3 dead in fiery I-5 head-on crash involving 3 big rigs
Three big-rig drivers died late Monday night when one drifted into traffic moving in the opposite direction on Interstate 5 north of Stockdale Highway, according to the California Highway Patrol.
Around 10:15 p.m. Monday, the driver of a southbound truck allowed his rig to drift across the dirt center divider and into the northbound lanes, into the path of the two northbound semi-trucks.
Names of the dead and their cities of residence have not yet been released by the coroner’s office.
The incident snarled traffic in the area until about 9 a.m. Tuesday Motorists were advised to uses alternate northbound routes.
One driver was traveling southbound on Interstate 5 at an unknown speed north of Stockdale Highway, a CHP news release said. It wasn’t known how fast the driver was going.
Each of the two other drivers was heading northbound, one in the No. 1 lane and the other in the No. 2. It wasn’t known how fast each of them was driving.
Around 10:15 p.m. Monday, the driver of a southbound truck driver allowed his vehicle to veer, enter the dirt center divider and cross into northbound lanes, straight into the path of the second and third drivers, the CHP reported.
The collision caused all three big-rigs to go up in flames. The drivers died at the scene, according to the CHP.

The driver of a Toyota Tacoma pickup turned left onto Gene Autry Trail from Seven Lakes Drive, Kovaleff said, citing the preliminary investigation.
The left side of the truck collided with the motorcyclist, then veered into a home at the southeast corner of the intersection, Kovaleff said. That crash broke a gas line, a break that was quickly contained.
No one was home at the time of the crash.
The motorcyclist died at the scene.
The driver of the Toyota, whose name and age were not released, suffered moderate injuries and was taken to a local hospital.
Neither alcohol nor drugs appear to be involved in the crash, Kovaleff said.

Right of Way
-
Pedestrians always have the right of way. So, no matter where you encounter a pedestrian on the road, they always have the right of way. This includes crosswalks, round-a-bouts, at intersections not marked with signals and at street corners. Crosswalks are sometimes defined by white lines or flashing lights. Crosswalks are outlined in yellow near schools.
California Pedestrian Law
“Under California Vehicle Code Section 21950 (a) The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.
(b) This section does not relieve a pedestrian from the duty of using due care for his or her safety. No pedestrian may suddenly leave a curb or other place of safety and walk or run into the path of a vehicle that is so close as to constitute an immediate hazard. No pedestrian may unnecessarily stop or delay traffic while in a marked or unmarked crosswalk.
(c) The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.
(d) Subdivision (b) does not relieve a driver of a vehicle from the duty of exercising due care for the safety of any pedestrian within any marked crosswalk or within any unmarked crosswalk at an intersection.”

Pedestrians need to be especially cautious on our roadways because they are more vulnerable to injury or death. There were two pedestrians killed and two injured in car accidents in Twentynine Palms in 2009, according to the California Highway Patrol Statewide Integrated Traffic Report. In San Bernardino County 39 pedestrians died and 440 were injured in 2009.
In California, there were 598 pedestrians killed and 12,418 injured in 2009, according to the CHP traffic report.
National data compiled by the National Highway Transportation and Safety Authority shows that pedestrian injuries and fatalities in the United States were up 4.9% in 2010 to 4,280 deaths and injuries were up 19% in 2010 to 70,000 people injured.
4 killed, 7 injured in crash on I-5 crash in Elk Grove
Four people were killed in a violent, head-on crash this afternoon on northbound Interstate 5 in Elk Grove, emergency officials said.
Tracey Hansen, chief of the Cosumnes Fire Department, confirmed the four fatalities and said seven others were injured in the wreck.
The injured were taken to UC Davis Medical Center in Sacramento, Kaiser South, Sutter General and Methodist Hospital, all in critical but stable condition.
Names of those killed in the crash have not yet been released.
Northbound lanes of I-5 near the crash site remain shut down as emergency officials continue to clean up the scene and investigate further.
Hansen said emergency crews were dispatched to the crash site about a half mile north of Hood Franklin Road at 3:41 p.m.
Investigating officials there said a 2004 Ford Expedition, a large sport-utility vehicle that comes with three rows of seating, was southbound on I-5 when it veered out of control for an as-yet unknown reason and crossed the center divider, colliding head-on with a 2012 Honda Accord heading north.
Both vehicles rolled over, and people were ejected from both cars.
Officials said the Ford had nine occupants, including a driver and two passengers who were killed and six others who were taken to hospitals.
The Honda Accord had two occupants. Officials said the male driver of the Honda was killed, and a female passenger believed to be 50 to 60 years old was taken to a hospital.
Another vehicle, a Toyota RAV4 towing a boat, was involved in the crash, but no injuries were reported in that SUV.
Officials said the closed lanes of I-5 – shut down at Twin Cities Road – are expected to remain closed until late tonight or very early tomorrow morning.
Northbound traffic is being detoured east to Franklin Boulevard or Highway 99. Motorists wanting to re-enter I-5 northbound can do so via Elk Grove Boulevard.

