Wrongful Death

Woman killed in big rig crash on I-680 in San Jose

A horrific scene unfolded on a freeway off ramp Thursday morning when a tumbling big rig fell on top of a car, crushing a passenger to death and critically injuring the truck driver, the California Highway Patrol said.

The collision was reported just before 10 a.m. as the rig driver was getting onto northbound Interstate-680 from eastbound McKee Road, said Officer DJ Sarabia. The male driver lost control while taking the cloverleaf on ramp, causing his trailer to fall onto a passing gray Toyota Camry occupied by two women.

The passenger, described as being in her 40s, was killed at the scene. The Camry driver, a woman in her 20s who may be the victim’s daughter, was taken to Valley Medical Center with minor injuries.

The rig driver, a man in his 30s, was taken to Regional Medical Center in San Jose — located less than a mile from the crash site — with critical injuries, Sarabia said. The trailer was filled with broccoli, but the load did not spill out.

Within moments of the crash, onlookers gathered along the south side of the overpass and peered through chain-link fencing as authorities righted the trailer and moved the wrecked Camry onto a tow truck. The victim remained inside the vehicle and will be taken to the coroner’s office for extraction, away from public view, Sarabia said.

Authorities shut down the offramp from northbound I-680 to westbound McKee Road, as well as the onramp from eastbound McKee Road to northbound I-680. Sarabia said motorists should expect delays and blockages until at least 2 p.m.

Cause of the San Jose Big-Rig Crash

A preliminary investigation suggests that speed was a likely cause for the overturn. According to Officer D.J Sarabia of the California Highway Patrol “We think he was going too fast to make that curve”.

Sacramento Woman Dies In Scuba Diving Accident

On Sunday morning, a Sacramento County woman died while diving with a scuba instructor at Ocean Cove near Jenner.

The diver, Teresa Collentine, 43, of Elk Grove, and her husband, James, were updating their diving skills with instructor Joe Mohamed when she began having trouble at about 10:15 a.m., the Sheriff’s Office said.

The three were swimming through kelp beds to open water when Collentine began thrashing in the water without her regulator in her mouth, officials said.

Her husband and the instructor got a secondary regulator in her mouth and started for the shore. As they headed back, Mohamed determined she wasn’t breathing.

On land, they attempted lifesaving measures, but Collentine was pronounced dead at about 11 a.m. Officials said the cause of death is unknown.

California Scuba Diving Accidents

Scuba diving is a potentially hazardous sport that carries with it certain inherent risks. Hundreds of U.S. citizens are injured in scuba diving accidents worldwide and over 70 divers die annually as a result of their injuries. In order to dive in the U.S., people must complete and pass a diving certification course. Risks are discussed and safety issues are addressed during the course. Commercial and recreational SCUBA diving accidents usually occur because of poor judgment, improperly maintained equipment, inadequate training, or inadequate supervision.

Fortunately, most commercial and recreational diving accidents are preventable. The most dangerous risk a scuba diver faces is decompression sickness, also known as “the bends”. This occurs when a diver returns to the surface too quickly. While diving, pressure underwater causes nitrogen from the air the diver is breathing to dissolve in the body. Nitrogen bubbles, which form in the blood stream, can cause a variety of problems. Minor injuries may include joint pain as well as skin problems. In more serious cases, paralysis, blindness, brain injuries, and even death may result.

Divers are routinely required to sign liability waivers and releases from the certifying agent, dive resort, boat owner and operator, and anyone related to the dive. Most courts have upheld these releases reasoning that since diving is a voluntary sport, involving risk, that the diver freely waives the right to sue the parties named in the release. However, not all courts uphold these releases as there may be negligence that makes the release inapplicable in certain cases.

When you undergo training for your scuba diving certification, you trust your instructors to provide you with safe, functional equipment and accurate training. Failure to do so may cause you to enter hazardous or even deadly situations. Unfortunately, tragic scuba diving accidents do occur, and due to the environment the victims are in when engaged in this activity, even minor mistakes could cost them their lives.

Causes of Scuba Diving Accidents

When future scuba divers go through the training courses necessary to be granted certification, they should be taught the risks associated with scuba diving and the measures necessary to avoid them. Malfunctioning equipment, failure to adhere to safety measures, and inexperience are all contributing factors to dangerous scuba accidents. In addition, it is quite dangerous to dive alone. Divers should also have been taught what marine organisms to avoid, such as jellyfish and stingrays. Lastly, they should know to survey the dive site for temperature and depth before submerging themselves.

These are all precautions that students should be taught by instructors in their training courses. If your instructor failed to provide you with the appropriate information to safeguard you against scuba risks and accidents, then you may be able to confront that individual in a legal setting, should you suffer a scuba injury.

These are just a partial list of the more common types of scuba diving accidents and injuries:

  • Dive Operator Negligence
  • Boat Run Overs / Drive Offs
  • Out of Air Emergencies
  • Nitrogen Narcosis / Bends
  • Current or Water Conditions
  • Improperly Maintained Equipment
  • Unfamiliar with Equipment / Dive Site
  • Training and/or Dive Buddy Negligence If you or someone you know have been in a commercial or recreational scuba diving accident or related injury in the state of California, simply contact The Law Offices of Gary A. Kessler.

Man killed in Fremont crash involving big rig

FREMONT — A man died when a big rig and a cement truck collided Friday morning in the city’s Warm Springs district, police said.

The fatal crash occurred about 8:30 a.m. in the 47100 block of Kato Road, near where West Warren Avenue meets Interstate 880, police said. The cement truck was heading north when it collided with the southbound big rig, which was carrying a boom crane.

