Wrongful Death

Motorcyclist Run Over By Big Rig

SACRAMENTO, Calif. (KCRA) — All lanes of Business 80 have reopened after a deadly crash Thursday morning that closed the eastbound side of the highway for more than four hours.

A man on a motorcycle lost control and crashed onto the concrete just before 5 a.m. near Arden Way — a wreck that might have been weather-related, the California Highway Patrol said.

A big rig driver behind him couldn’t stop in time to avoid the collision, and ended up running the man over, according to the CHP. The motorcyclist was hit by a second vehicle and died instantly at the crash scene, police said.

Traffic was backed up for about two miles in the area after the accident, but cars were soon after re-routed off the freeway to avoid the scene entirely.

The big rig driver said the air brakes on his truck went out, and he couldn’t avoid hitting the man. At first, he didn’t even realize it was a person who he had struck, police said.

Big-rig crash claims life of Marina man

A 47-year-old Marina man died in a weekend crash with a semi-truck-trailer on Highway 101 south of Chualar, the California Highway Patrol reported Monday.

The name of the victim was not released pending notification of next of kin, the CHP said.

The victim was driving south about 10 a.m. Sunday in a Buick Electra when a truck-trailer combination behind him collided with the car and caused it to go out of control and overturn, the CHP said.

The car didn’t have seatbelts, and the victim was pinned underneath the vehicle, the CHP said.

The accident occurred about two miles south of Chualar in the right-hand lane.

The CHP said the truck driver, Jose Ortiz, 42, of Mountain View failed to see the slow-moving car for an unknown reason.

Drugs or alcohol did not appear to be involved, the CHP said. The collision remains under investigation.

The truck, owned by AAVI Transport of Fresno, was hauling a load of produce from Castroville, the CHP said. The truck driver wasn’t hurt.

Cause of the the big-rig crash

According to the California Highway Patrol, the driver of the Buick was traveling with a line of classic cars on the slow lane of Southbound Highway 101. It was followed by a  motor home and a big-rig truck.

The motor home passed the Buick, but the big-rig driver did not notice the Electra’s slower speed and hit it from behind.

The impact caused the Electra to overturn on the center divide, ejecting and killing the driver.

Fault and Wrongful Death Liability

Accidents involving big-rigs  have unique and complex legal issues. If it is determined that the driver of the big-rig was  at fault for this collision, the family of the victim would be well-advised to speak to a California truck accident attorney. An experienced and knowledgeable attorney will be able to review the cause of the accident, and if warranted, arrange for an independent investigator to reconstruct the collision to determine exactly what happened and who was responsible. A skilled lawyer can also provide an explanation to the victim’s family on their legal rights in a wrongful death claim against the driver or any other parties at fault. Damages awarded in a wrongful death claim may include funeral and burial expenses, lost earnings, pain and suffering, and other damages.

Deadly boating accident on Lake Lanier overnight

BUFORD, Ga. — A 59-year-old man was killed and a woman was seriously injured when their boat was struck by a 21-foot ski boat in Lake Lanier off East Bank Park early Sunday morning.

Stephen Blake Jones of Duluth was killed, according to the Georgia Department of Natural Resources. The woman’s name has not been released. She remains hospitalized with injuries.

The occupants of the second boat, Steven Parker, 32, and Ashley LeBlanc, 30, both of Cumming, swam from their damaged ski boat to shore and flagged down a motorist for help. Parker and LeBlanc were treated at a local hospital and released.

Gwinnett County firefighters responded to the scene after receiving a 911 call from a driver who was flagged down on Buford Dam Road.

According to fire officials, Parker and LeBlanc were crossing the lake just after midnight when they struck Jones’ pontoon boat in the water.

Rescue Boats from the Georgia Department of Natural Resources, the U.S. Army Corps of Engineers, and Forsyth Fire Department began searching for the second boat.

The Gwinnett Police Aviation Unit began searching for the boat from the air.

Thirty minutes into the search, crews discovered Jones’ body in the water.

Hours later, firefighters found the second boat in the Shoal Creek area of the lake near East Bank Park.

The boating accident is believed to have occurred approximately 200 yards from the face of the dam back toward Lower Overlook Park inside Gwinnett County, according to fire officials.

