Big rig crash closes 60 Freeway in Diamond Bar, one person dead

One man was killed and three men were injured Friday morning in a pileup involving three big rigs on the 60 Freeway.

The crash led to the closure of the eastbound 60 for several hours, and the temporary closure of the westbound lanes as well.

Coroner’s officials didn’t release the dead man’s name because his next of kin hasn’t been notified yet. The California Highway Patrol identified him as a 46-year-old Norco resident.

CHP Officer Kerri Rivas said a Ford F7000 box truck and a tractor trailer traveling on the eastbound 60, west of Phillips Ranch Road got into a minor collision at 11:03 a.m.

They pulled onto the freeway shoulder to exchange insurance information. The Ford’s driver, his two passengers and the big rig driver were standing between the vehicles.

A third truck carrying bananas and tomatoes came into view.

“For unknown reasons, (the driver) veers to the right and rear ends the parked big rig. The big rig lurches about 15 feet forward and crushes three of the four people,” Rivas said.

The third truck then veered to the left and overturned onto the freeway, spilling boxes of bananas across the lanes. Some fuel also spilled onto the freeway.

Rivas said the driver of the box truck was pronounced dead at the scene.

One of his passengers was able to jump out of the way and wasn’t hurt.

But the second passenger, 40-year-old Arnold Hutchinson of Mira Loma, ended up with major injuries. Rivas said Hutchinson was taken to Pomona Valley Hospital Medical Center then flown by helicopter to Arrowhead Regional Medical Center where he is in critical condition.

The driver of the parked big rig, 53-year-old Constantino Olmos of Riverside, also sustained major injuries. Olmos was taken by helicopter to Los Angeles County USC Medical Center and is in the intensive care unit, according to Rivas. He is listed in critical condition.

She said the man driving the third truck, Emilio Alvarez, 23, of South Gate, complained of pain and was treated at San Dimas Community Hospital.

The eastbound lanes of the 60 Freeway, from the 57 freeway to Phillips Ranch Road, were shut down. Traffic was diverted off the freeway.

Officials with the Los Angeles County Coroner’s office arrived at the scene about 2 p.m. to retrieve the body.

Coroner’s investigator Elissa Fleak said an autopsy is scheduled this Sunday.

The closure of the eastbound lanes resulted in a traffic jam stretching into Rowland Heights. Westbound lanes were closed for a short time to allow a rescue helicopter to land. Traffic was also jammed on the northbound 57 from Tonner Canyon Road.

The car pool lane, the No, 1 and 2 lanes were reopened at 5:55 p.m. All eastbound lanes were opened at 7:17 p.m.

San Jose families mourn Highway 152 crash deaths resulting in DUI arrest

Relatives are preparing to lay two San Jose women to rest after authorities say they were killed in a car crash near Los Banos last week at the hands of a San Jose man driving against traffic while on drugs.

Alicia Carranza, 40, and 30-year-old Sara Castro Chiti were passengers in a Ford F-150 pickup on eastbound Highway 152 approaching Interstate 5 in the early-morning hours of Oct. 9 when the truck was hit head-on by a Ford Explorer going the wrong way, according to the California Highway Patrol and Merced County Sheriff’s Office.

Chiti was pronounced dead at the scene. Carranza was airlifted to a Modesto hospital, where she died. Another passenger in the pickup, 23-year-old San Jose resident Maria Can, was hospitalized with major injuries. The pickup driver, 23-year-old Victor Manual Herrera of San Jose, suffered minor injuries.

The driver of the wrong-way Ford Explorer, 68-year-old San Jose resident Ali Farsad, suffered minor injuries and was soon arrested on suspicion of multiple counts of vehicular manslaughter and driving under the influence of illegal drugs. He is being held in Merced County Jail on $304,404 bail. It was not immediately clear what drugs Farsad was allegedly using.

Friends and relatives said the four people in the F-150 were headed to Los Angeles for janitorial jobs there when the crash occurred.

Chiti emigrated from the small Guatemalan town of Totonicapán seven years ago, and other than brother Govany Castro and sister-in-law, her family still lives there. Castro remembered his sister, who once cleaned houses in SanJose before getting her current job in Southern California, as a social person who doted over his 2-year-old son.

“She was friendly, outgoing and had a lot of friends,” Castro said. “And she totally loved my son.”

Carranza was a friend and co-worker of Chiti; her family could not immediately be reached. Can is Govany Castro’s sister-in-law.

A funeral Mass for the two women is tentatively planned for Thursday morning at Our Lady of Guadalupe Church on San Antonio and Jackson streets in San Jose.

CHP Reports Alcohol played role in fatal Willow Creek bus crash

An unidentified 19-year-old woman was killed and seven other people were injured when a bus drove off a steep embankment on State Route 96 late Friday night, according to a California Highway Patrol press release issued Saturday.

Around 9:50 p.m. a 1993 GMC former school bus driven by Lorenzo Jackson, 42, of Washington state, drove off the right of the highway for unknown reasons approximately four miles north of State Route 299, according to the release. The bus rolled a short distance down a steep embankment, and came to rest against some trees.

Jackson broke his leg exiting the bus, according to the release. Two other passengers exited the bus and remained nearby while two passengers walked up to State Route 96. Three people remained in the bus, including a woman who was pronounced dead at the scene by paramedics.

Deputy Coroner Roy Horton said the woman’s identity is currently unknown, and that the passengers on the bus did not know very much about each other.

During investigation of the crash, it was determined that both Jackson and 35-year-old Joseph Forcier of Florida had driven the bus under suspicion of alcohol intoxication prior to and during the collision, according to the release.

