Wrongful Death

Vallejo Police Identify Boy Killed In Garbage Truck Crash

VALLEJO (CBS SF) — Vallejo police have identified the boy who died Friday in a skateboarding accident as 12-year-old Joseph Tafoya.

Tafoya and 8-year-old Kaleo Young of Vallejo were both sitting on the same skateboard as they rode downhill on Chapman Court around 12:35 p.m., Officer Michael Nichelini said.

The skateboard collided with and went under a Recology Vallejo waste collection truck driven by Jamie Castillo-Noyola, 36, of Vallejo at the Linfield Drive intersection, Nichelini said.

Tafoya died at Kaiser Permanente Vallejo Medical Center and Young was taken to Children’s Hospital in Oakland. He underwent surgery for injuries that are not life threatening, Nichelini said.

On Friday, police said the driver said that he tried to swerve and stop to avoid hitting the boys on the skateboard.

The driver’s attorney has not allowed police to talk to his client, Nichelini said Monday.

Recology Vallejo said in a statement it extends its deepest sympathies to the friends and families of Joseph Tafoya and is hopeful Young fully recovers.

Recology Vallejo spokesman Adam Alberti said the company is assisting authorities in the investigation of the tragic accident.

Nichelini said the collision is still under investigation.

Cause of the Vallejo accident

If news accounts in the CBS News are accurate, the driver of the garbage truck is likely  responsible for causing this accident. However, the accident is still under investigation by the Vallejo Police Department and an official determination of the cause of the Solano County crash has not been made.

Divers search for recording device in fatal jet ski crash

Divers planned to spend Monday plumbing the Puddingstone Reservoir in San Dimas for a recording device that may have information about a crash between a motor boat and a jet ski that killed three women.

Deputies assigned to the Sheriff’s Special Enforcement Bureau-Emergency Services Detail as divers, along with Los Angeles County Lifeguard divers, are searching the water for a recording device
that was mounted to the women’s watercraft.

The boat and watercraft collided Saturday afternoon in the reservoir, located in Frank G. Bonelli Regional Park.

The women who died were all on the jet ski. They were identified by coroner’s officials as Mari-Con Abello, 34, of Escondido; her mother, Aurora Yeso, 59, of San Dimas; and Anesia Barba Bautista, 59, of Glendora.

They were pronounced dead at the scene. The four occupants of the motorboat were treated for injuries at hospitals and released.

Authorities have said the powerboat driver was not intoxicated. It was unclear whether the women who died had been drinking.

Officials asked anyone with information to contact the L.A. County Sheriff’s Department homicide bureau at (323) 890-5500. Anonymous calls may be made to Crime Stoppers at 800-222-TIPS (8477).

Boating Accident Personal Injury Liability

The most common boating accidents are collisions with other boats, sinkings, capsizings and boat disappearances.

Boating accidents occur very quickly and in many different places.  Lakes, canals, rivers, intercoastal waterways and oceans are where tragedies normally occur.  Last year in California, there were 744 boating accidents involving 439 injuries and 44 fatalities.

According to the United States Coast Guard each year there are more than 8,000 boating accidents in the U.S. that result in 4,000 serious injuries and 800 deaths.

Many times a boater will have been speeding or may have had too much alcohol.

There are specific boating laws that must be followed or fatalities can occur.  The Law Offices of Gary A Kessler is familiar with the different state’s boating laws.  We know the boating liability issues and will inform you of your true state, local and Federal boating rights and legal options which will result in successful outcome in your case.

It is a general rule of law that the operator of a boat and its owner has a duty to exercise a reasonable degree of care in order to prevent injuries to others.  The most common boating accidents are collisions with other boats, sinking and boat disappearance.  Boating injuries usually occur because of a reckless or careless operator, alcohol, boat malfunctions or an inexperienced boating (captain) operator.

Operators of boats have a legal obligation to operate their watercraft in a safe and prudent manner.  The overwhelming majority of boating accidents are caused by factors that can be controlled by the operator of the boat.  The primary cause of boating accidents nationwide was operator inattention, followed by careless/reckless operation, operator inexperience, operating at an unsafe speed, and failure to have a proper lookout.

Common violations of the duty of ordinary care in a maritime setting include a failure to warn against foreseeable harm, violations of “rules of the water,” such as excessive speed, failure to have proper lights, failure to yield, intoxication and others.  Owners may also be held liable under the theory of vicarious liability.  For example, an owner may be held liable for an operator’s failure to warn passengers of intended maneuvers, overloading the boat or permitting the guest to sit in a dangerous position.

Accidents involving bystanders, such as swimmers or water skiers, are typically treated in the same manner as cases involving social guests.  The law and courts where the accident occured will generally control any lawsuits brought by injured bystanders unless the defendant boat owner asserts admiralty jurisdiction.

Disneyland employee killed while bicycling home

ANAHEIM – A vehicle fatally struck a woman, identified as a Disneyland employee, while she was riding her bicycle home from work early Thursday morning.

