident attorney. An experienced and knowledgeable attorney will be able to review the cause of the accident, and if warranted, arrange for an independent investigator to reconstruct the collision to determine exactly what happened and who was responsible. A skilled lawyer can also provide an explanation to the victim’s family on their legal rights in a wrongful death claim against the driver or any other parties at fault. Woman dies after falling out of moving party bus on Calif. highway

A drunken female reveller who fell out of a party bus during a catfight was caught under the wheels of the bus and killed.

The two young women clashed on their way back from a country music concert to Santa Cruz, California, when the doors accidentally opened and the tragic accident took place.

Natasha Noland, 25, died after plunging from the bus at around 11.50pm on Friday on Highway 17, while a 20-year-old woman from Felton was injured.

Several of the 12 to 15 passengers on the Party Bus of Santa Cruz fled the scene, according to Mercury News, and two others were arrested for drunkenness.

The group was returning from a Brad Paisley concert at Shoreline Amphitheatre in Mountain View and were all ‘highly intoxicated’ and uncooperative, according to police.

‘We’re hoping once they sober up they’ll cooperate a bit more,’ said California Highway Patrol officer DJ Sarabia.

The shocking news comes at a time when lawmakers are debating whether to more closely regulate drinking on party buses.

Party buses are typically vans that look like airport shuttles and can seat from 15 to 30 people. They often have couches and bars instead of row seating and some include stripper poles and dance floors.

‘As they’re fighting, somehow the door to this bus opens up and they both fall out,’ said Mr Sarabia. ‘The victim is run over by the bus, and the other woman is injured.’

Ms Noland is the daughter of Todd and Sue, owners of a well-known Santa Cruz surf shop.

Employees at Pacific Wave, where she worked as the women’s goods buyer, later said they were devastated by the news.

The Mercury News noted that the accident occurred as the California legislature is considering a bill to clamp down on underage drinking on party buses.

Cyclist Killed on Campbell Avenue Identified

A Cupertino man who was struck by a car while riding his bicycle in Campbell was pronounced dead at the scene.

The cyclist was identified as Charles Shaffer of Cupertino.

Around 6:25 p.m. on Thursday Campbell police say Shaffer was attempting to cross four-lane Campbell Avenue east of La Pradera Drive in front of the Kirkwood Plaza Shopping Center.

A Buick sedan traveling east, driven by an unidentified 28-year-old man, struck Shaffer.

Traffic was diverted for a time after the collision.

There is no indication the car was traveling at excessive speed, according to Campbell Police Capt. Charley Adams.

The driver remained at the scene and Adams said he has been “very cooperative” with the investigation. He submitted to a voluntary substance test and police do not believe drugs or alcohol were a factor in the collision.

Officers responded to a report of a traffic collision between a cyclist and a car, Adams said. Upon arrival, officers found Shaffer in the center of Campbell Avenue.

“Emergency personnel attempted to revive (him) but were unsuccessful,” Adams said. “He was pronounced dead at the scene.”

The car is still being processed and witness accounts are being vetted, police said.

Child dies after Fresno crash; Central High coach faces DUI, manslaughter charges

Central High School’s boys varsity basketball coach faces a charge of vehicular manslaughter after a child struck in a northwest Fresno crash Wednesday night died, police say.

The 7-year-old child was one of three family members riding bicycles in a crosswalk across Shepherd Avenue when they were struck by a car driven by Loren LeBeau, 42, police said.

Police said LeBeau left the accident scene but later returned and identified himself. He was arrested on suspicion of driving under the influence, Lt. Mike Doyle said.

Doyle said a father and his 2-year-old daughter were on one bicycle and the 7-year-old boy on another when they were hit as they rode the Fresno-Clovis Rail Trail across Shepherd Avenue just after 9 p.m.

The boy, identified by the Fresno County coroner as Donovan Maldonado, was dragged a couple hundred yards down westbound Shepherd Avenue, Doyle said.

The boy was taken either to Community Regional or Children’s Hospital Central California and was initially listed in very critical condition.

The father and daughter were taken to Community Regional Medical Center with serious injuries. Doyle said. They were not identified.

Doyle said the family was in a group that included four others — including the children’s mother — who were walking the trail. A street light at that crossing was not working Wednesday night.

Police were trying to determine Wednesday night how fast the driver was going, and whether his headlights were on at the time of the crash.