Both men were arrested and remain at medical facilities to be treated for their injuries. Forcier received major head trauma and was transported to Mad River Community Hospital, according to the release.

According to the California Highway Patrol the crash was “due to the Bus driver’s state of intoxication, the driver failed to maintain effective control of the vehicle, which ran off the left side of the roadway”.

Adelanto woman killed in freeway crash

An 18-year-old Adelanto woman was killed late Friday night after the vehicle she was riding in lost control on the Palmdale Road on- ramp to southbound Interstate 15, was struck by an oncoming pickup truck, then both were hit by a tractor-trailer, California Highway Patrol and San Bernardino County Coroner’s officials said.

The woman, identified by the coroner’s office as Alejandra Gomez, was a passenger in a 2004 Silver Toyota Corolla. Just before 10 p.m. the driver attempted to merge onto the southbound 15 freeway by the Palmdale Road on-ramp. The driver lost control, was struck by the truck which pushed the Corolla onto the freeway and in the path of oncoming traffic, according to reports.

One minute after CHP dispatch received the call of the initial crash, several calls came in reporting a southbound tractor-trailer had struck both the Corolla and the truck.

Paramedics arrived and Gomez was pronounced dead at the scene at 10:00 PM. The California Highway Patrol is investigating the incident.

While authorities have identified the 18-year-old as Alejandra Gomez, her friends say she is known as Alejandra “Ally” Mendoza.

Friends and family took to the teen’s Facebook page to offer prayers to the family and to voice their disbelief over her sudden death.

The term “wrongful death” is defined as the death of an individual as a result of the negligence, carelessness, intentional act of another individual, corporation, company or entity.  Filing a proper wrongful death claim is extremely difficult and complex for families because they are not only dealing with their grief over the death of a beloved family member, but also complex issues of compensation as well.  Wrongful death claims are usually sought after by relatives, siblings, or members of the decedent’s estate who have lost a considerable amount of money as well as loss of support and grief due to the wrongful death of the decedent.

In most states, if the death of a relative or spouse was caused by the wrongful act of another, surviving family members can file a wrongful death lawsuit against the negligent party or parties.  In order to file a wrongful death claim, you must be able to prove that you will experience severe future emotional and financial hardship because of the loss of the death of a relative, family member or spouse.

A man on a bike who was being sought by deputies was killed early Monday in a collision involving a deputy’s patrol vehicle in Inglewood, according to authorities.

LA County Sheriff’s Deputies say they believed Alfonso Cerda Sr. was carrying a gun when they tried to stop the bicyclist in Inglewood early Monday. Cerda was killed in a collision involving a deputy’s patrol vehicle. No gun was found and his family members say the 45-year-old father of three never carried a weapon.

Family members identified the victim as a 45-year-old Alfonso Cerda, a father of three who lived in the neighborhood.

Deputies were attempting to contact the individual because they thought he had a gun, authorities said. No weapon was found.

“My dad never carried a weapon,” said Alfonso Cerda Jr. “If he was on his bike he had a flashlight, his wallet, and that’s it — and his happiness.”

Two sheriff’s deputies attempted to stop the man, who they believed was armed, according to the sheriff’s department.

“At that time, the man on the bicycle took off,” said Lt. James Madia, of the Inglewood Police Department. “He tried to escape from the deputies. They gave chase in the police car.”

The collision occurred at about 1:30 a.m. in the 3500 block of West 107th Street. The man was pronounced dead at a hospital, authorities said.

Cerda rode the bike around the neighborhood, fixing electric items and selling old clothes, family members said.

“My dad didn’t deserve to die,” said Cerda Jr. “How do you hit someone with a 5,000-pound vehicle? How does that happen?”

Police Brutality Attorney

Have you been the victim of a police brutality?  Have you lost a loved one from a police brutality you believe was unjustified?  If so, you need the help of  the Law Offices of Gary A. Kessler.  Contact us today for a free consultation regarding the specifics of your case.  We have extensive practice in this area, and have a track record of recovering millions for victims of unjustified police civil rights violations and their families.  Unless a person shoots at officers or hurts others in the presence of the police, it is usually unnecessary for police to use unnecessary force.  Unlawful civil rights violations by police are considered excessive force, and are a violation of rights.

Tensions are High

Whenever police are involved in a situation, tensions are automatically raised.  In turn, individuals may panic and behave irrationally.  The police are sworn to protect citizens, and trained in ways to calm intense circumstances and the people involved.  If inadequately trained, there is the problem of excessive force being used by the police, often by the way of shootings or other means of excessive force, when not necessary.  The police firearm should be used in only extreme situations, and every other method to calm the conflict should be used in exhaustion before firing, even when using non-lethal methods such as police vehicles, bean bag guns or tasers.  Although non-lethal, these methods of control can still cause significant injury to the victim, and should not be used unless absolutely necessary.  Recent victims of police shootings from bean bag shot guns have needed emergency surgery, and even died as a result of the wound.  In many cases, this is due to a lack of training for the police officer.

The Next Step

If you have lost a loved one due to a police shooting  or police excessive force you believe to be unjustified, or are yourself a victim of an unjustified police shooting, it is important for you to take action immediately.  Although an investigation of all police shootings is done by the police department, that can hardly be considered an objective investigation, when it is obvious they will lean toward the shooting being justified if there is any question on how evidence can be construed.  Our attorneys will be able to uncover any evidence necessary to find out what actually occurred to result in the shooting or excessive force.  Contact the Law Offices of  Gary A. Kessler today to find out how we can help you.
