Fatal morning wreck on PCH in Malibu closes highway for hours

A preliminary investigation into a head-on crash that on Saturday killed one person, injured three others and forced the closure of Pacific Coast Highway in Malibu suggests that a blown tire may have started the deadly chain of events, officials said.

The 19-year-old driver of a red Ford Explorer told investigators he lost control of the sport-utility vehicle after his right rear tire blew out, according to Det. Richard Curry with Los Angeles County Sheriff’s Department.

The SUV crossed over into oncoming traffic where it crashed head on into a black Toyota 4Runner, which then spun out and collided with a Lexus.

Sheriff’s Sgt. Anthony Arnold said the dead person was a juvenile who had been a passenger in the Ford Explorer. Investigators said the victim and driver had been partying in the area the night before. It was not immediately known whether drugs or alcohol played a role in the crash, but investigators said they are looking into the possibility.

The crash was at 8:10 a.m. Saturday in an S-curve just east of the Los Angeles County fire battalion headquarters at Carbon Canyon Road. The vehicles came to rest at the western-most intersection of PCH and Rambla Pacifica, which intersects PCH twice .

PCH was reopened around 4 p.m. Saturday, several hours after the crash, according to California Highway Patrol officials. The area was cordoned off for the death investigation and to clear wreckage from the road.

There are no other roads along that section of the Malibu coast, which caused massive traffic snarls.

Resident Karen Horner said she was driving back to her home along PCH when she hit the traffic.

Authorities, Horner said, told her to park her car and walk home.

A SigAlert for the area was declared, but has since been lifted.

Automobile Collisions and Wrongful Death Liability

While the accident October 27 remains under investigation, the  family members of the victims would be well-advised to seek immediate consultation from an experienced wrongful death lawyer. An experienced attorney can advise the victims of their legal rights and decide the best course of action in recovering the maximum compensation for their injuries, lost wages, and pain and suffering. Also, in unique and complex situations such as this one, an attorney can hire a highly skilled independent investigator to reconstruct the scene of the accident to determine who is at fault.

The Law Offices of Gary A Kessler is a prominent and highly respected law firm in California and the United States.  Gary A Kessler has been serving the people as an experienced wrongful death attorney for over twenty years dedicated and committed to obtaining the best results for his clients in each and every case.  Through experience and education, our firm is able to expertly evaluate complex medical injuries and pursue wrongful death claims.

The Law Offices of Gary A Kessler has a sustaining record of outstanding results for their client’s wrongful death cases throughout California.  Our firm specializes in difficult automobile vs. tractor-trailer rig(s), collision cases, uninsured motorists cases, rollover accident cases, bus and train collision litigation, defective product liability litigation, boating collision death cases, boating capsizing and drowning cases, backyard pool drownings, jacuzzi spa drownings, association and community pool drownings, accidental shootings, tractor-trailer and commercial vehicle fatality, fuel tank fire cases and wrongful death cases.

The term “wrongful death” is defined as the death of an individual as a result of the negligence, carelessness, intentional act of another individual, corporation, company or entity.  Filing a proper wrongful death claim is extremely difficult and complex for families because they are not only dealing with their grief over the death of a beloved family member, but also complex issues of compensation as well.  Wrongful death claims are usually sought after by relatives, siblings, or members of the decedent’s estate who have lost a considerable amount of money as well as loss of support and grief due to the wrongful death of the decedent.

In most states, if the death of a relative or spouse was caused by the wrongful act of another, surviving family members can file a wrongful death lawsuit against the negligent party or parties.  In order to file a wrongful death claim, you must be able to prove that you will experience severe future emotional and financial hardship because of the loss of the death of a relative, family member or spouse.

The Hurt report Findings

A major work done on this subject in the USA is the Hurt Report, published in 1981 with data collected in Los Angeles and the surrounding rural areas. There have been longstanding calls for a new safety study in the US, and Congress has provided the seed money for such a project, but as yet the remainder of the funding has not all been pledged.

The Hurt Report concluded with a list of 55 findings, as well as several major recommendations for law enforcement and legislation. Among these, 75% of motorcycle accidents involved collision with another vehicle, usually a car. In the MAIDS report, the figure is 60%.