The term “wrongful death” is defined as the death of an individual as a result of the negligence, carelessness, intentional act of another individual, corporation, company or entity. Filing a proper wrongful death claim is extremely difficult and complex for families because they are not only dealing with their grief over the death of a beloved family member, but also complex issues of compensation as well. Wrongful death claims are usually sought after by relatives, siblings, or members of the decedent’s estate who have lost a considerable amount of money as well as loss of support and grief due to the wrongful death of the decedent.
In most states, if the death of a relative or spouse was caused by the wrongful act of another, surviving family members can file a wrongful death lawsuit against the negligent party or parties. In order to file a wrongful death claim, you must be able to prove that you will experience severe future emotional and financial hardship because of the loss of the death of a relative, family member or spouse.
CHP reports fatal head-on east of Porterville blamed on dropped cell phone
An elderly man was killed and an elderly woman sustained major injuries when their Honda sedan was hit head-on by a Cadillac sedan whose driver was distracted by his cell phone east of Porterville just after 3 p.m. Saturday, the California Highway Patrol said.
The CHP described the couple, who were from Lancaster, as elderly but did not provide their ages or names. They were traveling northbound on Success Valley Road north of Reservation Road when a man driving a Cadillac was distracted by his ringing cell phone, attempted to pick it up but dropped it on the floor, CHP Sgt. Joe Vega said. When the man tried to retrieve his phone, the Cadillac veered into the northbound lanes, colliding head-on with the Honda, the CHP said.
The Honda driver was pronounced dead at the crash site and the woman was airlifted to Community Regional Medical Center in Fresno, Vega said.
The four people in the Cadillac, including the driver, sustained moderate injuries and were taken to Kaweah Delta Medical Center. All four live on the reservation, Vega said.
No alcohol or drugs are suspected in the crash, Vega said.

Gary A. Kessler believes enforcement and common-sense safety laws, such as texting while driving bans, can help prevent distracted driving car accidents, and deaths. But legislation is not the only solution. Common sense, personal responsibility and educating drivers about the dangers of distracted driving are all major parts of the solution that will save lives.
Distracted Driving
Each day, more than 15 people are killed and more than 1,200 people are injured in crashes that were reported to involve a distracted driver. Distracted driving is driving while doing another activity that takes your attention away from driving; these activities can increase the chance of a motor vehicle crash.
There are three main types of distraction:
A recent CDC analysis examined the frequency of two major distractions—cell phone use and texting—among drivers in the United States and several countries in Europe.
- Visual—taking your eyes off the road;
- Manual—taking your hands off the wheel; and
- Cognitive—taking your mind off what you are doing.
Distracted driving activities include things like using a cell phone, texting, and eating. Using in-vehicle technologies (such as navigation systems) can also be sources of distraction. While any of these distractions can endanger the driver and others, texting while driving is especially dangerous because it combines all three types of distraction.
How big is the problem?
- In 2009, more than 5,400 people died in crashes that were reported to involve a distracted driver and about 448,000 people were injured.
- Among those killed or injured in these crashes, nearly 1,000 deaths and 24,000 injuries included cell phone use as the major distraction.
- The proportion of drivers reportedly distracted at the time of a fatal crash has increased from 7 percent in 2005 to 11 percent in 2009.
- When asked whether driving feels safer, less safe, or about the same as it did five years ago, more than 1 in 3 drivers say driving feels less safe today. Distracted driving—cited by 3 out of 10 of these drivers—was the single most common reason given for feeling less safe today.
- A recent CDC analysis examined the frequency of two major distractions—cell phone use and texting—among drivers in the United States and seven European countries (Belgium, France, Germany, the Netherlands, Portugal, Spain, and the United Kingdom). Results of the analysis included the following findings:
- Cell phone use while driving:
- 25% of drivers in the United States reported that they “regularly or fairly often” talk on their cell phones while driving.
- In Europe, percentages ranged from 21% in the Netherlands to 3% in the United Kingdom.
- 75% of U.S. drivers ages 18 to 29 reported that they talked on their cell phone while driving at least once in the past 30 days, and nearly 40% reported that they talk on their cell phone “regularly” or “fairly often” while driving.
- In Europe, percentages of young adults who reported talking on their cell while driving at least once in the past 30 days ranged from 50% in Portugal to 30% in the Netherlands.
- Texting or e-mailing while driving:
- 9% of drivers in the United States reported texting or e-mailing “regularly or fairly often” while driving.
- In Europe, percentages ranged from 10% in the Netherlands to 1% in the United Kingdom.
- 52% of U.S. drivers ages 18-29 reported texting or e-mailing while driving at least once in the last 30 days, and more than a quarter report texting or e-mailing “regularly” or “fairly often” while driving.
- In Europe, percentages of young adults who reported texting or e-mailing while driving at least once in the past 30 days ranged from 44% in Portugal to 17% in the United Kingdom.
- Cell phone use while driving:
What are the risk factors?
- Some activities—such as texting—take the driver’s attention away from driving more frequently and for longer periods than other distractions.
- Younger, inexperienced drivers under the age of 20 may be at highest risk because they have the highest proportion of distraction-related fatal crashes.
How can distracted driving be prevented?
- Many states are enacting laws—such as banning texting while driving—or using graduated driver licensing systems for teen drivers to help raise awareness about the dangers of distracted driving and to keep it from occurring.
- On September 30, 2009, President Obama issued an executive order prohibiting federal employees from texting while driving on government business or with government equipment.
- On October 27, 2010, the Federal Motor Carrier Safety Administration enacted a ban that prohibits commercial vehicle drivers from texting while driving.
Elderly Seattle man killed by dump truck identified
The 88-year-old man killed Tuesday after he was hit by a dump truck was identified as Herbert Whitman, of Seattle.
He suffered multiple broken bones and organ damage, according to the King County Medical Examiner’s Office, which identified him Thursday afternoon. Records show he lived less than two blocks away from where the accident happened.
Whitman was hit about 2:45 p.m. while walking in the 200 block of West Mercer Street. He was rushed to Harborview Medical Center where he died.
“Preliminary investigation indicates that a 2008 red Kenworth dump truck was facing north on 2nd Avenue West at Mercer Street,” Detective Jeff Kappel said in a statement. “The adult male truck driver initiated an eastbound turn and collided with the male pedestrian in the intersection. The circumstances leading up to the collision remain under investigation.”
Police evaluated the 38-year-old man who drove the truck and found no signs of impairment.
“There were no citations issued at the scene, which is standard procedure in serious traffic collisions requiring extensive follow up investigation and collision reconstruction,” Kappel said.
Cause of the Seattle Crash