Police later identified the victim as Margaret Conway, 21, from Anaheim

Anaheim police received a call regarding a traffic collision between a vehicle and a bicyclist on Ball Road and the I-5 at 12:30 a.m., said Sgt. Bob Dunn of the Anaheim Police Department.

Dunn said the woman was riding her bicycle eastbound on Ball Road in the No. 1 lane and was crossing the I-5 over pass when a white Ford sport utility vehicle struck her from behind.

The woman was pronounced dead at a nearby trauma center, Dunn added.

The driver of the sport utility vehicle remained at the scene and at this point alcohol does not appear to be a factor in the collision, Dunn said.

Thursday morning, Disneyland officials released a statement about the fatal collision.

“I join with all of our cast members as we mourn the loss of one of our own,” said George A. Kalogridis, president of the Disneyland Resort.

“Our thoughts are with her family, friends and co-workers after this tragic accident.”

Cause of the Anaheim Accident

If news accounts in the Orange County Register are accurate, the driver of the sports utility vehicle is likely  responsible for causing this accident. However, the accident is still under investigation by the Anaheim Police Department and an official determination of the cause of the Orange County crash has not been made.

Woman dies when tree lands on car

COSTA MESA – One person was killed when a tree slammed into a car Thursday afternoon, authorities said.

Police received initial reports of a vehicle crashing into a tree, but when officers arrived at the scene, it wasn’t immediately clear how the driver was injured, Costa Mesa police Lt. Mark Manley said.

“It may have been a tree just fell onto the car,” Manley said.

Rescuers responded to the intersection of Irvine Avenue and 17th Street about 2 p.m.

A 50-foot eucalyptus tree landed on top of the vehicle, which was occupied by one person.

A helicopter was initially called to transport a woman to a hospital, authorities said, but was called off when she was pronounced dead at the scene.

Authorities have not identified the woman nor released her age.

Newport resident Pier Warmuth said she was driving a convertible with its windows down westbound on 17th when the tree fell. Warmuth said she didn’t hear or see any collisions and indicated that there wasn’t any wind in the area at the time.

“All of a sudden, there was a weird creaking noise, then everyone was looking around and suddenly there was the tree,” Warmuth said.

A man got out of another vehicle to try to help the woman, Warmuth said, but was unable to reach her.

“There was nothing you could do. The tree was enormous, and it was lying right on the driver’s side,” Warmuth said. “It just happened so quickly. It could have been any of us.”

Both directions of Irvine Boulevard were closed from 17th Street to Mariners Drive, Costa Mesa police Lt. Bryan Glass said, as investigators go over the scene and workers remove the tree and the car.

Thousand Oaks man reportedly killed in Santa Barbara showgrounds accident

A Thousand Oaks man reportedly was killed Monday in Santa Barbara as he dismantled equipment used during a rodeo at the Earl Warren Showgrounds last weekend, a Santa Barbara County Fire Department spokesman said.

A 1,500-pound monitor fell on the man around 1 p.m. When firefighters arrived, they found workers had moved the screen off the man, who was unconscious and not breathing, said Brian Hayden, an engineer and inspector with the Santa Barbara County Fire Department.

“CPR was performed on him on the way to Cottage Hospital, which is just the short distance away,” Hayden said.

The man’s identity could not be confirmed, but he reportedly was a Thousand Oaks business owner.

Cause of the Showgrounds Accident

The accident that occurred on August 8th remains under investigation by authorities. However, based on the limited information provided by KSBY and KYET, it is unclear why the  1500lb. Jumbotron LED screen fell on Mann. Hopefully authorities can come to a conclusion of what happened and why.

Fault and Wrongful Death Liability

Accidents such this one have unique and complex issues. The general contractor, and all subcontractors at the site where the Jumbo Screen was being installed, have a duty to make the working environment as safe as possible. If for any reason a party was negligent in maintaining a safe work area, they will be held liable for all injuries or fatalities that occur. Therefore, family members of the victim are well advised to seek an experienced California wrongful death attorney. A knowledgeable attorney who has the experience in these particular accidents can hire a private investigator to take photographs, interview witnesses and gather evidence to determine fault. The attorney can also protect the families legal rights  and possibly receive compensation for funeral/burial expenses, lost wages, pain and suffering, and other damages relating to this horrific tragedy.

The term “wrongful death” is defined as the death of an individual as a result of the negligence, carelessness, intentional act of another individual, corporation, company or entity.  Filing a proper wrongful death claim is extremely difficult and complex for families because they are not only dealing with their grief over the death of a beloved family member, but also complex issues of compensation as well.  Wrongful death claims are usually sought after by relatives, siblings, or members of the decedent’s estate who have lost a considerable amount of money as well as loss of support and grief due to the wrongful death of the decedent.

In most states, if the death of a relative or spouse was caused by the wrongful act of another, surviving family members can file a wrongful death lawsuit against the negligent party or parties.  In order to file a wrongful death claim, you must be able to prove that you will experience severe future emotional and financial hardship because of the loss of the death of a relative, family member or spouse.
