Arvin Woman Killed, Man Hurt In Possible DUI Crash

An Arvin woman is dead and her driver hurt after being hit by a possible drunken driver at Edison Highway & DiGiorgio Road.

The crash happened about 3:30 p.m. near Lamont when California Highway Patrol officials said a Bakersfield man in a red truck ran a stop sign, crashing into the side of a white truck driven by the Arvin residents.

The 47-year-old Arvin female passenger died, and the 58-year-old male driver was taken to the hospital with major injuries.

CHP officials are now investigating if the Bakersfield driver at fault was driving under the influence.

The crash was initially reported as an attempted hit and run, but officers said the driver stayed on the scene and was “shaken up.”

Cause of the Kern Car Accident

If news accounts of KERO News are accurate, the man driving the red truck is likely  responsible for causing this accident, because he was allegedly driving under the influence and a high rate of speed. However, the incident is still under investigation by the California Highway Patrol and an official determination of the cause of the Kern County crash has not been made.

Personal Injury Liability for Drunk Driving Accidents

Drivers who choose to drink and drive may be liable for the consequences of their actions. In situations such as this one, the driver may be financially liable for medical expenses, lost earnings, pain and suffering, and other damages. While this accident remains under investigation, the victim’s family would be well-advised to contact an experienced and knowledgeable DUI Lawyer such as Gary A. Kessler. An attorney who specializes in representing victims of drunk driving accidents can help the injured victims protect their rights and ultimately recover the maximum compensation they are entitled to receive.

Two Pedestrians Killed in Incline Village Friday Night

The Nevada Highway Patrol says two pedestrians were killed when they were hit by a vehicle in Incline Village Friday night.

Troopers tell Channel 2 News that it happened around 7:30 p.m. on State Route 28. They say it happened by the Radio Shack, near Village Boulevard.

Troopers say the two unidentified pedestrians were crossing the street when a black 2006 Chevrolet pickup truck driving south on State Route 28 hit them.

The truck was driven by 27-year old Christopher Torii Smith of Grass Valley, California who was also carrying three passengers.

Troopers say witness statements and evidence shows the pedestrians were in a painted crosswalk, or nearby one when Smith allegedly hit them.

The male victim reportedly died at the scene, while the female victim died while being taken to Renown Regional Medical Center.

Troopers say the road was closed in both directions for about four hours before opening back up again a little after 11:30 p.m. Friday.

Smith later was arrested and taken into custody Friday night. They believe drugs may have been a factor in the fatal crash.

Smith was charged with two counts of driving under the influence causing death and failure to yield to pedestrians.

The Nevada Highway Patrol is asking anyone who may have information to call Trooper Mike Stapledon at 689-4623 about case number: NHP-111230851.

Cause of the Lake Tahoe Car Accident

If news accounts from North Lake Tahoe Bonanza News  reports are accurate, the pickup driver likely is responsible for causing this accident.  However, the incident is still under investigation by the  Nevada Highway Patrol.

Pedestrian Accidents and Wrongful Death Liability

As a pedestrian you should be able to walk in the crosswalk, feeling safe and confident.  Unfortunately, in California we know all to well that car drivers do not take the time to yield the right of way to pedestrians in crosswalks, and innocent pedestrians get seriously injured and sometimes even killed.

Bicycles have as much right to be on the road as other vehicles.  When automobile drivers violate the rights of a bicyclist, serious injuries and death can occur.

When you suffer serious/traumatic injuries or a loved one’s death, you are entitled to compensation (medical bills, funeral costs, lost wages, future wages and pain and suffering).  The Law Offices of Gary A Kessler will aggressively represent you and fight for your rights against the insurance companies for the monetary damages you deserve.

the insurance companies for the monetary damages you deserve.

The great majority of pedestrian injuries caused by motorists are due to the following:

  • DUI
  • Reckless driving
  • Cell phone usage
  • Ran a red light or stop sign- Failure to observe the crosswalk
  • Confusing temporary construction zones, forcing pedestrians to walk out of the crosswalks

If you or a loved one is involved in a serious pedestrian or bicycle accident:

  • Insist that a report is filed by the Police Department, California Highway Patrol, or Sheriff’s Department
  • Obtain essential information (i.e. name, address, insurance information, vehicle license number and driver license number of any and all persons involved in the accident)
  • Photograph the accident scene as well as all visible injuries
  • Shut up!  Talk to no one about the accident or your injuries other than your attorney or doctor, never to an insurance adjuster or insurance investigator.  Do not volunteer a statement to any insurance company.
  • Sign absolutely nothing without consulting a lawyer
  • Seek medical attention immediately and keep a diary of your level of pain
  • – Keep all receipts for all medical expenses and/or funeral bills and wage loss records
  • – Contact the Law Offices of Gary A Kessler or another experienced law firm immediately to protect your rights and preserve the evidence!

Both pedestrians were taken to Sunrise Hospital where the 52-year-old woman was pronounced dead. The male pedestrian, identified by police as 58-year-old John Salvo Jr., is in critical condition.

Woman Struck and Killed by Trash Truck

A pedestrian was struck and killed Thursday afternoon by a trash truck in a residential area of Westminster, an Orange County Fire Authority official said.

