In most states, if the death of a relative or spouse was caused by the wrongful act of another, surviving family members can file a wrongful death lawsuit against the negligent party or parties.  In order to file a wrongful death claim, you must be able to prove that you will experience severe future emotional and financial hardship because of the loss of the death of a relative, family member or spouse.

A 48-year-old Indio woman died Thursday about two days after a traffic accident that closed the Ortega Highway in the mountains above Lake Elsinore, according to California Highway Patrol investigators and Riverside County coroner’s officials.

Estee Sperrysmith was a passenger in a 1985 American General truck that ran off the highway at 6:30 p.m. Tuesday and rolled about 300 feet down a mountainside near The Lookout Restaurant, roughly two miles west of Grand Avenue in Lake Elsinore.

She died at 8:22 a.m. Thursday at Inland Valley Medical Center in Wildomar.

“The truck is still there,” CHP Officer Rigo Garcia said this morning. “There’s no way (tow truck operators) can get down there.”

The truck was being driven by 45-year-old Edward Stephen Burns of the Perris-area community of Nuevo. He suffered facial fractures and a broken left collarbone and right arm, the CHP reported.
