Beaumont: Driver of pickup who slammed into big rig identified
Authorities today identified a 65-year-old man who was killed when his pickup truck slammed into the back of a big rig on Interstate 10 in Beaumont.
Edward Dodson III of Yucaipa died at the scene of the crash, which occurred around 9:30 Tuesday night on the eastbound 10, near Beaumont Avenue, according to California Highway Patrol Officer Darren Meyer.
He said Dodson apparently failed to see that a semi tractor-trailer was slowing to a stop ahead of him for road construction and plowed into the rear of the rig.
The victim’s 1992 Toyota pickup crumpled on impact, Meyer said.
The driver of the big rig was uninjured.
Cause of the Beaumont Accident
Officers are still Investigating the reasons behind deadly I-10 crash in Beaumont.
Highway and road construction zones make for some of the most dangerous road conditions in California. It seems that major highways and thoroughfares are nearly under construction leaving drivers to deal with improperly marked roads, obstacles and other hazardous conditions. Hundreds of drivers and passenger cars, semi trailer trucks and motorcycles are injured or killed every year in construction zone accidents that could have been prevented.
Dangerous Roadway Conditions
In a construction zone accident, there may be more than one party liable for compensating you for your serious injuries . Road maintenance crews, highway engineers, construction zone traffic controllers and other drivers are often held legally accountable for damages.
Roadway defect claims are complex injury claims and many attorneys are hesitant to handle these cases because of their level of difficulty. An experienced auto accident attorney who has successfully won roadway design and defect cases will know what experts to consult with to determine if the condition of the roadway was actually a factor in the accident.
Demand accountability from those responsible for the dangerous conditions of the construction site accidents. Many times the insurance companies will play “hardball” if you try to settle the case yourself or you have employed a lawyer who does not have the litigation experience to handle such a complex case. We at the Law Offices of Gary A Kessler have twenty years of litigation experience and know how to handle the insurance companies to your advantage. We are prepared to front all costs required for the necessary investigation and expert witnesses needed to prepare your case for trial.

Vancouver man dies in Woodland collision

WOODLAND, Wash. (AP) — The Clark County sheriff’s office says a 76-year-old Vancouver man was killed and three other people were injured in a head-on collision late Tuesday night in Woodland.
Roy E. Thorp, 76, died in the accident. Constance A. Jones, 72, of Vancouver, and Patrick S. Wisniewski, 23, of Woodland, were critically injured and taken to Peace Health Southwest Medical Center.
Sgt. Scott Schanaker said Tyler G. Peabody, 20, of Woodland, was westbound on NW Hayes Road in a 1992 Mustang. He was passing another vehicle on a curve in a no passing zone when he lost control.
The Mustang started to swerve an crossed into the oncoming lane, hitting a 2002 Subaru head-on driven by Thorp. Speed, alcohol and drugs were all factors in the crash, Schanaker.
Cause of the Clark County Accident
The cause of the August 2nd crash remains under investigation by the Washington Highway Patrol. However, based on the limited information provided by AP News, the driver of the Subaru likely could have done nothing to prevent this horrific collision.

