Vancouver man dies in Woodland collision

WOODLAND, Wash. (AP) — The Clark County sheriff’s office says a 76-year-old Vancouver man was killed and three other people were injured in a head-on collision late Tuesday night in Woodland.

Roy E. Thorp, 76, died in the accident. Constance A. Jones, 72, of Vancouver, and Patrick S. Wisniewski, 23, of Woodland, were critically injured and taken to Peace Health Southwest Medical Center.

Sgt. Scott Schanaker said Tyler G. Peabody, 20, of Woodland, was westbound on NW Hayes Road in a 1992 Mustang. He was passing another vehicle on a curve in a no passing zone when he lost control.

The Mustang started to swerve an crossed into the oncoming lane, hitting a 2002 Subaru head-on driven by Thorp. Speed, alcohol and drugs were all factors in the crash, Schanaker.

Cause of the Clark County  Accident

The cause of the August 2nd crash remains under investigation by the Washington Highway Patrol. However, based on the limited information provided by AP News, the driver of the Subaru likely could have done nothing to prevent this horrific collision.

The term “wrongful death” is defined as the death of an individual as a result of the negligence, carelessness, intentional act of another individual, corporation, company or entity.  Filing a proper wrongful death claim is extremely difficult and complex for families because they are not only dealing with their grief over the death of a beloved family member, but also complex issues of compensation as well.  Wrongful death claims are usually sought after by relatives, siblings, or members of the decedent’s estate who have lost a considerable amount of money as well as loss of support and grief due to the wrongful death of the decedent.

In most states, if the death of a relative or spouse was caused by the wrongful act of another, surviving family members can file a wrongful death lawsuit against the negligent party or parties.  In order to file a wrongful death claim, you must be able to prove that you will experience severe future emotional and financial hardship because of the loss of the death of a relative, family member or spouse.

3 women killed, 2 hurt in fiery crash ID’d

BUENA PARK – The three women who were killed and the two others who were seriously injured in an I-5 crash Monday night were returning from a church service at Crystal Cathedral, the California Highway Patrol said.

Pronounced dead at the scene were Sara Flores, 40; Angela Prado, 49; and Elda Nava-Mayo, 24, according to the coroner’s office. They were all from Downey.

The driver, identified by the CHP as Ruth NavaTorres, and a 16-year-old passenger, both from Downey, were taken to UCI Medical Center with major injuries, the CHP said. Conflicting reports have been released regarding the age of the driver.

It appears the women were related, the CHP said.

The crash occurred at about 10:15 p.m. when the driver of the Ford Excursion, traveling at a high rate of speed, lost control of the vehicle on northbound I-5 toward Beach Boulevard, the CHP said.

The Excursion hit a guard rail, rolled over multiple times and wound up on its side just west of the Auto Center Drive on-ramp to northbound I-5, the CHP said.

CHP officer Ray Payton said the initial investigation suggests the women did not wear their seatbelts. Alcohol is not believed to be a factor in the crash, Payton said.

Initial reports indicate that Buena Park police arrived shortly after 10:19 p.m.

Patricia Espinoza, 21, a Good Samaritan, said she was at the scene before emergency crews or officers arrived. With the help of another man, she helped pull the driver out of the burning vehicle. She said the other women inside the vehicle had been ejected.

Espinoza added that another man helped her pull the 16-year-old girl away from the smoldering vehicle. She was lying on the ground, close to the vehicle, Espinoza said.

Buena Park police Sgt. William Kohanek said officers noticed that two of the victims were out of the vehicle, but appeared to be dangerously close to the flames and chose to pull them to a safer distance, Kohanek said.

Once they assessed their injuries, officers realized the victims were already dead.

The other woman inside the vehicle was ejected further away from the vehicle, Espinoza said

Woman who died after 4 vehicle collision ID’d

IRVINE – Authorities have identified a 22-year-old woman who died after a four-vehicle collision at an Irvine intersection Tuesday afternoon that left one other woman injured.

Orange County Coroner’s Office officials late Tuesday identified Elizabeth Eddleman of Irvine as the woman who died after her car was reportedly struck in an afternoon collision.

Officers about 4:15 p.m. responded to an accident at the intersection of University Drive and Rosa Drew Lane, just before Rosa Drew turns into Ridgeline Drive in the University Park community, Irvine police Lt. Julia Engen said.

Police say that according to their preliminary investigation, a 2010 BMW coupe traveling south on Rosa Drew Lane was struck by a 2003 Mercury Mountaineer traveling west on University Drive.

The SUV apparently crashed into the BMW on the driver’s door, police said, causing the two vehicles to careen toward a postal truck and a minivan in the intersection.

Eddleman, who was driving the BMW, had to be cut from the car before being taken to a hospital in critical condition, Engen said. She died after being taken from the scene.