Other notable findings in the Hurt report (quoted below) were:

  • 75% of accidents were found to involve a motorcycle and a passenger vehicle, while the remaining 25% of accidents were single motorcycle accidents.
  • “In the single vehicle accidents, motorcycle rider error was present as the accident precipitating factor in about two-thirds of the cases, with the typical error being a slide-out and fall due to overbraking or running wide on a curve due to excess speed or under-cornering.”
  • “Almost half of the fatal accidents show alcohol involvement” and “injury severity increases with speed, alcohol involvement and motorcycle size.”
  • In the multiple vehicle accidents, the driver of the other vehicle violated the motorcycle right-of-way and caused the accident in two-thirds of those accidents.
  • The report’s additional findings show that the wearing of appropriate gear, specifically, helmets and durable garment, mitigates crash injuries substantially.
  • “Vehicle failure accounted for less than 3% of these motorcycle accidents, and most of those were single vehicle accidents where control was lost due to a puncture flat” and “Weather is not a factor in 98% of motorcycle accidents.”
  • “The failure of motorists to detect and recognize motorcycles in traffic is the predominating cause of motorcycle accidents… Conspicuity of the motorcycle is a critical factor in the multiple vehicle accidents, and accident involvement is significantly reduced by the use of motorcycle headlamps-on In daylight and the wearing of high visibility yellow, orange or bright red jackets.”

San Jose pedestrian hit and killed in traffic accident

An elderly San Jose woman was killed Friday evening when an SUV slammed into her as she was crossing a downtown street.

The accident happened about 5:08 p.m. at the intersection of Taylor Street and North 6th Street in Japantown.

Police said the 79-year-old pedestrian appeared to have been walking north across Taylor Street in or near the crosswalk when she was hit by a gray Toyota 4-Runner traveling west on Taylor.

The woman, who was not identified, was laying in the street when officers arrived and was pronounced dead at the scene.

The 32-year-old man driving the vehicle, who also wasn’t identified, remained at the scene and is cooperating with the investigation, according to a police Sgt. Jason Dwyer.

“It’s an area where there is a lot of pedestrian traffic,” Dwyer said. “I don’t know exactly what caused it. When we got out there, we didn’t see anything negligent in terms of speed.” He added that officers found no indication of drugs or alcohol being a factor in the accident.

Dwyer said the driver was allowed to leave without being ticketed and the incident remains under investigation.

Arcadia teen struck by car while riding bike dies

A 16-year-old Arcadia boy who was struck by a car while riding his bicycle over the weekend has died from his injuries, authorities said Wednesday.

Roger A. Lewis, who had been on life support following Saturday’s collision at Santa Anita Avenue and Duarte Road, died Tuesday at a hospital, Los Angeles County Department of Coroner Assistant Chief of Operations Ed Winter said.

The crash took place just before 10 p.m., Arcadia police officials said in a written statement.

The 2008 Chrysler Sebring struck the teenage cyclist, who was thrown from his bicycle, police said. Lewis, who was not wearing a helmet, suffered major head injuries.

He was pronounced dead at 9:53 a.m. Tuesday, Winter said. An autopsy was pending.

Lewis had been riding a Bianchi “fixed-gear” bicycle, police said.

The type of bicycle was originally developed for velodrome racing but has grown in popularity among recreational riders in recent years.

Lewis was a former student at Arcadia High School, where he studied for a little more than a year before transferring more than a year ago, Arcadia High School Principal Brent Forsee said.

“We’re very aware that even though he wasn’t a current student, he did have friends on campus,” the principal said. “He was a member of the community.”

Forsee said he wasn’t sure whether Lewis had been attending another school or was being home schooled.

Grief counselors and psychologists had been made available to AHS students, “just to counsel them, to be there,” Forsee said Wednesday.

He expressed sorrow for Lewis’ family and said as a result of the incident, school staff would be taking time to talk with students about helmets and bicycle safety.

The crash remained under investigation, however no crime was initially suspected, police said. Though toxicology results for both Lewis and the 26-year-old Arcadia man who was driving the involved car were pending, driving under the influence of drugs or alcohol did not appear to be a factor, authorities said.

“The department sends its condolences to the family and friends of the bicyclist, as well as to the driver and witnesses to the collision,” Le Veque said.

