Wheelchair pedestrian killed in Costa Mesa accident

COSTA MESA (CBS) — A 40 year-old man pushing an empty wheelchair across the street outside the crosswalk was fatally struck by a motorist in Costa Mesa Friday, a police lieutenant said.

Gary De La Rosa was struck about 5 a.m. in the 2000 block of Harbor Boulevard by a gray 2004 Jaguar X-J8 driven southbound by a 49-year-old woman.

De La Rosa was walking across Harbor Boulevard, south of Bay Street, said Costa Mesa police Lt. Bryan Glass.

De La Rosa was pronounced dead at the scene.

The motorist was questioned by police. It was not immediately known if she was cited.

Costa Mesa Police Department traffic investigators asked anyone who saw the crash to call them at (714) 754-5264.

UPDATE: Girls killed in Fontana crash were sisters

Two girls who were among four people killed early Sunday in a single-car collision in Fontana were sisters, Fontana police confirmed this afternoon.

Raquel Garcia, 18, and Rebecca Garcia, 16, both of Fontana, died in the fiery crash that happened just after 1 a.m. on Foothill Boulevard at Lime Avenue, Fontana police Sgt. Billy Green said today by telephone.

Also killed in the crash were Javier T. Contreras, 18, who was driving, and Pedro Rivera, 18. All the 18-year-olds graduated by Fontana’s A.B. Miller High School in June, Green said. Rebecca was a student at Miller.

Contreras was at the wheel of a Chrysler Sebring that witnesses said was traveling in excess of the posted 45 mph speed limit, Green said. Investigators have yet to determine exactly how fast the car was going.

The car slammed into a concrete support for a railroad trestle that passes above the roadway, bursting into flames, he said.

Contreras and Rebecca Garcia died at the scene, the San Bernardino County coroner’s office said. Rivera died in the emergency room at Kaiser Permante Fontana Medical Center and Raquel Garcia was pronounced dead in the ER at Arrowhead Regional Medical Center in Colton.

Green said final results of the investigation into the crash will not be available for at least a month and perhaps two.

The condition of the bodies was such that toxicology tests will be difficult, he said. The usual blood tests might not be possible, so tissue samples will have to be tested “and there’s only one lab in San Diego that does that.”

Green said the family has requested privacy and is not talking to the media.

Fatal collision mars charity Love Ride

A well-known motorcycle charity event that raises money for children’s causes was marred Sunday by the death of two people, who were killed in a collision with a truck on the Golden State (5) Freeway.

The incident occurred along the 30-minute route of the annual Love Ride, a motorcycle event that began in Glendale, traversed part of the 5 Freeway, and ended at Lake Castaic in Santa Clarita.

A male motorcyclist and his female passenger died after hitting a big-rig truck on the northbound Golden State Freeway at Branford Street near Pacoima.

The two, believed to be in their 40s, were pronounced dead at the scene, according to California Highway Patrol Officer Ed Jacobs.

The fatal crash occurred whenthe couple encountered a patch of traffic snarled by another accident on the freeway, Jacobs said.

That accident – in which a motorcyclist was injured in a crash – was witnessed by City Councilman Mitch Englander and his wife, Jayne.

Englander, who was riding his Harley-Davidson in the event next to comedian Jay Leno, said he laid flares down around the motorcyclist and waited for paramedics. “To see someone injured like that, we were very shaken up,” Englander said.

The injured man was transported to Providence Holy Cross Medical Center in Mission Hills and was accompanied by Leno, Englander said. His condition wasn’t immediately known.

The string of accidents cast a pall on the otherwise festive event, one that saw thousands of motorcyclists crowd into a cordoned-off San Fernando Road early Sunday morning to line up their bikes in anticipation of the ride.

Amid the rumbling of motorcycle engines, local rock band Max Mueller played, while enthusiastic riders compared bikes.

“I like this event because it’s one of the loudest events in Glendale,” Glendale Mayor Laura Friedman told the crowd, to a roar of approval.

