Boat explodes off Huntington Beach; 8 hurt

HUNTINGTON BEACH, Calif. (KABC) — A 24-foot power boat exploded off the coast of Huntington Beach on Saturday, injuring eight people.
Authorities said the 2003 Monterey launched just before noon at the Sunset Beach Harbor and minutes later it exploded about 200 yards out. Fire officials said it might have been caused by a fuel leak.
At least four of the nine people on board were thrown into the water.
“There were some burns, there were some contusions and cuts,” said Sgt. Jeff Foster of the Orange County Sheriff’s Harbor Patrol. “We understand that there were also some bones that were fractured and there’s at least one person that we know of right now that’s in surgery for damage to his leg.”
Paramedics transported eight patients, four of them taken to trauma centers. Their ages ranged from 14 to 60, Foster said.
Authorities said there was a mechanical problem and the people on board were trying to fix it when it exploded.
Other boaters heard what they described as a sonic boom and saw flames.
Retired Harbor Patrol reserve officer Tom Cantwell called for help and steered his boat toward the wreckage. He said the victims were not wearing life jackets.
“The boat was fully engulfed in flames,” he said.
The fire on the boat was extinguished and measures were taken to prevent the spread of any hazardous materials, but the wreckage remains in the water as officials work to retrieve it, Foster said.
Boating Accident Personal Injury Liability
The most common boating accidents are collisions with other boats, sinkings, capsizings and boat disappearances.
Boating accidents occur very quickly and in many different places. Lakes, canals, rivers, intercoastal waterways and oceans are where tragedies normally occur. Last year in California, there were 744 boating accidents involving 439 injuries and 44 fatalities.
According to the United States Coast Guard each year there are more than 8,000 boating accidents in the U.S. that result in 4,000 serious injuries and 800 deaths.
Many times a boater will have been speeding or may have had too much alcohol.
There are specific boating laws that must be followed or fatalities can occur. The Law Offices of Gary A Kessler is familiar with the different state’s boating laws. We know the boating liability issues and will inform you of your true state, local and Federal boating rights and legal options which will result in successful outcome in your case.
It is a general rule of law that the operator of a boat and its owner has a duty to exercise a reasonable degree of care in order to prevent injuries to others. The most common boating accidents are collisions with other boats, sinking and boat disappearance. Boating injuries usually occur because of a reckless or careless operator, alcohol, boat malfunctions or an inexperienced boating (captain) operator.
Operators of boats have a legal obligation to operate their watercraft in a safe and prudent manner. The overwhelming majority of boating accidents are caused by factors that can be controlled by the operator of the boat. The primary cause of boating accidents nationwide was operator inattention, followed by careless/reckless operation, operator inexperience, operating at an unsafe speed, and failure to have a proper lookout.
Common violations of the duty of ordinary care in a maritime setting include a failure to warn against foreseeable harm, violations of “rules of the water,” such as excessive speed, failure to have proper lights, failure to yield, intoxication and others. Owners may also be held liable under the theory of vicarious liability. For example, an owner may be held liable for an operator’s failure to warn passengers of intended maneuvers, overloading the boat or permitting the guest to sit in a dangerous position.
Accidents involving bystanders, such as swimmers or water skiers, are typically treated in the same manner as cases involving social guests. The law and courts where the accident occured will generally control any lawsuits brought by injured bystanders unless the defendant boat owner asserts admiralty jurisdiction.
The laws regarding boating accident (drowning) cases are complex and include many facets of the law. It is vital to surviving family members to seek the advice of an experienced boating fatality lawyer such as Gary A Kessler at the Law Offices of Gary A Kessler to protect your rights and those of your loved ones.