The term “wrongful death” is defined as the death of an individual as a result of the negligence, carelessness, intentional act of another individual, corporation, company or entity. Filing a proper wrongful death claim is extremely difficult and complex for families because they are not only dealing with their grief over the death of a beloved family member, but also complex issues of compensation as well. Wrongful death claims are usually sought after by relatives, siblings, or members of the decedent’s estate who have lost a considerable amount of money as well as loss of support and grief due to the wrongful death of the decedent.
In most states, if the death of a relative or spouse was caused by the wrongful act of another, surviving family members can file a wrongful death lawsuit against the negligent party or parties. In order to file a wrongful death claim, you must be able to prove that you will experience severe future emotional and financial hardship because of the loss of the death of a relative, family member or spouse.
Quail Valley student killed in bicycle crash
OAK HILLS • A 12-year-old student from Quail Valley Middle School was killed when he was hit by a vehicle as he was riding his bike with friends over the weekend.
Zachariah Houck of Victorville died Saturday evening when he reportedly rode through a stop sign and was struck by a Lincoln Navigator, according to California Highway Patrol Officer Joaquin Zubieta.
“We’re all numb,” Sarah Houck-Garcia, Houck’s aunt, said Monday. “It’s been tragic for the entire family. He was just a big love bug.”
Houck and several friends were riding their bikes south on Joshua Road near Mesquite Road in Oak Hills a little before 7 p.m., Zubieta said.
“The Lincoln Navigator is traveling west on Mesquite, (Houck) doesn’t stop at the stop sign, the driver tries to avoid him by swerving to the right but couldn’t keep from hitting him,” Zubieta stated.
Houck was knocked off his bicycle and was pronounced dead at the scene, officials said. It was unclear if the boy was wearing a helmet or any other protective gear.
The driver of the Navigator was not arrested.
Students and faculty members at Quail Valley were saddened to learn the news Monday, circulating a flyer around the campus showing the 12-year-old smiling.
“He just started seventh grade on Thursday and my brother had to go turn in his (school) books today,” Houck-Garcia said.
CHP authorities remind people that bicyclists must also follow the rules of the road.
“(Bicyclists) need to remember that traffic laws apply to both bicyclists as well as motorists,” Zubieta said. That includes having a light at night and always having reflectors.
Quail Valley is collecting donations for Houck’s family at the front office including gift cards, money or letters and cards of encouragement, according to Principal Dennis Zimmerman. Anyone wishing to make a donation to Houck’s family can visit the school at 10058 Arrowhead Road in Phelan or make out a check in the name of Zachariah Harrison Houck II and take it to a Wells Fargo branch.
“He was a wonderful boy,” Houck-Garcia said, recalling her nephew. “He was very creative and crafty. He always made birthday cards. He didn’t want to buy one. He would put a picture of you and him on it and made them personal.”
Bicycle Accident Personal Injury Liability
The CHP will surely look at speed and other factors to determine why this accident occurred, and whether the driver of the pickup truck could have done anything to avoid the collision. While this accident remains under investigation, the parents of the young boy injured in this collision would be well-advised to speak with an experienced and knowledgeable bicycle accident lawyer. An attorney who understands the unique legal issues of car vs. bicycle accidents can review the CHP report and determine who is responsible for this collision. If the driver of the vehicle is determined to be responsible, he may be liable for the young victim’s medical care expenses, pain and suffering, and other damages.
Bicycles have as much right to be on the road as other vehicles. When automobile drivers violate the rights of a bicyclist, serious injuries and death can occur.
When you suffer serious/traumatic injuries or a loved one’s death, you are entitled to compensation (medical bills, funeral costs, lost wages, future wages and pain and suffering). The Law Offices of Gary A Kessler will aggressively represent you and fight for your rights against the insurance companies for the monetary damages you deserve.

Site of I-15 chain crash notorious for backups

A commuter bus slammed into backed-up traffic Wednesday morning in Temecula on a stretch of highway notorious for congestion and a high rate of accidents.
The five-vehicle, chain reaction crash on southbound Interstate 15 sent seven people to local hospitals, including the driver of the Riverside Transit Agency bus, whose right leg was almost completely severed, California Highway Patrol Officer Nathan Baer said.
About 7:50 a.m., the bus carrying five passengers rammed into the back of a white box truck that was stopped at the end of a line of cars waiting to exit the freeway at Winchester Road. The bus driver, whose injuries were potentially life-threatening, apparently didn’t notice that the vehicles in front of him were stopped, Baer said.
Throughout each day, traffic backs up onto the southbound freeway from the heavily used Winchester Road off-ramp, leaving drivers to idle precariously in the right-hand lane. A $200-million road project aimed at alleviating the congestion has been in the works for 12 years.
Temecula and the rest of southwest Riverside County have grown exponentially over the past 20 years, and traffic on its freeways and interchanges have, too. The Winchester Road interchange, a gateway to The Promenade mall and the rest of Temecula’s retail core, is one of the busiest.
The southbound freeway around Winchester Road had a rate of collisions more than 50 percent higher than the state average, according to a 2009 study done by Temecula and Caltrans in preparation for the project. The study looked at crashes from 2002 to 2004.
Most of the accidents occurred during weekdays in good driving conditions, and most were rear-end collisions, the study found.