Authorities responded to a call about 1:15 p.m. at 9021 Madison Ave., where witnesses say a woman who appeared to be in her 40s was hit.

Capt. Marc Stone said the woman was taken to a hospital, where she was pronounced dead.

“She wasn’t in crosswalk or anything like that,” Stone said. “How the two came together, I have no idea.”

Witnesses have told police that the woman, identified as Betty Dietz, 65, was trying to flag down the garbage man when she stepped into the street and was accidentally run over, authorities said Thursday evening.

Dietz was standing near her house in a cul-de-sac in the 9000 block of Madison Avenue because she may have forgotten to put out her trash can. She stepped into the street to try to alert the driver, but the driver did not see her and exited his truck only after he heard the sound of her body being crushed, according to witnesses.

“At this point it looks like it was just a horrible accident,” Westminster Police Det. Alan Aoki said. “At this point we see nothing criminal.”

Sober Rides Available For New Year’s Eve

Law enforcement will be out in full force for the holiday weekend, so if you find that you’ve had too much to drink, there are a few options to help get you home safely.

For the 15th year, the Auto Club of Southern California will offer its free Tipsy Tow service again for the holiday weekend. From 6 p.m. Friday through 6 a.m. Sunday, you can call 800-400-4-AAA and the Auto Club will give you a free tow home of up to seven miles.

But AAA said there are some rules you need to follow: the ride is only available to the driver, no passengers can be included. And it’s a first-come, first-serve basis, you can’t call and make a reservation. The Auto Club said the program should be used as a last resort, and everyone should be planning to designate a sober driver early. They also said to bring your patience, because the two truck drivers will be very busy.

Law enforcement officials are encouraging anyone who sees a drunk driver out on the roads to call 911. Also, they warn that it’s not worth it to get behind the wheel if you’ve had a few drinks, because they’ll be out in force looking for impaired drivers. Officials report their holiday crackdown so far has been successful. Officers say they want to keep it that way, and make it through the holiday without a traffic-related death.

Pedestrian hit by one car, then dragged by a second

GARDEN GROVE — A 54-year-old man was seriously injured Wednesday night when he was struck by two cars, one of which fled while the other dragged him more than 700 feet, police said.

A Dodge Magnum traveling south on West Street near Acacia Avenue is believed to have struck Gregory Martin of Garden Grove, who was then hit by an SUV traveling in the same direction, said Jason Perkins, a collision investigator with the Garden Grove Police Department.

Martin was trapped underneath the SUV and was dragged along southbound West Street and onto Garden Grove Boulevard until the driver stopped the vehicle, Perkins said.

Police and paramedics arrived about 6:40 p.m., taking Martin to a hospital, where he was reportedly in critical condition.

While the driver of the SUV remained at the scene to talk to police, the driver of the Magnum fled before officers arrived, Perkins said.

A witness gave investigators a license plate number for the Magnum, which they reported finding abandoned in Santa Ana several hours after the accident.

“There was obvious and indicative damage to it,” Perkins said.

Police were searching for the driver of the Magnum.

It wasn’t immediately clear whether the pedestrian or the vehicles had right of way.

While there are unmarked crosswalks in the area, police do not know if Martin was walking in one of them.

The cause of the December 28  pedestrian accident remains under investigation by the Garden Grove Police Department.

Fatal Crash Involving Medical Transport Van

BAKERSFIELD, Calif. — Two vehicles collided at about 1 p.m. on Truxtun Avenue, sending a van into a tree near Camino Real restaurant killing one and injuring two.

Officers were sent to the intersection of Truxtun Avenue and Westwind Drive regarding a crash involving two vehicles.

An elderly woman driving a silver Cadillac attempted to turn north onto Westwind Drive from eastbound Truxtun Avenue directly into the path of a medical transport van, Sgt. Mary DeGeare said.

The van was being driven westbound on Truxtun Avenue, transporting three passengers, DeGeare said.

Officials Identify victim in Winchester Crash

Coroner’s officials have released the name of the 69-year-old Hemet woman killed during Monday’s head-on collision in Winchester that triggered the DUI arrest of the surviving driver.

Ella Anne Jefferson died at the scene of the 11:16 a.m. wreck along the eastbound lanes of Domenigoni Parkway, about three-quarters of a mile west of Leon Road.

Arrested at a hospital for investigation of driving while under the influence was 20-year-old Ryan Mahan of Menifee, said California Highway Patrol Officer Darren Meyer.

“Drugs and alcohol were considered to be a significant part of the collision,” Meyer said this morning.

The case now will reviewed to determine whether Mahan will be charged with gross vehicular manslaughter, the officer said.

The investigation began with reports of an erratic driver who was speeding and weaving through traffic while headed west on Domenigoni Parkway toward Menifee.

Before officers could intercept the motorist, the driver jumped a concrete curb and dirt divider and traveled into the eastbound fast lane where Mahan’s 2003 Saturn Ion slammed head-on into Jefferson’s gold 2011 Toyota Camry, Meyer said.

Mahan suffered two broken legs and internal injuries, Meyer said.

Both drivers were traveling alone.