Lake Elsinore Travel Inn Death Ruled Drowning
The investigation into a Murrieta woman who was found dead in the Lake Elsinore Travel Inn swimming pool on Thanksgiving continues, but authorities are releasing few details.
Nicole Lambert, 26, was found dead in the lodge’s swimming pool around 11:55 a.m. on November 24, 2011.
Today, Cpl. Courtney Donowho, spokeswoman with the Riverside County Sheriff’s Department, said “the cause of death is drowning, but there is no further information available at this time.”
It is unclear how Lambert Cruz drowned and who found her; motel staff are referring reporters calls to police.
According to the deceased’s mother, Lambert Cruz was living with her grandfather in Murrieta when she went missing November 19. “She left for a walk and never came back,” said Donna Lambert.
Details from the autopsy and toxicology reports have not been made available.
The Lambert family had been in the media spotlight prior to Thanksgiving for their staunch support of the medical marijuana movement.
Donna Lambert’s elderly father Don, who Nicole lived with, had been a fixture at Murrieta City Hall where he regularly advocated on behalf of medical marijuana patients. Don took up the cause after his daughter Donna was arrested in 2009 for marijuana possession in San Diego County.
Her case garnered significant media attention. She was accused of providing cannabis to an undercover police detective who posed as a medical marijuana patient. The sting was part of a larger investigation dubbed Operation Green Rx spearheaded by San Diego District Attorney Bonnie Dumanis.
In 2010, however, felony charges against Donna Lambert were dismissed.
The Law Offices of Gary A Kessler has successfully represented numerous families and individuals that have suffered serious injuries and deaths from swimming pools, association pools, jacuzzis, spas/ hot tubs, water parks and whirlpool bathtubs.
Many swimming pool drownings occur due to:
- Negligently designed and misconstructed pools;
- Pools not having adequate safety fences around their pools;
- The pool was so filthy that you could not see the bottom of the pool (where the child fell in and drowned) or the child at the bottom of the pool;
- Door lock mechanism malfunction from a state of disrepair on a sliding door to the house;
- The patio/ entry was too easily accessible to a child from inside the house;
- Screen door frames bent outward causing latch mechanisms to be out of alignment, defective and useless;
- Inadequate fences or improperly installed fences;
- Failure to install child safety locks on doors, screens, or fences;
- Dangerously defective pool covers which could not support a child’s weight;
- Negligent Supervision;
- Poor or improper maintenance of the pool and surrounding area;
- Too few lifeguards;
- Lifeguards not paying attention to swimmers or children in the pool area;
Pool Association & Hotel/Motel Drownings
Defendant pool associations and Hotel/Motel pool drowning cases usually occur because the defendant commercial pool owner:
- (1) Failed to hire experienced lifeguards
- (2) Failed to hire enough lifeguards
- (3) Negligent supervision of the swimmers by lifeguards
- (4) Lack of warning signs
- (5) Water rockslide pools do not providing proper rails or steps
- (6) Surfaces are not “non-skid” surfaces
- (7) Failure to mark the water depth so the unsuspecting swimmers will not know the accurate depth of the pool
- (8) Hidden danger of a commercial pool
- (9) Inadequate indicators of the pool’s depth
- (10) Murky water, making it difficult, if not nearly impossible, to see children in the deep end
- (11) Failure to repair the water pump system, keeping the pool properly clean
If you or a loved one is involved in a swimming pool drowning accident/death:

Fresno girl, 13, killed while crossing Highway 180 on foot

FRESNO, Calif. (KFSN) — A 13 year old girl who died after trying to cross a freeway Tuesday is being remembered as a bright student who loved to help others. Angel Perez died Tuesday night after being hit by a car on Highway 180 at the 168 interchange, near the Cedar overpass.
Like many teenagers, Perez was looking forward to this week’s release of Twilight. Now, her family members are trying to understand why such a bright student would try to cross 12 lanes of traffic. “She was always smiling, no matter what. She was athletic, she got good grades,” said Angel’s sister, Ashley Rojas.
According to the California Highway Patrol, Perez and two friends were walking north on Cedar when they approached the overpass. For some reason, Perez decided to try to cross the freeway instead of using the sidewalk. She only made it across one lane before she was hit and killed.
Perez was an eighth grader at Kings Canyon Middle School, where she held a 3.8 GPA. Her algebra teacher called her one of his best students. “She was a real leader. The kids would look up to her. Whenever they were having trouble with a problem, they could go to Angel and she would help them with a smile on her face,” said teacher Charles Rogers. Rogers couldn’t understand why such a level headed and bright student would have decided to cross the freeway.
Wednesday, Perez’s desk sat empty during 4th period. Back at the freeway overpass, friends left flowers to pay their respects. Instead of preparing for the holidays, her family members are now planning a funeral. “I just bought her a new phone and we went to get stuff for Christmas, a games and a radio, things she wanted. We were going to set the tree up right after Thanksgiving,” said Betty Padilla, Perez’s grandmother.
The driver who hit Perez stopped at the scene of the accident. Drugs and alcohol are not believed to have been a factor in the crash.