At the end of the event in Lake Castaic, country duo Montgomery Gentry entertained the raucous group.

Founded in 1984 by Oliver Shokouh, owner of Glendale Harley-Davidson, the Love Ride is one of Southern California’s largest motorcycle gatherings. This year’s ride returned to Castaic Lake for the first time since 2006. Funds raised benefited Autism Speaks, a New York-based autism research and advocacy group.

About 2,000 bikers registered for this year’s event, according to organizers, who said the poor economy had flattened attendance.

At its height, Love Ride saw more than 20,000 riders flood the area. Two years ago, the event was canceled due to a drop in attendance.

And the economy is still hurting participation in the event, which charges a $65 entry fee, said Emily Vindeni, Shokouh’s daughter.

“Times are still hard for people,” said Vindeni, one of the organizers of the event. “It’s been hard to get the word out that it’s back.”

Bob Carrara, a Chatsworth resident and member of the Boozefighters club, a Los Angeles motorcycle club, agreed the crowds were smaller than in years past, but said that didn’t diminish enjoyment of the event.

“It’s nice to see people you haven’t seen in a while,” he said.

Still, moments before the race, numerous riders talked about the risks of taking part in the Love Ride.

The number of motorcyclists flooding the freeway can overwhelm nearby motorists, while not all bikers are trained to ride on major roadways, said

Paul Alfonso, a Northridge resident.

“There’s too many bikes,” said Alfonso. “It’s the most dangerous thing I do.”

“It’s scary,” agreed Carrara. “This many bikes, you get a lot of newbies.”

Accidents during the Love Ride are a common occurrence, CHP Officer Jacobs said. But he couldn’t immediately recall the last time a fatality occurred to either an event participant or a passer-by.

Divers search for recording device in fatal jet ski crash

Divers planned to spend Monday plumbing the Puddingstone Reservoir in San Dimas for a recording device that may have information about a crash between a motor boat and a jet ski that killed three women.

Deputies assigned to the Sheriff’s Special Enforcement Bureau-Emergency Services Detail as divers, along with Los Angeles County Lifeguard divers, are searching the water for a recording device
that was mounted to the women’s watercraft.

The boat and watercraft collided Saturday afternoon in the reservoir, located in Frank G. Bonelli Regional Park.

The women who died were all on the jet ski. They were identified by coroner’s officials as Mari-Con Abello, 34, of Escondido; her mother, Aurora Yeso, 59, of San Dimas; and Anesia Barba Bautista, 59, of Glendora.

They were pronounced dead at the scene. The four occupants of the motorboat were treated for injuries at hospitals and released.

Authorities have said the powerboat driver was not intoxicated. It was unclear whether the women who died had been drinking.

Napa coach pleads no contest to sex offenses with teen

A coach for two Napa girls’ softball teams pleaded no contest Thursday to sexual offenses against a 16-year-old team member earlier this year.

Christa Tharp, 34, of Napa, pleaded no contest to felony charges of oral copulation and sexual penetration with a foreign object on a person under age 18 and two misdemeanor charges of child molestation, her attorney Beverly Saxon Leonard said this morning.

Tharp faces up to eight years in state prison when she is sentenced Nov. 10, Saxon Leonard said.

“We will seek local jail time,” she said.

Tharp was a volunteer coach for the Napa High School girls’ softball team and a coach for the Napa Valley Express girls’ team, Saxon Leonard said. The victim was on both teams.

Tharp and the girl developed a relationship and became good friends, and although the sexual conduct between March and July was consensual, it was illegal, Saxon Leonard said.

It began after Tharp separated from her husband and moved in with the 16-year-old girl’s family, Saxon Leonard said.

The sexual relationship came to light when the parents of other girls on the team notified authorities of their suspicions about the “unusual” relationship between player and coach, Saxon Leonard said.

Police were informed about the relationship on July 11 and Tharp was arrested on four felony charges on July 22.

Tharp was released from jail but was taken into custody again when she violated a civil

restraining order against her by meeting with the girl three times, Saxon Leonard said.