The driver of the SUV, who police identified only as a 26-year-old Corona del Mar resident, was taken to a hospital in serious condition. Her injuries are not believed to be life-threatening.

The occupants of the minivan and the postal truck were not injured.

The eastbound lanes of University were closed for more than five hours after the crash, snarling traffic in the area.

Investigators have not yet determined which vehicle had right of way in the intersection.

Cause of the Irvine Car Accident

If news accounts from the Orange County Register  reports are accurate, the SUV driver likely is responsible for causing this accident.  However, the incident is still under investigation by the  Irvine Police Department.

2 dead, 5 hurt in crash on Lake Tahoe highway

Authorities say two people are dead and five people are hurt after a three-vehicle crash on a highway on the northeast Lake Tahoe shoreline.

The Nevada Highway Patrol is investigating the crash that killed two men in Lake Tahoe.

The accident happened around 3:30 Tuesday afternoon on Highway 28 just south of Sand Harbor. Troopers say the driver of a pickup truck drifted across the median and hit a semi truck. There was a car right behind the semi, and the car’s driver pulled over to the shoulder. But the pickup slammed into the car.

Two men inside the car died at the scene. Two women who were in the car were taken to the hospital in critical condition. The driver of the pickup truck and his three passengers have non-life threatening injuries.

The accident closed that section of Highway 28 for several hours as the Nevada Highway Patrol investigated the crash.

Cause of the Lake Tahoe Car Accident

If news accounts from KOLO-TV in Reno reports are accurate, the pickup driver likely is responsible for causing this accident.  However, the incident is still under investigation by the  Nevada Highway Patrol.

Boy Killed While Riding Go-Kart

A Bakersfield family is heartbroken after an accident killed their boy. 9-year-old Donald Orwig, Jr. was riding his go kart in a southwest Bakersfield alley when a truck ran over him.Family members and neighbors say kids play in the alley all the time. Tuesday afternoon began as a typical summer play day, but ended up leaving neighbors shocked and heartbroken. “He’s the greatest kid. He really loved everybody. He laughed, he played, he loved it all,” said Donald Orwig, the boy’s father. D.J. Orwig loved his electric go kart, a gift from his parents for being a good boy. “He was just amazing. I don’t know what to say, I lost my life,” said the boy’s mother, Pam Miller. D.J. was the youngest in his family, a family that is now pulling together to try and deal with their loss. “When I was looking to see who was accelerating in the alley, that’s when I saw D.J. go in front of him.” D.J.’s family says they heard the truck come around the corner, accelerate and strike the boy in the alley. “I was yelling immediately. I was going out to stop him because he wouldn’t stop right away or whatever. Anyway after I got him stopped, I ran and got my car jack and jacked up the truck best I could to pull him out,” said his father. Don Orwig, Sr. tried to revive his son with CPR. Witnesses say the driver of the pickup truck jumped out and ran, but came back with family. He does not speak English. “We were face to face and I was yelling he killed my baby and he had a look on his face like he didn’t know what I was saying,” said D.J.’s mother. The driver, 23-year-old Leonel Vasquez, cooperated with police and underwent sobriety tests. Neighbor Vicki Ware says the driver had a near-miss with her children before hitting the 9 year old boy. “We had to holler at him to stop cause there’s kids behind you, and it looked like he was kind of in a hurry.” “Speed limit in any alley way is 15 miles per hour, and basically what they’ll look at his pre- and post-collision skid,” explained Bakersfield Police Sergeant Allan Abney. Bakersfield traffic officers will look into the driver’s speed. They are also awaiting results from toxicology tests which could take four to six weeks. Ware and other neighbors are torn up, recalling what they saw. “She was hollering you killed my kid, you killed my kid come back, come back. You know just the goose bumps thinking that, that could have been my grandson.” Bakersfield police say Vasquez did not run, but fully cooperated with them. Right now he is free with no charges filed. But, if evidence shows Vasquez was under influence, he could be charged with reckless driving and involuntary manslaughter.

The crash occurred at about 1:25 a.m. near Chapman Avenue in the No. 4 lane and shut down the northbound lanes for two hours, said California Highway Patrol officer Devon Boatman.

Irvine crash victim declared dead

IRVINE – Students arrived at Northwood High School wearing white tees and shirts Tuesday morning, a sign to celebrate the life and mourn the loss of a classmate killed in a Sunday crash.

Five people were injured in the holiday weekend crash that killed Ashton Sweet, a 14-year-old cheerleader at Northwood High School. She suffered an irreversible brain injury.

Sweet had been kept alive on a breathing machine so her organs could be evaluated for donation. She was declared dead at 1 p.m. Tuesday, according to the Orange County Coroner’s Office. Ashton’s parents had made the determination to allow for organ donation, police officials said.