Although Doyle could not confirm LeBeau was Central High’s coach, a player contacted Wednesday night who saw television footage of the driver confirmed he was the school’s coach.

LeBeau has been Central High’s varsity basketball coach for 10 seasons, including the past five years.

In between his two stints as Central’s coach, LeBeau served as an assistant coach at Pepperdine and Fresno City.

Company recalls hundreds of thousands of strollers

WASHINGTON — Peg Perego recalled hundreds of thousands of strollers Tuesday because children can become trapped and strangled between trays on them. One death has already been reported.

A six-month-old boy from Tarzana, Calif. died of strangulation in a stroller in 2004, while a seven-month-old girl from New York was nearly strangled in 2006, according to Peg Perego USA Inc. The company said entrapment and strangulation can take place, particularly among those younger than a year old, when the child is not harnessed into the stroller. If unharnessed, children can pass through the opening between the tray and the seat bottom and the child’s neck and head can become trapped by the tray.

Peg Perego is recalling approximately 223,000 strollers, which include Venezia and Pliko-P3 strollers in various colors, made between January 2004 and September 2007.

Only strollers with a child tray and one cup holder are part of the recall. Strollers with a bumper bar in front of the child or a tray with two cup holders are not included in this recall.

The company said the strollers were made before a voluntary industry standard was implemented in January 2008 that addresses the height of the opening between the stroller’s tray and the seat bottom. The voluntary standard requires larger stroller openings that prevent infant entrapment and strangulation hazards.

The model number is located on a white label on the back of the Pliko P-3’s stroller seat and on the Venezia stroller’s footboard. “Peg Perego” and “Venezia” or “Pliko-P3” are printed on the side of the strollers.

The Pliko-P3 strollers were sold for between $270 and $330, while the Venezia strollers sold for $350 to $450. The strollers were sold at various retailers, including Buy Buy Baby and Babies R Us.

Consumers are advised to immediately stop using the strollers and contact Peg Perego for a free repair kit at (888) 734-6020 or on its web site, www.PegPeregoUSA.com.

Separately, Kolcraft Enterprises Inc. is recalling some strollers due to potential falling and choking hazards.

The company is recalling about 5,600 of the Contours Options LT double strollers with model number ZT012 sold between February and July. However, no injuries have been reported.

The front wheel assembly can break, which could lead to a child falling out of the stroller. And the nuts that hold the stroller’s basket support screws in place can detach on strollers made in January and February. The detached nuts are a potential choking hazard.

Kolcraft has received six reports of front caster wheels breaking and two reports of the basket’s support screws and nuts detaching.

The model number and date the stroller was made can be found on a label on the stroller’s rear leg. The strollers were involved in the recall include those in black with red canopies and accents and those in gray with yellow canopies and accents. The strollers have one mesh basket below the two seats.

The strollers were sold for about $250 in Burlington Coat Factory stores, at juvenile product specialty stores and on the websites of Amazon, Target and other retailers.

Consumers should immediately stop using the strollers and contact Kolcraft for free replacement wheels. Those with strollers made in January and February will also receive replacement nuts. The company can be reached at (800) 453-7673 or online at www.kolcraft.com.

Santa Paula police officer killed in DUI crash

A Santa Paula police officer was killed and another person was arrested on suspicion of driving under the influence after a crash Sunday night near Santa Paula, authorities said.

Officers responded to the single-vehicle collision about 9:15 p.m. on eastbound South Mountain Lookout Road near Coyote Canyon Road, the California Highway Patrol reported.

Authorities say the driver of the car, Christopher Blankenship, lost control of the car when approaching a curve on the winding road. The vehicle spun and rolled over at about 9:15 p.m

The passenger, who was partially ejected and pinned under the jeep, was pronounced dead at the scene, officials said.

The Ventura County Medical Examiner’s office identified the passenger as Kimberley Hemminger, 33, of Oxnard. Hemminger had been a Santa Paula police officer since July 2008.

Two other people in the jeep, both female, sustained minor injuries, authorities said. One suffered a minor cut on her knee and the other had bruises and neck pain, the CHP reported.

The driver, whose name was not released this morning, was arrested on suspicion of driving under the influence of alcohol and vehicular manslaughter, officials said.

None of the people in the jeep were wearing seat belts, the CHP reported.