Rush-hour mess
The bus that authorities said started the crash was traveling on RTA Route 208, an express commuter line heading from downtown Riverside to the mall. The route is operated for RTA by an outside contractor, Empire Transportation of Bellflower. The driver, whose identity was not released, is an employee of that company.
An Empire representative declined to comment on the crash, referring questions to RTA.
Passengers estimated the bus was going about 55 mph when it crashed, though CHP officers couldn’t immediately confirm that.
Baer said officers continue to investigate but there was no indication drugs or alcohol played a role. RTA officials said in a statement they were working with the CHP to review camera footage taken from the bus.
The impact from the bus forced the box truck into a Nissan pickup and off the side of the road. The pickup was sent forward into an SUV, which hit another SUV in front of it.
The driver of the box truck walked away from the crash without significant injuries, despite his truck ending up on its side.
The bus careened off the box truck, across four lanes of traffic into the concrete center divider. The front of the red-and-white bus was shorn off.
All five bus passengers were taken to local hospitals with minor to moderate injuries, Baer said. The driver of the pickup, which was totaled, was treated at a hospital with cuts to his face.
The crash and resulting cleanup reduced the freeway to two lanes for several hours, causing a massive traffic headache for morning commuters. Southbound traffic backed up for miles, as far north as Lake Elsinore on I-15 and into Menifee on Interstate 215, according to drivers and the CHP.

Demand accountability from those responsible for the bus accidents. A bus driver is a “common carrier” who owes you the “highest duty of care!” Many times the insurance companies for the bus companies (i.e., many times they are “self insured”) will play “hardball” if you try to settle the case yourself or you have employed a lawyer who does not have the litigation experience to handle such a complex bus case. We at the Law Offices of Gary A Kessler have twenty years of litigation experience and know how to handle the insurance companies to your advantage. Remember, cases against the governmental bus companies RTA (bus), Caltrans, BART (bus) or Muni Bus System have a very short time to file the proper government claim which must be filed first, way before the actual lawsuit is filed! Thousand Oaks man reportedly killed in Santa Barbara showgrounds accident

A Thousand Oaks man reportedly was killed Monday in Santa Barbara as he dismantled equipment used during a rodeo at the Earl Warren Showgrounds last weekend, a Santa Barbara County Fire Department spokesman said.
A 1,500-pound monitor fell on the man around 1 p.m. When firefighters arrived, they found workers had moved the screen off the man, who was unconscious and not breathing, said Brian Hayden, an engineer and inspector with the Santa Barbara County Fire Department.
“CPR was performed on him on the way to Cottage Hospital, which is just the short distance away,” Hayden said.
The man’s identity could not be confirmed, but he reportedly was a Thousand Oaks business owner.
Cause of the Showgrounds Accident
The accident that occurred on August 8th remains under investigation by authorities. However, based on the limited information provided by KSBY and KYET, it is unclear why the 1500lb. Jumbotron LED screen fell on Mann. Hopefully authorities can come to a conclusion of what happened and why.
Fault and Wrongful Death Liability
Accidents such this one have unique and complex issues. The general contractor, and all subcontractors at the site where the Jumbo Screen was being installed, have a duty to make the working environment as safe as possible. If for any reason a party was negligent in maintaining a safe work area, they will be held liable for all injuries or fatalities that occur. Therefore, family members of the victim are well advised to seek an experienced California wrongful death attorney. A knowledgeable attorney who has the experience in these particular accidents can hire a private investigator to take photographs, interview witnesses and gather evidence to determine fault. The attorney can also protect the families legal rights and possibly receive compensation for funeral/burial expenses, lost wages, pain and suffering, and other damages relating to this horrific tragedy.