Krista Merassa, 15, was reported in critical condition.

“This is just devastating,” said Ian Hanigan, spokesman for the Irvine Unified School District. “There is nothing worse that our school community can go through than to lose somebody so young. Our thoughts and our prayers are with Ashton’s family, as well as with all of those who were in the car.”

On Tuesday morning, several students at Northwood High School were seen wearing white, walking past news vans and reporters on their way to class.

Austin Jeffrey Farley was taken into custody after the Sunday morning crash on suspicion of driving under the influence. According to online arrest records, he is being held in lieu of $1 million bail.

No formal charges have been filed against the 26-year-old driver. The investigation is open and the District Attorney’s Office does not have all of the evidence so a decision has not  been made on filing charges, Chief of Staff Susan Kang Schroeder said.

Farley has had several run-ins with the law, including previous DUI arrests, according to court records.

Farley was arrested by the California Highway Patrol on May 4, 2004. Being a 19-year-old driver at the time, he was charged with being a minor with a blood-alcohol-content of .05 percent or more, court records show. That charge was dismissed in June 2004 after he was sentenced to a diversion program.

In July 2004, Farley was back in court, charged with having a license suspended after allegedly refusing to submit to a chemical test. Farley pleaded guilty to the charge and was sentenced to three years probation and $300 in fines.

In February 2009, he was pulled over by authorities again. He was charged with driving under the influence, disobeying a court order, battery on a peace officer and driving with a suspended license. He pleaded guilty to the charges and was sentenced to three years of probation, 104 hours of service in lieu of fines, 30 days in jail, six months in a first-offender alcohol program, and to attend a victim’s panel for Mothers Against Drunk Driving.

Friends and family said the four girls were out celebrating a friend’s birthday Saturday night and were being driven home by the father of the girls when the crash occurred about 1 a.m. Sunday.

Michael Ghaemi, 48, was driving the girls in an E-Class Mercedes-Benz on Culver Drive. He said he was passing through Irvine Boulevard when they were struck by a pickup on the left-rear side of the car.

On Sunday night, friends and family of the girls gathered at the site of the crash, lighting candles, bringing flowers and leaving notes for Ashton.

“We are doing our best to support the kids,” Hanigan said.

Five counselors are expected to be available on campus Tuesday, reaching out to friends and classmates of the teenage girls injured in the crash.

Ashton was a cheerleader and in track-and-field, Hanigan said. She was also involved in the high school’s “Wolfpack” club, which pairs special-needs students with other students for school activities.

Cause of the Irvine Car Accident

If news accounts in the Orange County Register are accurate, Austen Jeffrey Farley likely is responsible for causing this accident, because he was allegedly driving under the influence and a high rate of speed. However, the incident is still under investigation by the Irvine Police Department and an official determination of the cause of the Orange County crash has not been made.

Woman killed when car collides with Inglewood police cruiser

A woman was killed in Inglewood early Tuesday morning after the vehicle she was riding in was involved in a crash with a police cruiser, authorities said.

The incident occurred just before 1 a.m. at the intersection of Prairie Avenue and Manchester Avenue, according to Officer Travis Ruiz, a spokesman for the California Highway Patrol.

Ruiz said three Inglewood Police Department patrol cars with their lights and sirens on were responding to a call of shots fired in another part of the city about four miles away.

The first police vehicle made it through the intersection. The second car collided with a Range Rover, Ruiz said.

It is not clear who had the right of way, Ruiz said. The patrol car video and red-light camera are being reviewed, he added.

The police cruiser hit the front right side of the Range Rover, which spun around, and the force ejected a female in the front passenger seat, Ruiz said. The woman, between 40 and 45 years old “suffered fatal injuries from striking the concrete,” Ruiz said.

The driver of the Range Rover and the police officers in the patrol car suffered minor injuries, Ruiz said. They were treated at a hospital and later released. No further details were available. The investigation is “still in the very beginning stages,” Ruiz said

Cause of the Inglewood Accident: Based on the limited information provided in news accounts, it is unclear what exactly happened. This accident raises a number of questions and it is not evident why the police cruiser was not able to avoid the collision. Was the driver not paying attention? Police will surely look at speed and other factors in determining the cause of the accident. Hopefully, the investigation will reveal exactly what happened and who was responsible. If the investigation reveals that the police cruiser driver caused this collision, the driver  maybe liable for the victim’s injuries, in which case, the victim’s heirs may be entitled to damages for medical expenses, lost earnings, pain and suffering, and other accident-related expenses. The family members of the victim would be well advised to contact California Wrongful Death Attorney Gary A. Kessler about their legal rights in a wrongful death claims.