The cement truck driver, identified only as a 39-year-old man, was pronounced dead at the scene with major head injuries. The 51-year-old driver of the 18-wheel truck suffered minor injuries and was transported to a hospital, police said.

Drugs and alcohol don’t appear to be factors in the collision, police said.

Authorities closed Kato Road between Benicia and Auburn streets for several hours while they investigated what caused the accident.

Council candidate’s father killed in cycling accident

Alfredo Pedroza, the 56-year-old father of Napa City Council candidate Alfredo Pedroza, was killed on Silverado Trail on Thursday evening while riding his bicycle home from a 50-mile workout.

The senior Pedroza was riding southbound on the shoulder of Silverado Trail just south of Pine Ridge Winery at 6:30 p.m. when a Ford hatchback, also heading south, veered off the roadway at 55 mph and struck him, California High Patrol Sgt. Gilberto Jose said.

Pedroza was killed instantly, the CHP said. The vehicle then crashed into an embankment and eventually came to rest against a hill, Jose said.

His son, Alfredo, is a Napa banker who is running for City Council in the November election.

The car was driven by Cammie Mutz, 20, of Calistoga, Jose said. The cause of the crash is still under investigation. Drugs and alcohol are not suspected, Jose said.

Mutz was not injured in the crash, but was taken to Queen of the Valley Medical Center as a precaution, Jose said. Mutz was “very upset” about the accident.

Jose said there were no obvious road hazards at the time, noting traffic was light, it was still daylight and the shoulder in that area is at least three feet wide.

The CHP will investigate whether Mutz fell asleep or was using a cell phone at the time of the crash, the CHP said.

On Friday afternoon, the victim’s son paid tribute to his father, saying he came to the United States as a teenager with no money and no English skills, then “built this family from the ground up.”

“He worked over 30 years in the vineyards,” the son said. “He never missed a day at work. Those are the values I learned from my dad.”

On Thursday, his father had worked a full day as a manager for a vineyard management company, then had gone on a 50-mile bike ride to Calistoga and back, Alfredo Pedroza said. His father was training for a 100-mile race, he said.

The son said his father had married, bought a home and raised two children in Napa. His father never finished school, but aspired that his children succeed in his adopted country, said Pedroza, who was the first in his family to go to college.

“His focus was on making sure my sister and I had the opportunity to accomplish our goals,” he said.

RIVERSIDE: Safety of crosswalk where woman struck criticized

A Riverside community leader said he has asked the city for years to improve the markings and signage at a crosswalk where a police patrol car fatally struck a woman Sunday.

Isabel Pablo, 57, was taken off life support 12 hours after the 7:49 a.m. collision that happened when she crossed Madison Street at Emerald Street in the Casa Blanca neighborhood.

The officer was seen afterward shaking, his head in his hands.

Police said Pablo was outside the crosswalk.

“We know this from eyewitnesses’ and officers’ accounts,” Assistant Chief Chris Vicino said Monday by telephone.

The crosswalk is made up of connected flat pieces of rock. There are no stripes on either side. Bright-yellow signs on both sides of Madison featuring the pictogram of a pedestrian, as well as signs with arrows pointing to the crosswalk, warn drivers.

Bob Garcia, a member of the Casa Blanca Community Action Group, said in an interview at the scene Monday morning that the city has told him since the mid-1990s that there was no money for additional markings, flashers imbedded in the pavement or to post a stop sign.

Garcia said the city has told him that a traffic study showed no need for improvements.

The crosswalk is in front of St. Anthony’s Church, which Pablo frequently attended.

Garcia added that the opening of the nearby Casa Blanca Library in 2003 increased foot and vehicle traffic in the area, making the crossing more dangerous.

“It has always been an issue because of speed and traffic,” Garcia said.

Angel Gaytan Jr., who lives on Emerald, said he hears and sees vehicles driving too fast through the intersection on Sundays during family gatherings.

City spokeswoman Cindie Perry said no one from the Public Works Department was available Monday to comment.

In a later interview, Garcia said he had a “great” meeting Monday afternoon with Riverside Police Lt. Dan Hoxmeier, City Councilman Paul Davis, Community Police Review Commission Director Frank Hauptmann and CPRC member Robin Jackson. Garcia said afterward that he appreciated being able to address his group’s concerns.

“We must let the community know what happened and how it happened,” Garcia said.

INVESTIGATION UPDATE

The officer was on routine patrol Sunday when the incident happened, Vicino said.

“We are reviewing in detail everything we can with his vehicle,” Vicino said, noting that the car’s onboard computer records, incoming and outgoing messages, audio and video recorders are all being looked at to determine whether anything might have distracted the officer.

The findings of the Police Department’s Major Accident Investigation Team will not be available for at least several days, he said.

Traffic Fatality in North Long Beach

Yesterday morning at approximately 9:14am, officers from the Long Beach Police Department were dispatched to the area of Pacific Coast Highway and Martin Luther King, Jr. Avenue, where a traffic collision occurred that resulted in the death of an adult female.

The preliminary investigation revealed that a tractor-trailer truck was traveling westbound on Pacific Coast Highway, when a Chevy Blazer traveling eastbound attempted to turn northbound onto Martin Luther King, Jr. Avenue. The truck struck the Blazer, and the driver and front seat passenger, who were not wearing seat belts at the time of the collision, were both ejected onto the roadway. The truck then struck the ejected passenger, who was determined to be deceased at the scene. The driver and a second passenger, who was in the rear seat, sustained what appeared to be minor injuries and were transported to a local hospital.

The decedent has been identified as Sonia Esperanza Rodriguez, a 54-year-old Long Beach resident. The 48-year-old driver of the Blazer and 21-year-old passenger are both male residents of Long Beach.