Investigators from the Department of Natural resources are now going over the two boats to determine who or what is at fault for the fatal accident. Their Critical Incident Reconstruction Team is in charge of investigating accidents on state waterways. They will look at gauges, safety light bulbs, and send away for blood tests.

This is the third fatality on Lake Lanier this year, according to Mike Burgamy of the Department of Natural Resources. He is the Lake Lanier Supervisor.

“It started earlier this year, typically we don’t start seeing this many accidents until after the first holiday weekend, that being Memorial Day,” Bergamy said.

Investigators would not say whether safety lights were on or drugs or alcohol were involved in this case.

Boating Accident Personal Injury and Wrongful Death Liability

The most common boating accidents are collisions with other boats, sinkings, capsizings and boat disappearances.

Boating accidents occur very quickly and in many different places.  Lakes, canals, rivers, intercoastal waterways and oceans are where tragedies normally occur.  Last year in California, there were 744 boating accidents involving 439 injuries and 44 fatalities.

According to the United States Coast Guard each year there are more than 8,000 boating accidents in the U.S. that result in 4,000 serious injuries and 800 deaths.

Many times a boater will have been speeding or may have had too much alcohol.

There are specific boating laws that must be followed or fatalities can occur.  The Law Offices of Gary A Kessler is familiar with the different state’s boating laws.  We know the boating liability issues and will inform you of your true state, local and Federal boating rights and legal options which will result in successful outcome in your case.

It is a general rule of law that the operator of a boat and its owner has a duty to exercise a reasonable degree of care in order to prevent injuries to others.  The most common boating accidents are collisions with other boats, sinking and boat disappearance.  Boating injuries usually occur because of a reckless or careless operator, alcohol, boat malfunctions or an inexperienced boating (captain) operator.

Operators of boats have a legal obligation to operate their watercraft in a safe and prudent manner.  The overwhelming majority of boating accidents are caused by factors that can be controlled by the operator of the boat.  The primary cause of boating accidents nationwide was operator inattention, followed by careless/reckless operation, operator inexperience, operating at an unsafe speed, and failure to have a proper lookout.

Common violations of the duty of ordinary care in a maritime setting include a failure to warn against foreseeable harm, violations of “rules of the water,” such as excessive speed, failure to have proper lights, failure to yield, intoxication and others.  Owners may also be held liable under the theory of vicarious liability.  For example, an owner may be held liable for an operator’s failure to warn passengers of intended maneuvers, overloading the boat or permitting the guest to sit in a dangerous position.

Accidents involving bystanders, such as swimmers or water skiers, are typically treated in the same manner as cases involving social guests.  The law and courts where the accident occured will generally control any lawsuits brought by injured bystanders unless the defendant boat owner asserts admiralty jurisdiction.

The laws regarding boating accident (drowning) cases are complex and include many facets of the law.  It is vital to surviving family members to seek the advice of an experienced boating fatality lawyer such as Gary A Kessler at the Law Offices of Gary A Kessler to protect your rights and those of your loved ones.

Forklift accident kills laborer

A forklift accident killed a 32-year-old laborer yesterday in Mojave Desert community of Helendale where the victim was helping to line a waste water pond, San Bernardino County coroner’s officials say.

Jose Reyes died at the scene of the 9:14 a.m. accident Thursday along the 14400 block of Cougar Road, said coroner’s spokeswoman Sandy Fatland. Helendale is roughly mid-way between Victorville and Barstow.

The forklift was moving heavy rubber rolls that were being used to line the pond, Fatland said. It’s unclear exactly what happened because no witnesses saw the accident, she said.

The Santa Ana resident suffered a head injury, though he was wearing a helmet, Fatland said.

The death is being investigated by deputy sheriffs and Cal-OSHA.

Beyond Workers’ Comp

Many injured construction workers assume they are only able to receive workers’ compensation benefits for injuries on the job site.  A careful analysis of the accident by an attorney experienced in construction injury claims may reveal other sources of financial compensation.  If an employee of another subcontractor was responsible for the falling debris that injured you, we may pursue an injury claim against his or her employer, for example.  A general contractor who failed to maintain a safe workplace may also be liable.

The Law Offices of Gary A Kessler have a long history of winning impressive results for construction injury victims and the family members of those who died a wrongful death due to construction accidents.