 

Several misdemeanor charges of contributing to the delinquency of a minor and contempt of court were then added to the complaint, she said.

Napa County Superior Court Judge Mark Boessenecker will dismiss those charges and two felony charges at sentencing, Saxon Leonard said.

Tharp pleaded no contest on the day of her scheduled preliminary hearing and remains in custody.

Disneyland employee killed while bicycling home

ANAHEIM – A vehicle fatally struck a woman, identified as a Disneyland employee, while she was riding her bicycle home from work early Thursday morning.

Police later identified the victim as Margaret Conway, 21, from Anaheim

Anaheim police received a call regarding a traffic collision between a vehicle and a bicyclist on Ball Road and the I-5 at 12:30 a.m., said Sgt. Bob Dunn of the Anaheim Police Department.

Dunn said the woman was riding her bicycle eastbound on Ball Road in the No. 1 lane and was crossing the I-5 over pass when a white Ford sport utility vehicle struck her from behind.

The woman was pronounced dead at a nearby trauma center, Dunn added.

The driver of the sport utility vehicle remained at the scene and at this point alcohol does not appear to be a factor in the collision, Dunn said.

Thursday morning, Disneyland officials released a statement about the fatal collision.

“I join with all of our cast members as we mourn the loss of one of our own,” said George A. Kalogridis, president of the Disneyland Resort.

“Our thoughts are with her family, friends and co-workers after this tragic accident.”

Woman killed in suspected teen DUI crash ID’d

 

ANAHEIM – Authorities identified Friday one of two women struck and killed by a teen-age boy suspected of driving while intoxicated over the weekend.

Carol Shea, 66, died Saturday due to multiple traumatic injuries, Supervising Deputy Coroner Larry Esslinger said. Earlier this week, authorities identified the other woman as 56-year-old Hengameh Saghafi. She also died as a result of multiple traumatic injuries.   

The fatal accident happened shortly after 4 a.m. Saturday in the 1600 block of Harbor Boulevard near Disneyland.

The investigation revealed the women, who were both homeless, were walking in a crosswalk on the east side of Harbor Boulevard when they were struck by a Chevrolet Astro van traveling southbound on Harbor, Anaheim police Sgt. Rick Martinez said, adding that the van struck the center divider.

One of the women was thrown a “considerable distance” and came to rest in the southbound lanes of traffic. The other woman came to rest in the left-turn lane of the northbound lanes, he said.

The possessions the women were carrying were scattered all over the street.

A witness told police that there were more people in the van, but when police arrived, they found only a 17-year-old Santa Ana boy who told them he was the driver, Martinez said.

The driver was arrested and booked at Orange County Juvenile Hall on suspicion of driving under the influence of alcohol or drugs, causing a collision and vehicular manslaughter while intoxicated, Martinez said.

The investigation is continuing.

Update: Charles sought against 2 in Mass. pool death probe

 

BOSTON — A prosecutor said Monday he would seek criminal complaints against a current and a former state manager for allowing a murky public swimming pool to remain open for two days while the body of a woman who drowned lay unnoticed at the bottom of it.

 

Bristol District Attorney Samuel Sutter cited what he called a “systemic failure” in the operation of the pool in Fall River, 50 miles south of Boston.

 

Sutter said Brian Shanahan, regional director of the Department of Conservation and Recreation, and Jeff Carter, the department’s SouthCoast district manager, wouldn’t be charged in connection with the death of Marie Joseph, a Newport, R.I., hotel housekeeper from Haiti. But he said state police would seek complaints from a court charging Shanahan and Carter with reckless endangerment of a child for allowing swimmers — including children — to use the pool when it should have been closed because the water was too cloudy.

 

The prosecutor’s announcement followed a more than three-month investigation by the district attorney into the June 26 accidental drowning of Joseph at the Vietnam Veterans Memorial Pool.

 

“A series of poor decisions, with errors compounding errors, a disregard for regulatory requirements and a disregard for the proper standard for operating the pool pervaded multiple levels of DCR supervision and management,” Sutter wrote in a 20-page report.