Crash with Victorville sheriff’s vehicle injures four children
Four children were injured Halloween night after the vehicle they were traveling in was involved in a crash with a Victorville Sheriff’s patrol unit, San Bernardino County Sheriff’s officials said Thursday, and some witnesses say the patrol unit did not have its lights and siren on when the collision took place.
Initial information from the sheriff’s department does not indicate the unit had its lights on, but officials couldn’t immediately comment if the deputy ran a red light leading to the crash.
The children were airlifted to Loma Linda University Medical Center with moderate injuries and two others were taken to local hospitals following the crash which took place in the intersection of Bear Valley Road and Seventh Avenue, according to Cindy Bachman, spokeswoman for the sheriff’s department.
Around 9 p.m. Deputy Vanessa Duardo was traveling east on Bear Valley Road to an attempted armed robbery at the Goodwill store on Bear Valley and Hesperia roads, officials said, when her vehicle collided with a 1989 Chevrolet Blazer traveling north on Seventh Avenue.
The impact caused the Blazer to roll over ejecting the two children who witnesses said to be about the age of 5.
Duardo was taken to a local hospital with minor injuries, officials said. She is not expected to immediately return to work.
Dozens of witnesses, some children still in their Halloween costumes, gathered at the intersection of Bear Valley Road and Seventh Avenue and watched the scene unfold.
Cause of the Victorville Pedestrian Crash
The cause of the October 31, 2012 accident remains under investigation by the San Bernardino County Sheriff’s Department.
No details have been released about what kind of call the Victorville deputy was responding to, or how fast she may have been going at the time.
The cause of the crash is under investigation by the sheriff’s Region 2 Major Accident Investigation Team (MAIT).

Trick-or-treating children struck by car
Two children trick-or-treating in Santa Rosa were hit by a car Wednesday evening but are expected to survive, police said.
The 10-year-old boy and 4-year-old girl were crossing North Dutton Avenue in a residential area of Santa Rosa at 7:33 p.m. when they were hit by a car traveling north, said Sgt. Andrew Romero.
The adults with the children explained to police that they had been-trick or-treating along W. Eight Street and were crossing to the east-side of N. Dutton Avenue in the crosswalk, when a vehicle traveling north approached the crosswalk.
Both children were taken to the hospital and the driver stopped and cooperated with police, Romero said. Alcohol is not believed to have played a role in the crash.
The children were trick-or-treating with two adults on West Eighth Street who saw the car approaching, Romero said. The adults tried to hold the children back, but the two “darted past the adults” and into the street, Romero said.
It is was not immediately clear if the four are related.