Demand accountability from those responsible for the dangerous conditions of the construction site accidents.  Many times the insurance companies will play “hardball” if you try to settle the case yourself or you have employed a lawyer who does not have the litigation experience to handle such a complex case.  We at the Law Offices of Gary A Kessler have twenty years of litigation experience and know how to handle the insurance companies to your advantage.  We are prepared to front all costs required for the necessary investigation and expert witnesses needed to prepare your case for trial.

Bicyclist killed in multi-car crash

RANCHO MIRAGE — A bicyclist was killed Wednesday in a multi-vehicle collision that shut down Ramon Road and DaVall Drive in Rancho Mirage for several hours.

Palm Springs resident Donald McCluskey, 49, died at 1:40 p.m. at Desert Regional Medical Center in Palm Springs, according to the Riverside County coroner’s office.

The crash also resulted in the arrest of Larry Wayne Goodman, 60, of Cathedral City, on suspicion of driving under the influence of drugs, according to the Riverside County Sheriff’s Department.

Authorities, though, do not believe Goodman caused the crash.

The collision occurred around 12:15 p.m. when a 2010 Chrysler Town and Country van heading north on DaVall sped through a red light and was hit by a 1998 GMC Sierra pickup heading west on Ramon, authorities said.

The van flipped onto its side and skidded into McCluskey, who had been waiting for the light to change.

A 2010 Nissan Murano also was struck.

McCluskey was thrown into the Nissan.

He was rushed to the hospital with major injuries, where he later died, according to sheriff’s spokesman Deputy Angel Ramos.

The driver of the van, whose name was not released, was also hospitalized with moderate injuries, investigators said.

Goodman, who was arrested on suspicion of DUI, was the driver of the truck.

He and the Nissan’s driver were not injured, according to the sheriff’s department.

The intersection was closed until about 7 p.m. while sheriff’s department investigators reconstructed the crash.

The investigation is ongoing.

Fatal Saturday crash still under investigation

Police are still determining what caused a woman behind the wheel of a pickup to crash into a motorcyclist Saturday night, killing the young woman on the bike.

Bakersfield Police Department spokeswoman Sgt. Mary DeGeare said witnesses reported that the truck’s driver, Annamarie Reynosa, 20, never slowed or braked before she crashed into Charla Wilkins, 20.

Wilkins had been riding a motorcycle north on Jewetta Avenue and was stopped at the intersection with Reina Road when Reynosa ran into her at 8:37 p.m., police said.

Witnesses said Reynosa was driving at or above the speed limit when she hit Wilkins, according to police. DeGeare said Reynosa had consumed alcohol before the crash but was below the legal limit for driving under the influence. Reynosa had not been arrested or charged with a crime, DeGeare said Monday.

Wilkins, who was wearing a helmet, was taken to Kern Medical Center where she died at about 9:30 p.m., according to a Kern County Sheriff’s Department Coroner Section news release. Her funeral is scheduled for 11 a.m. Friday at Bakersfield Family Church-His House of Refuge, 106 Wilson Ave.

Pastor Richard Hill, who knew Wilkins for more than a decade, said she was a happy person who loved her family.

“She was just a beautiful young lady. Very loving, very kind,” Hill said.

The pastor said he remembered the first time he met Wilkins: She kept her twin brother and two younger brothers in line, and made sure they were polite. The four were very close, he said.

“She was kind of like a mother hen to them,” Hill said.

Wilkins had recently gotten into motorcycles, Hill said. She loved it but Hill said he tried to talk her into getting rid of her bike because he worried about her safety.

A memorial fund for Wilkins has been set up at Kern Schools Federal Credit Union. Donations can be made at any of the credit union’s branches to the Charla Wilkins Memorial Fund.

The term “wrongful death” is defined as the death of an individual as a result of the negligence, carelessness, intentional act of another individual, corporation, company or entity.  Filing a proper wrongful death claim is extremely difficult and complex for families because they are not only dealing with their grief over the death of a beloved family member, but also complex issues of compensation as well.  Wrongful death claims are usually sought after by relatives, siblings, or members of the decedent’s estate who have lost a considerable amount of money as well as loss of support and grief due to the wrongful death of the decedent.

In most states, if the death of a relative or spouse was caused by the wrongful act of another, surviving family members can file a wrongful death lawsuit against the negligent party or parties.  In order to file a wrongful death claim, you must be able to prove that you will experience severe future emotional and financial hardship because of the loss of the death of a relative, family member or spouse.