Bicycle Collisions and Wrongful Death Liability

The Arcadia Police Department will surely look at speed and other factors to determine why this accident occurred, and whether the driver  of the 2008 Chrysler Sebring could have done anything to avoid the collision. While this accident remains under investigation, the parents of the young boy fatally injured in this collision would be well-advised to speak with an experienced and knowledgeable bicycle accident lawyer. An attorney who understands the unique legal issues of car vs. bicycle accidents can review the  report and determine who is responsible for this collision. If the driver of the vehicle is determined to be responsible, he may be liable for the young victim’s medical care expenses, pain and suffering, and other damages.

Bicycles have as much right to be on the road as other vehicles.  When automobile drivers violate the rights of a bicyclist, serious injuries and death can occur.

When you suffer serious/traumatic injuries or a loved one’s death, you are entitled to compensation (medical bills, funeral costs, lost wages, future wages and pain and suffering).  The Law Offices of Gary A Kessler will aggressively represent you and fight for your rights against the insurance companies for the monetary damages you deserve.

San Bernardino Mountains: Runaway rig hits car, crash kills 2

A truck driver jumped or fell to his death along a mountain highway, leaving a runaway rig to jackknife across an entire road until it crushed an oncoming car, killing that driver and injuring the passenger, investigators say.

A mechanical inspection will be conducted on the three-axle flatbed truck to determine whether its brakes failed prior to the wreck, which closed Highway 330 between Highland and the mountaintop town of Running Springs from about 2:30 p.m. until well beyond sunset Monday, Oct. 22.

“We have no witnesses who saw the collision, so it’s undetermined whether he was ejected … or otherwise,” California Highway Patrol Officer Gary Fernandez said.

Killed were the drivers of the truck and a white 2005 Acura RL.

The car’s passenger — a 58-year-old woman — was taken to a hospital for treatment of chest and left leg pain and scrapes to her right hand, Fernandez said.

Both occupants of the car are from the Big Bear area, but none of the three victims’ names have been released.

“He’s a real nice guy. He was the life of the crew,” concrete company official Art Rodriguez said of the truck driver, whom he said was married and the father of four children. “Very easy going. He always offered (his assistance) if anybody needed help.”

The driver was part of a five-man crew that had been returning from a Big Bear-area jobsite to the Monrovia headquarters of Cell-crete Specialty Concrete Contractors, said Rodriguez, the firm’s safety director.

The crew’s other four workers were following in a pickup well behind the flatbed truck, which was pulling a trailer loaded with a Bobcat earthmover and a forklift. The pickup wasn’t involved in the accident.

The wreck began on a straight stretch of Highway 330 when the truck left the road and climbed a hillside, then veered back onto the highway, said Fernandez, the CHP officer.

Soon after that, the truck driver flew out of the cab and died where he fell. But the truck rolled on for about another 150 feet.

“We now have a driverless truck continuing (downhill and veering) into the up-bound lane,” Fernandez said. “It’s jackknifing and is across both lanes. The Acura had nowhere to go and drove under the flatbed truck.”

Fire crews had to cut the couple free of the car’s wreckage.

Victims of Temecula Fatal Identified as Seniors

Two people who died at the scene of a fatal crash in Temecula were identified as senior citizens from Yorba Linda.

Amar Jain, 74, and Cheryl Jain, 66, were both pronounced dead at the scene of the crash, according to the Riverside County Coroner’s office.

Amar Jain was the driver and was trapped in the sedan; he was pronounced dead at 3:18 p.m.

Authorities have determined that a Temecula man ran a red light and killed an elderly couple Saturday.

Deputies determined that a Hyundai sedan broadsided a Honda CRV as the Honda made a left- turn onto eastbound Rancho California Road from Jefferson Avenue, Riverside County Sheriff’s Sgt. John Magnan said.

Amar Jain, 74, and Cheryl Jain, 66, both of Yorba Linda, died at the scene, the sergeant said.

The driver of the Hyundai, Christopher Bostic, was heading west on Rancho California Road when he entered the intersection “against a red light,” Magnan said in a statement.

Bostic was taken to an area hospital for unspecified major injuries.

It’s too early to say whether alcohol played a role in the crash, Magnan said, as that part of the investigation was ongoing.

Traffic was snarled for more than five hours following the 3:03 p.m. Saturday collision.

Automobile Collisions and Wrongful Death Liability

While the accident October 20 remains under investigation, the  family members of the victims would be well-advised to seek immediate consultation from an experienced wrongful death lawyer.