3 women killed, 2 hurt in fiery crash ID’d

BUENA PARK – The three women who were killed and the two others who were seriously injured in an I-5 crash Monday night were returning from a church service at Crystal Cathedral, the California Highway Patrol said.
Pronounced dead at the scene were Sara Flores, 40; Angela Prado, 49; and Elda Nava-Mayo, 24, according to the coroner’s office. They were all from Downey.
The driver, identified by the CHP as Ruth NavaTorres, and a 16-year-old passenger, both from Downey, were taken to UCI Medical Center with major injuries, the CHP said. Conflicting reports have been released regarding the age of the driver.
It appears the women were related, the CHP said.
The crash occurred at about 10:15 p.m. when the driver of the Ford Excursion, traveling at a high rate of speed, lost control of the vehicle on northbound I-5 toward Beach Boulevard, the CHP said.
The Excursion hit a guard rail, rolled over multiple times and wound up on its side just west of the Auto Center Drive on-ramp to northbound I-5, the CHP said.
CHP officer Ray Payton said the initial investigation suggests the women did not wear their seatbelts. Alcohol is not believed to be a factor in the crash, Payton said.
Initial reports indicate that Buena Park police arrived shortly after 10:19 p.m.
Patricia Espinoza, 21, a Good Samaritan, said she was at the scene before emergency crews or officers arrived. With the help of another man, she helped pull the driver out of the burning vehicle. She said the other women inside the vehicle had been ejected.
Espinoza added that another man helped her pull the 16-year-old girl away from the smoldering vehicle. She was lying on the ground, close to the vehicle, Espinoza said.
Buena Park police Sgt. William Kohanek said officers noticed that two of the victims were out of the vehicle, but appeared to be dangerously close to the flames and chose to pull them to a safer distance, Kohanek said.
Once they assessed their injuries, officers realized the victims were already dead.
The other woman inside the vehicle was ejected further away from the vehicle, Espinoza said

Fiesta Island Boat Accident Leaves Young Girl Seriously Injured
6-year-old Neve Walker was struck in a San Diego boat collision that occurred on August 6, 2011, around 3:30 p.m. near Fiesta Island. According to the girl’s father, the child was riding on an inner tube along with her 10-year-old brother when a motorboat came from behind and veered into their path.
The little girl was knocked off the inner tube and ran over by the boat. She was taken to Rady Children’s Hospital for treatment, where she was diagnosed with fractured ribs, a partially collapsed lung and bruises, and cuts over her body.

Cause of the boating accident
Although the official cause of the accident has not been released, police are investigating why the boat operator ran directly into the path of the children.
Based on this news report by News 10, it appears that the boat driver was operating his watercraft recklessly and will be held liable for the young child’s injuries. The operator steered his boat too close to the children, a violation of boat safety regulations.
Boating Accident Personal Injury Liability
The most common boating accidents are collisions with other boats, sinkings, capsizings and boat disappearances.
Boating accidents occur very quickly and in many different places. Lakes, canals, rivers, intercoastal waterways and oceans are where tragedies normally occur. Last year in California, there were 744 boating accidents involving 439 injuries and 44 fatalities.
According to the United States Coast Guard each year there are more than 8,000 boating accidents in the U.S. that result in 4,000 serious injuries and 800 deaths.
Many times a boater will have been speeding or may have had too much alcohol.
There are specific boating laws that must be followed or fatalities can occur. The Law Offices of Gary A Kessler is familiar with the different state’s boating laws. We know the boating liability issues and will inform you of your true state, local and Federal boating rights and legal options which will result in successful outcome in your case.
It is a general rule of law that the operator of a boat and its owner has a duty to exercise a reasonable degree of care in order to prevent injuries to others. The most common boating accidents are collisions with other boats, sinking and boat disappearance. Boating injuries usually occur because of a reckless or careless operator, alcohol, boat malfunctions or an inexperienced boating (captain) operator.
Operators of boats have a legal obligation to operate their watercraft in a safe and prudent manner. The overwhelming majority of boating accidents are caused by factors that can be controlled by the operator of the boat. The primary cause of boating accidents nationwide was operator inattention, followed by careless/reckless operation, operator inexperience, operating at an unsafe speed, and failure to have a proper lookout.
Common violations of the duty of ordinary care in a maritime setting include a failure to warn against foreseeable harm, violations of “rules of the water,” such as excessive speed, failure to have proper lights, failure to yield, intoxication and others. Owners may also be held liable under the theory of vicarious liability. For example, an owner may be held liable for an operator’s failure to warn passengers of intended maneuvers, overloading the boat or permitting the guest to sit in a dangerous position.
Accidents involving bystanders, such as swimmers or water skiers, are typically treated in the same manner as cases involving social guests. The law and courts where the accident occured will generally control any lawsuits brought by injured bystanders unless the defendant boat owner asserts admiralty jurisdiction.
The laws regarding boating accident (drowning) cases are complex and include many facets of the law. It is vital to surviving family members to seek the advice of an experienced boating fatality lawyer such as Gary A Kessler at the Law Offices of Gary A Kessler to protect your rights and those of your loved ones.