 

He said the investigation revealed “a repeated willingness to diminish minimum safety standards by re-interpreting the applicable regulation and substituting self-generated standards.”

 

The prosecutor said witnesses told investigators that Carter, the district manager, had told pool employees that he wanted to save money by not chlorinating and filtering the pool well before June 25, the day the pool was scheduled to open for the season. The decision resulted in the buildup of algae in the pool, the report said.

 

The staff was told by the district manager not to begin chlorinating and filtering the pool until June 22, but he later agreed to move the process up a couple of days after a maintenance supervisor complained about “pea-soup green” water in the pool, the investigation found.

 

When interviewed by investigators, Carter acknowledged telling staff not to chlorinate or filter the water, but he denied that the decision was made to save money, Sutter said.

 

In a statement, DCR Commissioner Edward Lambert said the agency was reviewing the report and would use the prosecutor’s findings when crafting future safety measures. He said DCR had already ordered a number of changes after the drowning, including enhancement of “pool safety protocols regarding water clarity.”

 

Lambert said he requested and received Shanahan’s resignation following the discovery of the woman’s body, while Carter was placed on leave.

 

Phone numbers for Shanahan and Carter could not immediately be located Monday, and it was unknown if they had hired attorneys.

 

Investigators have said Joseph, a mother of five, drowned after going down a water slide in the pool’s deep end.

 

A review of surveillance video showed that Joseph surfaced briefly after going down the slide, bumped into a child and then went under with no signs of a struggle. Her body was discovered on the evening of June 28 after it floated to the surface.

 

State investigators previously said that the pool should not have opened on the day Joseph drowned because the water was too murky and that the water clarity also prevented lifeguards from being alerted to the drowning and from noticing the body at the bottom of the pool.

 

Sutter, who said Joseph apparently was unable to swim, ruled the death unintentional.

 

The pool was drained after the body was discovered and did not reopen during the summer.

 

Sutter said one day after the discovery of the body, state police divers went to the bottom of the pool and found considerable debris, including hair and hair ribbons, jewelry, coins, leaves and dirt. Staff later told investigators that the pool was never vacuumed before opening for the season because the available vacuum wasn’t working.

 

The district attorney’s probe appeared to exonerate lifeguards at the pool of any wrongdoing in connection with Joseph’s death.

 

The 9-year-old boy who Joseph bumped into after going down the slide told police that he had informed two lifeguards that Joseph had gone under and that the guards didn’t take action. But Sutter said the surveillance video didn’t corroborate the boy’s story.

 

 


Two People Injured in Highway 41 Big Rig Crash in Madera County

MADERA COUNTY,Calif.(KFSN) — Two people are recovering in the hospital after a big rig accident inMaderaCounty.

The crash happened on Highway 41 near Avenue 14 early Monday morning.

The California Highway Patrol says a big rig going northbound on Highway 41 tried to make a u-turn when the driver missed his exit.

The CHP says the big rig pulled out in front of on-coming traffic and the driver of a van wasn’t able to stop in time.

The two people inside the van were taken to the hospital. Their conditions have not been released.

The accident temporarily blocked a portion on Highway 41, but all lanes were back open by midday.

Cause of the Madera County Accident

Although the CHP is continuing to investigate the cause of the collision, based on the information reported, it appears that the driver of the big-rig may be responsible for this accident. The law pertaining to left turns is found in California Vehicle Code Section 21801: “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.

Man seriously hurt after being hit by van

SANTA ANA – A 41-year-old man was seriously injured after being struck by a vehicle Friday morning while crossing a Santa Ana intersection, police said.

The incident happened about 6:15 a.m. when the man was walking across McFadden Avenue and Bristol Street and was struck by a Ford van, Santa Ana police Cmdr. Jeff Owens said.

The man sustained serious head trauma and was taken to a hospital, he said.

The 45-year-old driver remained on the scene and was cooperating with the investigation, Owens said

Traffic investigators were at the scene trying to piece together what happened.