7-year-old boy killed while bicycling near grocery store in North Redondo Beach

A 7-year-old boy was killed Friday morning as he bicycled near the Albertson’s grocery store on Artesia Boulevard in North Redondo Beach. A truck making a delivery accidentally ran over the boy near the store’s loading bay.
According to police reports, at about 10:28 a.m. an Albertsons truck was backing into the bay when the driver sensed something wrong. Redondo Beach Police Department Sgt. Shawn Freeman said that the driver stopped his vehicle and jumped out to take a look when he discovered the boy and his bicycle pinned under the truck.
“He thought, ‘You know, something is not quite right,’” Freeman said. “He gets out to look and unfortunately discovers this 7-year-old boy under the truck.”
A 911 call was made immediately and paramedics quickly transported the boy to a local hospital, where he succumbed to his injuries. No charges have been made and police are investigating the matter as an accident.
“It’s a horrible, tragic accident for the family, for that truck driver, for the store, and for everyone around that neighborhood,” Freeman said. “Especially the family, obviously – this poor family is going to have to deal with the loss of a 7-year-old boy.”
The loading bay is located on the north side of the store, near the surrounding residential neighborhood.
Police did not release the boy’s name. Neighbors who appeared on televised reports identified him as Jeremy Perez and said his mother was a newly hired employee at Albertsons. According to neighbors, the family lived nearby and the boy — in the care of a babysitter — was going to visit his mother at work.
“He was my nephew, a very outgoing, full of life little boy,” wrote David Lopez, the boy’s uncle, on a Facebook posting on the NBC Los Angeles website. “I will miss him so much…my family has suffered four deaths this year.”
Investigators are conducting an independent review to determine exactly how the accident happened.
Too many lawyers rush to simplistic results only looking at the barebones insurance policy of the Defendant truck driver. The Law Offices of Gary A Kessler will consult with you about all of the potential defendants (i.e., truck driver, the contracting party for the load being delivered, the party who loaded the truck, owner of the trucking firm, etc.), whether the roadway created “dangerous conditions” for the driver involved, were there steering and/or brake failure, did the restraint system operate free of defect, did the fuel tank fire cause the majority of injuries, etc..
Demand accountability from the trucking company. We at the Law Offices of Gary A Kessler have handled complex trucking accident cases for twenty years. We have the litigation experience to handle complex trucking liability cases. We are prepared to front all costs required for the necessary investigation and expert witnesses needed to prepare your case for trial. Santa Rosa Man Killed in Highway 128 Tanker Crash
Eighteen hours after a fatal collision closed Highway 128, the road between Cloverdale and Boonville has been opened to one-way traffic.
The limited access is expected to remain in place at least three days and could be up to two weeks, according to highway officials.
A 23-year-old Santa Rosa man driving a 2005 Toyota Camry was killed when a westbound tanker truck filled with a load of gasoline went out of control and crossed into oncoming traffic at about 8 p.m. About 4,000 gallons of fuel spilled onto the road.
The identity of the man has not be released pending notification of his family. An autopsy is scheduled today.
Terry Wood, 56, of Santa Rosa was driving a 2007 Peterbilt truck filled with gas when he lost control and the trailer overturned, said CHP spokesman Randy England.
The truck is owned by Redwood Transportation of Santa Rosa, according to CHP.
The trailer collided with the Camry which was traveling east on Highway 128.
Hazmat and environmental health officials responded to the scene and Wednesday morning officials were still trying to determine the extent of the damage to the roadway, England said.
Alternate routes include Highway 253 near Boonville and Mountain House Road at Hopland.
